CHAPTER ONE: GENERAL PROVISIONS
Article One: Purpose of this Law
This Law determines the organization and functioning of Deposit Guarantee Fund for banks and microfinance institutions hereinafter referred to as “Fund”.
Article 2: Definitions
For the purpose of this Law, the following terms shall have the following meanings:
Banque Nationale du Rwanda, spécialement en ses articles 5, 6, 9, 56 et 58 ; Vu la Loi no 007/2008 du 08/04/2008 portant organisation de l’activité bancaire, spécialement en ses articles 63, 64 et 95 ; Vu la Loi n° 40/2008 du 26/08/2008 portant organisation de l’activité de microfinance telle que modifiée et complétée à ce jour, spécialement en ses articles 38, 39 et 79; ADOPTE :
CHAPITRE PREMIER: DISPOSITIONS GENERALES
Article premier: Objet de la présente loi
La présente loi détermine l’organisation et le fonctionnement du Fonds de Garantie des Dépôts pour les banques et les institutions de microfinance ci-après dénommé « Fonds ».
Article 2: Définitions
Aux fins de la présente loi, les termes repris ci￾après ont les significations suivantes:

igipimo cy’inyungu fatizo ku isoko ry’imari gishingirwaho mu kuguriza Ikigega kandi gitangazwa na Banki Nkuru y’u Rwanda. UMUTWE WA II: IMICUNGIRE Y’IKIGEGA Ingingo ya 3: Imicungire Ikigega gicungwa na Banki Nkuru y’u Rwanda. Ingingo ya 4: Komite Ngishwanama Hashyizweho Komite Ngishwanama y’Ikigega ifite inshingano yo kugira inama Banki Nkuru y’u Rwanda ku bijyanye n’imicungire y’Ikigega. Iteka rya Minisitiri ufite Imari mu nshingano ze rishyiraho abagize Komite Ngishwanama y’Ikigega rikanagena inshingano zabo n’igihe bamara ku mirimo. 1º contributing bank: licensed bank in accordance with laws governing banks in Rwanda; 2º contributing microfinance institution:
licensed microfinance institution in accordance with laws governing microfinance institutions in Rwanda; 3º key repo rate: the National Bank policy rate which serves as reference on money market for lending to the Fund.
CHAPTER II: MANAGEMENT OF THE
FUND
Article 3: Management
The Fund shall be managed by the National Bank of Rwanda.
Article 4: Advisory Committee
An Advisory Committee of the Fund is hereby established to advise the National Bank of Rwanda regarding the management of the Fund. An Order of the Minister in charge of finance shall appoint members of the Advisory Committee of the Fund and determine their responsibilities and term of office. 1º banque contribuant au Fonds : banque agréée conformément aux lois régissant les banques au Rwanda ; 2º institution de microfinance contribuant au Fonds: institution de microfinance agréée conformément aux lois régissant les institutions de microfinance au Rwanda ; 3º taux directeur: taux de référence sur le marché monétaire, publié par la Banque Nationale, pour le prêt au Fonds. CHAPITRE II: GESTION DU FONDS
Article 3: Gestion
Le Fonds est géré par la Banque Nationale du Rwanda.
Article 4: Comité Consultatif
Il est créé un Comité Consultatif du Fonds chargé de conseiller la Banque Nationale du Rwanda en matière de gestion du Fonds. Un arrêté du Ministre ayant les finances dans ses attributions nomme les membres du Comité Consultatif du Fonds et détermine leurs attributions et leur mandat.

1º imisanzu itangwa n’amabanki n’ibigo by’imari iciriritse bikorana n’Ikigega; 2º inyungu ku mafaranga y’ikigega yashowe mu buryo bwemewe na Banki Nkuru y’u Rwanda; 3º inyungu z’ubukererwe zikomoka ku musanzu wishyurwa na banki n’ibigo by’imari iciriritse bikorana n’Ikigega; 4º inkunga n’impano byemewe na Banki Nkuru y’u Rwanda; 5º amafaranga y’ubukererwe yo kudatangira igihe amakuru yishyurwa na banki n’ibigo by’imari iciriritse bikorana n’Ikigega. The Advisory Committee of the Fund shall establish the rules governing its functioning.
CHAPTER III: PROPERTY OF THE FUND
Article 5: Source of property of the Fund
The property of the Fund shall come from the following sources:
1º premiums paid to the Fund by contributing banks and microfinance institutions; 2º income of the Fund’s money invested in accordance with the standards of the National Bank of Rwanda; 3º default interest on payment of premiums from contributing banks and microfinance institutions; 4º grants and donations approved by the National Bank of Rwanda; 5º late payment charges for failure to provide information in time paid by contributing banks and microfinance institutions. Article 5: Source du patrimoine du Fonds
Le patrimoine du Fonds provient des sources suivantes:
1º primes versées au Fonds par les banques et institutions de microfinance contribuant au Fonds ; 2º revenu de l’argent du Fonds investi conformément aux normes reconnues par la Banque Nationale du Rwanda ; 3º intérêts de retard de paiement des primes des banques et institutions de microfinance contribuant au Fonds ; 4º subventions et dons approuvés par la Banque Nationale du Rwanda ; 5º frais de retard pour défaut de fournir les informations à temps imposés aux banques et aux institutions de microfinance contribuant au Fonds.

Official Gazette nᵒ 35 of 31/08/2015 Ingingo ya 6: Umusanzu utangwa mu Kigega Banki Nkuru y’u Rwanda ikoresheje amabwiriza, ishyiraho uburyo banki n’ibigo by’imari iciriritse bikorana n’Ikigega bitangamo umusanzu. Ayo mabwiriza agomba kugaragaza ibintu bikurikira:
1º igipimo cy’umusanzu utangwa ku mwaka; 2º uburyo umusanzu ubarwa; 3º uburyo bwo kwishyura umusanzu. Ingingo ya 7: Kumenyesha ingano y’umusanzu Banki Nkuru y’u Rwanda imenyesha buri banki na buri kigo cy’imari iciriritse bikorana n’Ikigega ingano y’umusanzu n’igihe ugomba gutangirwa mu Kigega. Mu gihe Banki cyangwa Ikigo cy’imari iciriritse bikorana n’Ikigega bitatanze umusanzu kandi byaramenyeshejwe ingano yawo n'igihe cyo kuwutanga, byishyura inyungu z’ubukererwe zingana na zeru n’ibice bitanu ku ijana (0.5%) z’amafaranga atishyuwe kuri buri munsi urenze ku gihe cyatangajwe.
Article 6: Premiums paid to the Fund
The National Bank of Rwanda shall, by regulation, determine procedures for premiums payment to the Fund by contributing banks and microfinance institutions. The regulation shall specify in particular the following:
1º rate of annual premiums; 2º calculation of premiums; 3º premiums payment mode.
Article 7: Notification of the premium amount
The National Bank of Rwanda shall notify each contributing bank and each contributing microfinance institution of the premium and the period within which it shall be paid into the Fund. Where a bank or a contributing microfinance institution fails to pay any premium due according to the notice specifying the amount and the period of payment, it shall pay the penalty interest rate of zero point five per cent (0.5%) of the unpaid amount for every day beyond the notice period on which the amount remains unpaid.
Article 6: Primes payées au Fonds
La Banque Nationale du Rwanda détermine par voie de règlement, les procédures de paiement de primes au Fonds par les banques et les institutions de microfinance contribuant au Fonds. En particulier, le règlement doit préciser ce qui suit:
1º le taux des primes annuelles ; 2º le calcul des primes; 3º le mode de paiement de primes.
Article 7: Notification du montant de prime
La Banque Nationale du Rwanda notifie à chaque banque et à chaque institution de microfinance contribuant au Fonds la prime due et la période pendant laquelle la prime doit être versée au Fonds. Lorsqu’une banque ou une institution de microfinance contribuant au Fonds ne paie pas la prime due conformément à la notification précisant le montant et la période de paiement, elle paie un intérêt de retard équivalant à zéro virgule cinq pour cent (0,5%) du montant des primes impayées pour chaque jour de retard au￾delà de la période de paiement notifiée.

Icyakora, Ikigega nticyishingira amafaranga abikijwe:
1º n’amabanki n’ibigo by’imari iciriritse; 2º n’ibigo by’ubwishingizi, iby’ubwiteganyirize bwa pansiyo n’ay’ibigega by’ishoramari by’abishyizehamwe; 3º na Leta cyangwa Ikigo cya Leta; 4º n’abantu bafite imigabane ihwanye no hejuru ya gatanu ku ijana (5%) by’amajwi
Article 8: Investment
The assets of the Fund shall be invested in Government bonds or in any other safe investments determined by the National Bank of Rwanda.
CHAPTER IV: INSURED DEPOSIT AND
MODE OF PAYMENT
Article 9: Amount of deposit covered by the
Fund
The National Bank of Rwanda shall determine the maximum insured amount of a depositor at a contributing bank or microfinance institution. However, the Fund shall not cover the deposits of:
1º banks and microfinance institutions; 2º insurance companies, pension funds, and collective investment schemes; 3º Government or public agency; 4º persons holding shares of more than five percent (5%) of voting rights in a

La Banque Nationale du Rwanda détermine le montant maximum assuré d'un déposant dans une banque ou dans une institution de microfinance contribuant au Fonds. Toutefois, le Fonds ne couvre pas les dépôts:
1º des banques et des institutions de microfinance; 2º des sociétés d'assurance, des fonds de pension et des fonds d'investissement collectif ; 3º de l’Etat ou de l’établissement public; 4º des personnes détenant les actions représentant plus de cinq pour cent (5%) des

Article 10: Emergency funding
Where the amount of the Fund prove to be insufficient for paying out the insured depositors, the National Bank of Rwanda shall provide the Fund with the emergency funding equivalent to the difference between the total amount to be paid and amount available in the Fund. The emergency funding made available to the Fund shall be paid back to the National Bank of Rwanda with an interest calculated at the key repo rate.
Article 11: Compensation of deposits
Any declaration of liquidation of a contributing bank or microfinance institution by the National Bank of Rwanda shall cause the compensation of the insured deposits within sixty (60) working days from the declaration date. The amount due to each insured depositor shall be transferred to another contributing bank or microfinance institution or through any other payment method that the National Bank of Rwanda may determine. droits de vote dans une banque ou une institution de microfinance contribuant au Fonds.
Article 10: Financement d’urgence
Lorsque l’argent du Fonds se révèle insuffisant pour payer les déposants assurés, la Banque Nationale du Rwanda fournit au Fonds les fonds d’urgence équivalant à la différence entre le montant total à payer et les sommes disponibles dans le Fonds. Le financement d’urgence fourni au Fonds est remboursé à la Banque Nationale du Rwanda avec un intérêt calculé au taux directeur.
Article 11: Indemnisation des dépôts
Toute déclaration de liquidation d'une banque ou d’une institution de microfinance contribuant au Fonds par la Banque Nationale du Rwanda déclenche l’indemnisation des dépôts assurés dans un délai ne dépassant pas soixante (60) jours ouvrables à compter de la date de la déclaration. Le paiement du montant dû à chaque déposant est effectué par transfert dans une autre banque ou dans une autre institution de microfinance contribuant au Fonds ou par toute autre forme de paiement que la Banque Nationale du Rwanda peut déterminer.

The National Bank of Rwanda shall specify compensation procedures through regulation. However, the Fund shall not compensate the following persons:
1º members of the management of the contributing bank or microfinance institution under liquidation; 2º any other person responsible for the insolvency of the contributing bank or microfinance institution.
CHAPTER V: SHARING INFORMATION,
AUDITING AND REPORTING
Article 12: Raising awareness about the
organisation and functioning of the Fund The National Bank of Rwanda shall raise awareness amongst clients of banks and microfinance institutions about the organisation and functioning of the Fund in general, and the insured and uninsured deposits in particular, as provided for by this Law.
Article 13: Information provided to the
National Bank of Rwanda
Any contributing bank or microfinance institution shall submit any information required in writing by the National Bank of Rwanda. La Banque Nationale du Rwanda spécifie par règlement les procédures d’indemnisation. Toutefois, le Fonds n’indemnise pas les personnes suivantes :
1º les membres de la direction de la banque ou de l’institution de microfinance contribuant au Fonds en liquidation; 2º toute autre personne responsable de la faillite de la banque ou de l’institution de microfinance contribuant au Fonds. CHAPITRE V: ECHANGE D’INFORMATIONS, AUDIT ET TRANSMISSION DE RAPPORT
Article 12: Sensibilisation sur l’organisation et
le fonctionnement du Fonds La Banque Nationale du Rwanda sensibilise les clients des banques et des institutions de microfinance sur l’organisation et le fonctionnement du Fonds en général, en particulier de dépôts assurés et non assurés tel que prévu par la présente loi.
Article 13: Informations à transmettre à la
Banque Nationale du Rwanda Une banque ou une institution de microfinance contribuant au Fonds fournit toute information demandée par écrit par la Banque Nationale du Rwanda.

A contributing bank or microfinance institution which fails to provide information within the period specified by the National Bank of Rwanda shall pay late payment charges to the Fund in accordance with the regulation of the National Bank of Rwanda.
Article 14: Audit
The Fund shall be audited every year by an external auditor. The audit may also be carried out whenever necessary upon request by the Advisory Committee.
Article 15: Publication of the Fund’s annual
report
The National Bank of Rwanda shall publish a report on the activities of the Fund in the first quarter of the following year.
CHAPTER VI: FINAL PROVISIONS
Article 16: Drafting, consideration and
adoption of this Law
This Law was drafted in English, considered and adopted in Kinyarwanda. Une banque ou une institution de microfinance contribuant au Fonds qui omet de fournir une information dans les délais déterminés par la Banque Nationale du Rwanda paye les frais de retard au Fonds conformément au règlement de la Banque Nationale du Rwanda.
Article 14: Audit
Le Fonds fait annuellement l’objet de l’audit par un auditeur externe. L’audit peut également s’effectuer chaque fois que de besoin à la demande du Comité Consultatif.
Article 15: Publication du rapport annuel du
Fonds
La Banque Nationale du Rwanda publie un rapport sur les activités du Fonds au cours du premier trimestre de l’année suivante. CHAPITRE VI: DISPOSITIONS FINALES
Article 16: Initiation, examen et adoption de la
présente loi
La présente loi a été initiée en Anglais, examinée et adoptée en Kinyarwanda.

Article 17: Repealing provision
All prior legal provisions contrary to this Law are hereby repealed.
Article 18: Commencement
This Law shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
Article 17: Disposition abrogatoire
Toutes les dispositions légales antérieures contraires à la présente loi sont abrogées.
Article 18 : Entrée en vigueur
