Modifying Circular 3/26 of the Single Insurance and Surety Circular

MODIFYING CIRCULAR 3/26 OF THE SINGLE INSURANCE AND SURETY CIRCULAR

(DISPOSITION 39.6.2.)

The National Commission of Insurance and Sureties, based on the provisions of articles 366, fraction II, 367, fraction II, 372, fractions VI and XLII, 373 and 381 of the Insurance and Surety Institutions Law, and:

CONSIDERING

That the Insurance and Surety Institutions Law (LISF), in its article 389, provides that Institutions and Mutual Societies, as well as other persons and entities subject to the inspection and supervision of the National Commission of Insurance and Sureties, must submit to it, in the form and terms established for that purpose through general provisions, the information and documentation required for regulation, supervision, control, inspection, surveillance, statistics, and other functions assigned to it.

Likewise, article 367 of the LISF provides that the Commission, for the exercise of its powers, will have Regional Delegations which may perform, within their geographical jurisdiction, the functions determined in their Internal Regulations.

In this sense, Disposition 39.6.2. establishes the hours, days of service, and location of the official records office of this Commission, as well as those of its Regional Delegations, so that Institutions, Mutual Societies, and other supervised persons may deliver the information required of them or so that public user attention may be provided.

Considering that Disposition 39.6.2., fraction III, subsection e), establishes the address of the Nuevo León Regional Delegation, which has been relocated in accordance with the principles of efficiency, effectiveness, transparency, and economy, in order to maintain the quality of attention to public users.

In view of the foregoing, the National Commission of Insurance and Sureties has resolved to issue the following modification to the Single Insurance and Surety Circular, in the terms specified below:

(Deposition 39.6.2.)

SINGLE. Disposition 39.6.2., fraction III, subsection e), of the Single Insurance and Surety Circular is modified, to read as follows:

III. Regarding the information referred to in article 389 of the LISF, other legal, regulatory, and administrative provisions, as well as Titles 32, 33, and 36 of these Provisions, which require physical delivery at the Commission's facilities, submission must be made at any of the following offices of the Commission:

a d) ...

Nuevo León Regional Delegation, located at Centro Cuauhtémoc, Av. Miguel Hidalgo No. 330, Floor 3, Local 308, Colonia Centro, C.P. 64000, Monterrey, Nuevo León; during hours of 9:00 to 13:00, on business days; and

... " .

TRANSITORY PROVISIONS

FIRST.- Publish in the Official Gazette of the Federation.

SECOND.- This Modifying Circular shall enter into force the day after its publication in the Official Gazette of the Federation.
