_________________________________________________________________________________________ 3/2026 MEASURE of the National Bank of Slovakia of 28 September 2026, amending and supplementing the Measure of the National Bank of Slovakia of 13 December 2016 No. 10/2016, laying down details on the assessment of a consumer's ability to repay a housing loan as amended by later regulations The National Bank of Slovakia, after discussion with the Ministry of Finance of the Slovak Republic, pursuant to Section 8(16)(f) and (g) of Act No. 90/2016 Coll. on housing loans and on amendment and supplementation of certain acts as amended by later regulations, lays down:
Art. I
The Measure of the National Bank of Slovakia of 13 December 2016 No. 10/2016, laying down details on the assessment of a consumer's ability to repay a housing loan (Notice No. 373/2016 Coll.) as amended by the Measure of 29 May 2018 No. 7/2018 (Notice No. 169/2018 Coll.), the Measure of 17 December 2019 No. 10/2019 (Notice No. 503/2019 Coll.) and the Measure of 23 August 2022 No. 5/2022 (Notice No. 309/2022 Coll.) is amended and supplemented as follows:

_________________________________________________________________________________________ the remaining amounts of the refinanced housing loans or increased housing loans by the lower of the values a) 2,000 euros, b) 5% of the sum of the remaining amounts of the refinanced housing loans or increased housing loans.".
2. In Section 7, new paragraphs 4 to 8 are inserted after paragraph 3, which read:
"(4) For the purposes of this Measure, a housing loan for the acquisition of a first home means a housing loan secured by real estate pursuant to Section 6(2) and (3) provided to a consumer who, as of the date of application for the housing loan, is no older than 35 years and does not own a residential property, provided that at least one of the purposes of this housing loan is the acquisition of ownership rights to real estate pursuant to Section 6(2)(a) points 1 and 2 or the construction of real estate pursuant to Section 6(2)(a) points 1 and 2. The conditions pursuant to the first sentence are considered fulfilled if each co-debtor meets them. (5) For the purposes of this Measure, a residential property means a) a building with building type code 9, 10, 13, 21 and 22 pursuant to a special regulation, 15a) b) a space in a building with building type code 9, 10, 13, 20 to 22 pursuant to a special regulation 15a) with space type code 1 and 3 pursuant to a special regulation 15b) or c) a space in a building with building type code 9, 10, 13, 20 to 22 pursuant to a special regulation 15a) with space type code 2 and 4 pursuant to a special regulation 15b) and at the same time with non-residential space type code 11 and 12 pursuant to a special regulation. 15c) (6) For the purposes of this Measure, ownership of one residential property means ownership of a residential property in the territory of the Slovak Republic with a share of at least 1/2 according to the status recorded in the real estate cadastre; 9) ownership of one residential property is also considered when co-debtors own co-ownership shares in the same residential property, the sum of which reaches at least 1/2. Ownership of a residential property does not include ownership of a building with building type code 21 pursuant to a special regulation, 15a) if the purpose of providing the housing loan is the completion of this building. If verification of ownership of a residential property pursuant to the first and second sentences is not possible due to reasons on the part of the real estate cadastre information system, ownership of a residential property shall be proven by submitting a sworn statement from the debtor and co-debtors. (7) For the purposes of this Measure, a housing loan for the acquisition of a third and subsequent real estate means a housing loan secured by real estate pursuant to Section 6(2) and (3) provided to a consumer who owns at least two residential properties or to co-debtors who collectively own at least two residential properties. (8) Information necessary to verify the facts pursuant to paragraphs 1, 4 to 7 may not be older than 30 days from the date of application for the housing loan.".
