OFFICE LETTER through which the Ministry of Finance and Public Credit, through the Banking, Securities and Savings Unit, makes known the Payment Procedure for Savers of the Free and Sovereign State of Oaxaca

PRESENT

The Secretary of Finance and Public Credit through the Banking, Securities and Savings Unit (UBVA), based on what is established in Article 4, section B, fraction IV and Article 8, fractions III, VIII and XV and Article 15, fractions I, XXXVI and XXXIX of the Internal Regulations of the Ministry of Finance and Public Credit, as well as on what is established in the Transitional Articles Third, Fifth second paragraph, Sixth and Twentieth of the Decree of Extinction, published on November 6, 2020 in the Official Gazette of the Federation (DOF), by which "Reforms and repeal various provisions of the Law for the Protection of Human Rights Defenders and Journalists; of the Law of International Cooperation for Development; of the Hydrocarbons Law; of the Electric Industry Law; of the Federal Budget and Fiscal Responsibility Law; of the General Law of Civil Protection; of the Organic Law of the National Financial Institution for Agricultural, Rural, Forestry and Fisheries Development; of the Law of Science and Technology; of the Customs Law; of the Regulatory Law of the Railway Service; of the General Law of Physical Culture and Sport; of the Federal Cinematography Law; of the Federal Rights Law; of the Mexican Oil Fund for Stabilization and Development Law; of the Biosafety Law of Genetically Modified Organisms; of the General Law of Climate Change; of the General Law of Victims and the Law creating the Trust that will administer the Social Support Fund for Mexican Migrant Workers is repealed" (Decree) and in which, among others, it repeals the Law of the Trust that will Administer the Fund for the Strengthening of Savings and Loan Societies and Cooperatives and Support for their Savers (FIPAGO Law); in Clause Third of the Agreement for the Extinction of the Trust that will Administer the Fund for the Strengthening of Savings and Loan Societies and Cooperatives and Support for their Savers (FIPAGO) and its Annex 5, item 3, subsection b); and in Clauses First and Third of the Mandate Contract called "PAGO Mandate", instrument in which the Banking, Securities and Savings Unit acts as Mandator.

Regarding this, the PAYMENT PROCEDURE FOR SAVERS OF THE FREE AND SOVEREIGN STATE OF OAXACA is made known, with the objective of supporting the savers of the societies named:

PAYMENT PROCEDURE FOR SAVERS OF THE FREE AND SOVEREIGN STATE OF OAXACA

OBJECTIVE:

Within the framework of administrative simplification and transparency of public management, it has been considered that the Payment Procedure for Savers be simple, and that, especially, its content meets the objectives of truthfulness and timeliness regarding the procedures to be carried out by the Savers.

In that context, in compliance with what is established in Clause Eighth of the Coordination Agreement signed between the Government of the Free and Sovereign State of Oaxaca and the Ministry of Finance and Public Credit, through the Banking, Securities and Savings Unit (Coordination Agreement), on July 10, 2024, the present mechanisms for coordination of actions are agreed upon between the Government of the Free and Sovereign State of Oaxaca and the Ministry of Finance and Public Credit, through the Banking, Securities and Savings Unit, in its capacity as "Mandator of the PAGO Mandate", with the purpose of providing a professional service to the Savers of the societies named: Bampeco Savings and Services Box, S.C. de A.P. de R.L. de C.V., Southeast Popular Box, S.C. de R.L. de C.V., South Box, S.C. de R.L., Solidarity Box of the Traditional Artisans of the Valleys of Oaxaca, S.C., Southeast Cooperative, S.C. de R.L., Kaxa Taon, S.C. de A.P. de R.L. de C.V., Fincapo, S.C. de R.L., Atlantic of the Southeast, S.C. de R.L., Corporativo 3 Mixtecas, S.C. de R.L. de C.V., Azteca Corporativo of Huajuapan, S.C. de R.L., Universal Peseta, S.C. de R.L. de C.V., Oaxacan Investors, S.C. of R.L., Business and Family Development without Limits, S.C. de A.P. de R.L. de C.V., Popular Link Cooperative, S.C. de A.P. de R.L. de C.V., Jalapa Support of the Isthmus, S.C. of R.L., Economic Coalition, S.C. of R.L. de C.V., Huaxyacac Union Cooperative, S.C. of R.L. and Progress of the Isthmus, S.C. of R.L.; guaranteeing efficient state coverage through the establishment and operation of Saver Attention Centers (CEATS) in the State of Oaxaca.

PAYMENT MECHANICS:

FIRST. - The registration period that is part of this Payment Procedure will apply for 60 (sixty) calendar days from the date of opening of the Centers, which will open according to the calendar presented in Clause Sixth of this Procedure.

SECOND. - Payment will only be made to those Savers who are identified and recognized within the Databases obtained from accounting audit work, audited and certified by the Federal Entity, whose Net Savings Balance is greater than $40,000.00 (Forty thousand pesos 00/100 M.N.) and equal to or less than $62,751.00 (Sixty-two thousand seven hundred fifty-one pesos 00/100 M.N.).

THIRD. - Net Savings Balance for payment is considered the amount resulting from the amount stated in the Credit Titles or supporting documents of the deposits made by the Saver, minus the credits granted to them that have not been covered. To determine this balance, interest will not be counted either in favor or against.

FOURTH. - Only 70% of the Net Savings Balance will be paid.

FIFTH. - In the event that the Saver has granted guarantees to the aforementioned societies, they must go before the person responsible for dissolution or liquidation, as applicable, to make payment of their debt, obtain the release of their guarantee(s) and the Certificate of No Debt. This Certificate will be recognized by the Mandator to reduce the loan balance owed, in the same proportion as the payment made that supports the Certificate.

SIXTH. - Within the 60 (sixty) calendar days from the date of opening of the Attention Centers, Savers who are identified and recognized within the Databases referred to in the SECOND item of this payment procedure and who have the Credit Titles or supporting documents of the deposits made, must go to the Attention Center assigned to them, within the schedule indicated below and initiate the payment procedure.

The service hours at the Saver Attention Centers for document reception and guidance for Savers are from 09:00 to 15:00 hours from Monday to Friday, on business days, at the following addresses:

With the aim of avoiding overcrowding and being in conditions to provide a quality service to Savers, the first days of operation of the Saver Attention Centers will be for the reception of documents for the payment procedure, which will be carried out according to the following schedule, depending on the initial letter of the first surname of each Saver. Once the dates indicated in said schedule are exhausted, attention will be given without any distinction, without exceeding the established term of 60 (sixty) calendar days.

Saver reception will be carried out at the Attention Centers, only within the 60 (sixty) calendar days from their opening date.

On October 31, 2024, at 15:00 hours, the non-extendable period ends to register and receive documentation from Savers who go to process the payment of the percentage indicated in the FOURTH item of this procedure of their Net Savings Balance.

SEVENTH. - To be identified as a Saver of the aforementioned societies, interested parties must accompany their payment request with the following general requirements, delivering two photocopies and presenting the original for verification of one of the following documents:

FOR IDENTIFICATION:

Valid official identification with photograph and signature of the Saver. Passport, Credential of the National Electoral Institute (formerly IFE), Credential of the National Institute for Older Adults INAPAM (formerly INSEN), Professional ID, Driver's License or Municipal Identity Certificate.

FOR AGE VERIFICATION:

Certified copy of Birth Certificate, Passport, Credential of the National Electoral Institute (formerly IFE), Credential of the National Institute for Older Adults INAPAM (formerly INSEN), Unique Population Registration Key (CURP), Professional ID, Driver's License or National Military Service Identity Card.

FOR ADDRESS VERIFICATION:

Proof of address with an age of less than 3 (three) months, which may be water bill, electricity bill, property tax receipt, phone bill, bank statement, cable television service receipt or residence letter issued by the municipality.
In the event that the Saver is of foreign origin and does not have official documentation issued by national authorities, they must present for identification purposes the following:

Valid passport and migratory documentation that accredits their legal stay in national territory, such as the Digital Multiple Migratory Form FMMD for tourists, the books called FM or letter of naturalization, documents that must be valid at the time of presentation.

TO ACCREDIT MEMBERSHIP IN THE SOCIETY:

Document or credential that accredits them as a member of the cooperative societies indicated in the Objective of this procedure.

FOR VERIFICATION OF CREDIT TITLES AND DEPOSITS MADE:

Original Credit Title(s) and/or supporting documents that accredit the amount saved and/or invested and, if applicable, Certificate of No Debt issued by the person responsible for the dissolution or liquidation of the Society.
If the Saver is a taxpayer of the Income Tax (ISR), they must present their annual declaration corresponding to each of the years in which they were a Saver of the Society for the last five (5) years.
If not a taxpayer of the ISR or not obliged to present a declaration, they must state this in writing on the form provided at the Attention Center and under oath, with the warning of the penalties incurred by those who declare falsely before an authority other than judicial.

FOR THE CASE OF LEGAL ENTITIES:

In the case of legal entities, a certified copy of the Constitutive Act of the Society, its statutes with their latest modifications, Power of Attorney for Acts of Ownership of the Legal Representative certified before a Notary Public in which they are authorized and valid official identification with photograph and signature must be exhibited.

EIGHTH. - The Saver must carry out their procedures personally; however, if necessary, they may do so through a Legal Representative, only for a serious and justified cause that is accredited or in the case of a Saver with some disability.

For this effect, in addition to what is stated in the Seventh item, it will be sufficient for their Legal Representative to present:

Valid official identification with photograph and signature.
Certified copy of the Birth Certificate of their represented person, if a minor and/or the judicial document that accredits the state of interdiction and guardianship.
Power of Attorney issued by a public notary for acts of ownership of the Legal Representative to whom they are authorized.

The original power of attorney will be delivered by the Saver or authorized person at the time of payment.

In no case can a Legal Representative represent more than three Savers at once.

NINTH. - In the event that the Saver has passed away and the procedure is carried out by the Executor of the succession recognized by judicial sentence, in addition to the requirements indicated in the Seventh item, the following documentation must be presented:

Certified copy of the Saver's Death Certificate.
Certified copy of the judicial document that accredits their position as Executor.
Certified copy of the Executor's Birth Certificate.
Valid official identification with photograph and signature of the Executor.

TENTH. - In the event that the Saver has passed away and the procedure is carried out by the Heir(s) recognized by judicial sentence, in addition to the requirements indicated in the Seventh item, the following documentation must be presented:

Certified copy of the Saver's Death Certificate.
Certified copy of the Birth Certificate of their represented person if a minor or the judicial document that accredits the state of interdiction and guardianship.
Valid official identification with photograph and signature of the Heir(s).
Certified copy of the will deed or, in case of judicial resolution or testamentary succession before a Notary Public, certified copy of the sentence in which its protocolization, partition and adjudication of inherited goods is stated.

ELEVENTH. - When the Saver has passed away and upon making their deposit in any of the aforementioned Societies, they had designated Beneficiary(ies), this/these can go to request payment, attaching to the request two photocopies and presenting the original for verification of one of the following documents, in addition to the requirements indicated in the Seventh item:

Certified copy of the Saver's Death Certificate.
Certified copy of the Birth Certificate of the beneficiary(ies),
To identify the beneficiary(ies) any of the following documents: Passport, Credential of the National Electoral Institute (formerly IFE), Credential of the National Institute for Older Adults INAPAM (formerly INSEN), Unique Population Registration Key (CURP) or Professional ID or Municipal Identity Certificate.
Valid official identification with photograph and signature of the Beneficiary(ies).
Original contract celebrated with the Society in question, in which the Beneficiary(ies) are designated.

TWELFTH. - Once the Saver, Authorized Person or their Legal Representative presents themselves at the Saver Attention Center with their corresponding documentation, the person in charge of the same will verify that they are in the audited, audited and certified Databases by the Federal Entity, the documents will be reviewed and if there are no inconveniences, the Saver or the Authorized Person or their Legal Representative will be delivered the request format to be requisitioned.

THIRTEENTH. - The Saver, Authorized Person or their Legal Representative will deliver the requisitioned request at the Saver Attention Center, attaching the documentation in original and two photocopies for verification.

FOURTEENTH. - The person in charge of the Saver Attention Center upon receiving the request and documentation in original and two copies, will verify that the Saver appears registered in the audited, audited and certified Databases by the Federal Entity and will verify that the Net Savings Balance is greater than $40,000.00 (Forty thousand pesos 00/100 M.N.) and equal to or less than $62,751.00 (Sixty-two thousand seven hundred fifty-one pesos 00/100 M.N.), as stipulated in the Second and Third items of this procedure.

FIFTEENTH. - The Saver must state in writing:

That they cede their credit rights.
That they waive the payment of interest in their favor.
That they do not reserve action or rights of any kind against any of the Societies of which they are a creditor as applicable, the National Bank of the Army Air Force and Navy, S.N.C., in its capacity as Mandatary, the Ministry of Finance and Public Credit, the Banking, Securities and Savings Unit in its capacity as Mandator and the Government of the Federal Entity.

SIXTEENTH. - Once the requirements are met, the Saver, Authorized Person or their Legal Representative, will receive the "Saver's Request" consigning the total sum of the amounts of the credit titles or deposit supporting documents exhibited by the Saver, Authorized Person or their Legal Representative, in original, so that they can subsequently go on the date indicated to exchange it for their payment order or non-negotiable named check.

The Saver's "Payment Request" will have a validity to exercise collection rights of up to 30 calendar days prior to the expiration of the Coordination Agreement signed with the Federal Entity.

The payment order or non-negotiable named check will only be provided against delivery of:

Payment settlement prepared for this purpose, for signature of conformity and which contains the Cession of Rights and the waiver of procedural actions.

Endorsement of the Credit Titles or Cessions of the deposit supporting documents in favor of the Ministry of Finance and Public Credit.

Subscription of the Contract of Cession of Rights in the Society(ies) that corresponds.

SEVENTEENTH. - No payment will be made:

If the Saver is not recognized in the Databases audited, audited by the External Auditor and certified by the Federal Entity, except for the cases referred to in the General Criteria for the Solution of Special Cases contained as Annex 4 of the Coordination Agreement signed with the Federal Entity.
If the Saver, Authorized Person or their Legal Representative, does not grant the waivers, endorsements, Cessions of Credit Rights in favor of the Ministry of Finance and Public Credit and, if applicable, deposit supporting document certified by the External Auditor.
If the Saver, Authorized Person or their Legal Representative, does not present the payment settlement duly signed in (3) three original copies.
If the Saver, Authorized Person or their Legal Representative, does not deliver the Contract of Cession of Rights signed in (3) three original copies.
In general, no payment will be made if the Saver, Authorized Person or their Legal Representative, does not deliver the originals and copies of the documents requested for the delivery of their payment order or non-negotiable named check.

EIGHTEENTH. - The Saver Attention Centers established by the Federal Entity have the obligation to advise and guide Savers, Authorized Persons or their Legal Representatives at all times, with the aim of facilitating and guiding them in carrying out their procedures regarding this Payment Procedure. Likewise, there will be a Special Attention Center to handle Atypical Cases or cases of special complexity.

The procedures carried out by the Saver, Authorized Person or their Legal Representative, before the Saver Attention Centers established by the Federal Entity or the Mandator, are completely free. This public program of payment to Savers is constituted with Federal and State resources and is unrelated to any political party and its use for partisan or personal promotion purposes is prohibited.
