Operation of a Dutch pension scheme by a pension institution from another Member State: Budapest Protocol

This document provides a non-limitative overview of the Dutch social and labour law provisions and rules on information provision that continue to apply when a pension scheme of a Dutch employer is operated by a pension institution from another Member State. The operating pension institution must comply with these provisions, which are supervised by De Nederlandsche Bank N.V. and the Dutch Authority for the Financial Markets (AFM). The overview covers specific sections of the Pensions Act, the Decree Implementing the Pensions Act, and the Supervisory Regulation, addressing obligations related to pension agreements, administration, information provision, value transfers, and supervision.
