NORMATIVE INSTRUCTION BCB NO. 465, OF APRIL 15, 2024

Updates MCR Document 1 (Requirements and Filling Instructions for the Rural Credit and Proagro Operations System - Sicor) of the Rural Credit Manual.

The Head of the Department of Regulation, Supervision and Control of Rural Credit and Proagro Operations (Derop), using the powers conferred upon him by art. 23, item I, letter “a”, of the Internal Regulations of the Central Bank of Brazil, annexed to Resolution BCB No. 340, of September 21, 2023, and considering the provisions of letter “b” of item 3 of Section 6 (Accounting and Control) of Chapter 3 (Operations) and item 11 of Section 9 (Social, Environmental and Climatic Impediments) of Chapter 2 (Basic Conditions) of the Rural Credit Manual (MCR),

RESOLVES:

Art. 1º The Specific Conditions Section - Document 1 (Requirements and Filling Instructions for the Rural Credit and Proagro Operations System - Sicor) of the Rural Credit Manual (MCR) shall enter into force with the following alteration:

d) Sicor performs area overlap critiques to avoid non-compliance with current legal and infra-legal norms, including:

I - of the area of the polygons informed in the contract, with the purpose of avoiding credit duplication, as provided in MCR 3-6-3-“b”;

II - of the polygons informed in the contract and of the polygon informed in the Rural Environmental Registry, with the purpose of avoiding non-compliance with the requirements regarding social, environmental and climatic impediments referred to in MCR 2-9.

e) in the area overlap critiques referred to in note “d”, tolerance margins for area overlap of polygons are applied, which may vary according to the size, nature or specificity of the overlapping areas.” (NR)

Art. 2º MCR - Document 1 of the MCR is located on the website of the Central Bank of Brazil, on the MCR consultation page, available at the electronic address www3.bcb.gov.br/mcr.

Art. 3º This Normative Instruction BCB enters into force on May 2, 2024.

NOTE

As a result of technological issues, imprecisions may occur in the area overlap checks performed by the Rural Credit and Proagro Operations System (Sicor) based on the polygons informed in the financing contracts. Thus, Sicor applies tolerance margins for area non-coincidence, which may vary according to the size, nature or specificity of the overlapping areas. The objective of this Normative Instruction is to give publicity, by reference in MCR Document 1 (Sicor Filling Requirements and Instructions), to the existence of these tolerance margins in the critiques performed by Sicor.

2. It should be highlighted that, by virtue of art. 24 of Decree No. 10.411, of June 30, 2020, the issuance of normative acts by bodies and entities of the direct federal administration, autarchic and foundation, from October 14, 2021, must be preceded by a Regulatory Impact Analysis (AIR). However, in its article 4º, the aforementioned decree establishes the hypotheses for exemption from carrying out an AIR. This IN BCB falls under the hypothesis provided for in item III, a normative act considered to have low impact, since it does not cause an increase in cost for the economic agents involved. Thus, based on item III of art. 4º of Decree No. 10.411, of 2020, it is understood that the issuance of the present IN BCB is exempt from carrying out an AIR.
