JOINT RESOLUTION AND ORDER

On Amendments to the Joint Resolution of the Board of the National Bank of the Republic of Kazakhstan dated September 26, 2025 No. 56 and Order of the Minister of Finance of the Republic of Kazakhstan dated September 29, 2025 No. 544 "On Approval of the Rules for Determining the Market Exchange Rate of Currency"

The Board of the National Bank of the Republic of Kazakhstan RESOLVES and the Minister of Finance of the Republic of Kazakhstan ORDERS:

1. Make the following changes to the Joint Resolution of the Board of the National Bank of the Republic of Kazakhstan dated September 26, 2025 No. 56 and Order of the Minister of Finance of the Republic of Kazakhstan dated September 29, 2025 No. 544 "On Approval of the Rules for Determining the Market Exchange Rate of Currency" (registered in the Registry of State Registration of Normative Legal Acts under No. 36983):

in the Rules for Determining the Market Exchange Rate of Currency, approved by the aforementioned joint resolution and order:

rephrase paragraph 2 as follows:

"2. The market exchange rate of currency is determined daily on working days on which the Joint Stock Company "Kazakhstan Stock Exchange" (hereinafter – the Exchange) conducts trading in foreign currencies, in the following manner:

1) for the United States dollar (hereinafter – USD), the market exchange rate of currency is determined as the weighted average exchange rate of tenge to the US dollar, established as of 15:30 Astana time;

2) for other foreign currencies, the market exchange rate of currency in relation to the tenge is determined as a cross-rate, calculated using the market exchange rate of the US dollar in relation to the tenge and the rates of these currencies to the US dollar, established as of 16:00 Astana time.

The National Bank of the Republic of Kazakhstan on the day of trading at the Exchange fixes the exchange rates of foreign currencies in relation to the tenge, determined in the manner established by this paragraph, for foreign currencies specified in the appendix to the Rules for Establishing the Official Exchange Rate of the National Currency of the Republic of Kazakhstan to Foreign Currencies, approved by the Resolution of the Board of the National Bank of the Republic of Kazakhstan dated August 24, 2012 No. 242 "On Approval of the Rules for Establishing the Official Exchange Rate of the National Currency of the Republic of Kazakhstan to Foreign Currencies" (registered in the Registry of State Registration of Normative Legal Acts under No. 7977) (hereinafter – Rules on Official Rates).

Market exchange rates for exchange currencies not specified in the appendix to the Rules on Official Rates are determined by organizations independently in the manner established by this paragraph. The use of the exchange rate of a foreign currency to the US dollar, published in the Financial Times newspaper or on its internet resource, as well as on the Bloomberg or Refinitiv information portals, on the day of establishing the market exchange rate of the US dollar in relation to the tenge, is permitted.";

rephrase the first part of paragraph 4 as follows:

"4. Financial organizations (except for legal entities carrying out activities exclusively through exchange offices based on a license of the National Bank of the Republic of Kazakhstan for exchange operations with cash foreign currency), branches of banks - non-residents of the Republic of Kazakhstan, branches of insurance (reinsurance) organizations - non-residents of the Republic of Kazakhstan and branches of insurance brokers - non-residents of the Republic of Kazakhstan, Joint Stock Company "Development Bank of Kazakhstan", joint investment funds, special financial companies, Islamic special financial companies, as well as the National Bank of the Republic of Kazakhstan and legal entities, fifty or more percent of shares (parts of participation in the authorized capital) or controlling block of shares of which belong to the National Bank of the Republic of Kazakhstan, for the purpose of maintaining accounting records, forming financial reporting and reporting on accounting data, carry out recalculation of assets and liabilities subject to recalculation in accordance with international financial reporting standards, at the end of the day on which trading was conducted at the Exchange, using the market exchange rate of currency, determined in the manner established by paragraph 2 of the Rules.";

rephrase paragraph 5 as follows:

"5. Financial organizations (except for legal entities carrying out activities exclusively through exchange offices based on a license of the National Bank of the Republic of Kazakhstan for exchange operations with cash foreign currency), branches of banks - non-residents of the Republic of Kazakhstan, branches of insurance (reinsurance) organizations - non-residents of the Republic of Kazakhstan and branches of insurance brokers - non-residents of the Republic of Kazakhstan, Joint Stock Company "Development Bank of Kazakhstan", joint investment funds, special financial companies, Islamic special financial companies, as well as the National Bank of the Republic of Kazakhstan and legal entities, fifty or more percent of shares (parts of participation in the authorized capital) or controlling block of shares of which belong to the National Bank of the Republic of Kazakhstan, in the presence of a digital system allowing the maintenance of accounting records using the market exchange rate of currency, determined in the manner established by paragraph 2 of the Rules, for the purpose of maintaining accounting records, use the market exchange rate of currency, determined in the manner established by paragraph 2 of the Rules, on the day of trading at the Exchange and subsequent non-working days without carrying out recalculation at the end of the day, or carry out recalculation of assets and liabilities subject to recalculation in accordance with international financial reporting standards, at the end of the day on which trading was conducted at the Exchange, using the market exchange rate of currency, determined in the manner established by paragraph 2 of the Rules.".

2. The Accounting Department of the National Bank of the Republic of Kazakhstan in the manner established by the legislation of the Republic of Kazakhstan ensure:

1) jointly with the Legal Department of the National Bank of the Republic of Kazakhstan state registration of these joint resolution and order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of these joint resolution and order on the official internet resource of the National Bank of the Republic of Kazakhstan after their official publication;

3) within ten working days after the state registration of these joint resolution and order, submission to the Legal Department of the National Bank of the Republic of Kazakhstan of information on the implementation of the measure provided for in subparagraph 2) of this paragraph.

3. Control over the implementation of these joint resolution and order is entrusted to the First Deputy Chairman of the National Bank of the Republic of Kazakhstan and the Vice-Minister of Finance of the Republic of Kazakhstan.

4. These joint resolution[1] and order are subject to official publication and enter into force upon the expiration of ten calendar days after the day of their first official publication.
