NOTE
Decree No. 10,139, of November 28, 2019, establishes the obligation for federal direct, autarchic, and foundational administrative agencies to review and consolidate regulatory acts issued within the scope of their respective competencies. This measure aims to review, update, simplify, and consolidate regulatory acts, in order to rationalize the regulatory stock. Based on Arts. 7, item I, and 8 of the Decree, this Normative Instruction intends to revoke Circular Letters No. 3,045, of October 10, 2002, 3,051, of October 25, 2002, 3,104, of November 4, 2003, and 3,198, of July 22, 2005, which no longer produce effects currently.
Decree No. 10,411, of June 30, 2020, determines, in its Art. 3, that the issuance, alteration, or revocation of regulatory acts of general interest to economic agents or users of services provided by federal direct, autarchic, and foundational administrative agencies must be preceded by a regulatory impact analysis (RIA).
However, this same Decree lists, in the items of the caput of its Art. 4, regulatory acts exempt from the aforementioned obligation, among which we highlight "regulatory act that aims to update or revoke norms considered obsolete, without alteration of merit" (item IV of said article).
Therefore, having in view to strictly dispose on the revocation of norms considered obsolete, the exemption from RIA applies to the normative instruction now proposed.
