Order for the Disincorporation of 81 Federal Real Estate Properties from the Federal Public Domain for Contribution to the National Fund for Ejido Development Trust

The Order disincorporates 81 federal real estate properties from the federal public domain regime for contribution to the assets of the National Ejido Development Fund Trust. Dr. Pablo Israel Escalona Almeraya, President of the Institute for Administration and Appraisal of National Assets, a decentralized administrative body of the Ministry of Finance and Public Credit, based on the provisions of Articles 1, 2 fraction I, 17, 26 fraction VI, 31 fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 2 fractions II and IV, 28 fraction I, 29 fractions I, VI and XV, 84 fraction VI, 93 second paragraph, 95 and 101 fractions VI and X of the General Law of National Assets; 1, 4 section G, fraction V, 48 and 49 of the Internal Regulations of the Ministry of Finance and Public Credit; and 1, 3 fractions VIII and X, 4 fraction I, subsection a) and 6 fractions XXXVI and XLVII of the Internal Regulations of the Institute for Administration and Appraisal of National Assets; and

CONSIDERING

FIRST.- That among the assets subject to the federal public domain regime, there are 81 federal real estate properties, of which 3 are individually identified as: Parcel 1352 Z2 P1/2, Parcel 1370 Z1 P2/2 and Parcel 1380 Z1 P2/2, with Federal Real Estate Registry 15-15174-5, 15-15060-3 and 15-15177-2, respectively, as well as 78 additional properties grouped in the polygons named: Polygon 1 Stage 2, Polygon 5 Stage 2, Polygon 6 Stage 2, Polygon 7 Stage 2, Polygon 8 Stage 2, Polygon 9 Stage 2 and Polygon 10 Stage 2, with Federal Real Estate Registry 15-15175-4, 15-15053-2, 15-15323-0, 15-15470-0, 15-15500-0, 15-15160-0 and 15-15616-0, respectively, all located in the Municipality of Atenco, State of Mexico, with a total surface area of 545,366.16 square meters.

SECOND.- That the ownership of the real estate referred to in the previous Consideration is accredited through Public Deeds granted before the authority of Licentiate José Ortiz Girón, Public Notary Number 113 of the State of Mexico and of the Federal Real Estate Assets, in which the various sales contracts in favor of the Federal Government were recorded, regarding the 81 parcels, with the data described below:

FOURTH.- That by letter number 0242-C/0172, dated February 9, 2024, the Directorate of Architecture and Conservation of Immovable Artistic Heritage of the National Institute of Fine Arts and Literature informed regarding the properties subject to this Agreement, as follows: "... there is no construction that has a Declaration of Artistic Monument with publication through Decree in the Official Journal of the Federation and neither is any type of construction included in the List of Properties with Artistic Value ...".

FIFTH.- That by letter number 401.3S.17-2024/0192, dated February 12, 2024, the Directorate of Archaeological Salvage of the National Institute of Anthropology and History informed regarding the properties subject to this Agreement, as follows: "... the mentioned plots are outside what was the intervention polygon of what would be the New International Airport of Mexico City in Texcoco, where some archaeological remains were found, in the case of the plots in question, no existence of archaeological or historical monuments has been observed on the surface. However, they could appear under the current surface, as many of them were located at their time.

We suppose that, if such presence exists, it does not interfere with the objective proposed in your letter, although at the moment when any type of construction is carried out on each of the plots, it would be necessary to process the corresponding approvals before this Institution ...".

TENTH.- That by Opinion of November 26, 2025, the General Directorate of Federal Real Estate Patrimony Administration determined not to carry out the diffusion provided for in article 49 fraction II of the General Law of National Assets and in numeral 118 of the Agreement establishing the provisions in matter of Material Resources and General Services, published in the Official Journal of the Federation on July 16, 2010 and last reform published in the same dissemination organ on April 05, 2016, respectively, regarding the properties subject to this Agreement, in virtue of that, due to their characteristics, they are not suitable to be destined to the service of any other Dependency, Entity or Public Institution, different from the one that has been occupying them, since currently the Fideicomiso Fondo Nacional de Fomento Ejidal uses them to carry out necessary promotion actions to strengthen the community life of the inhabitants of the Municipality of Atenco, State of Mexico.

ELEVENTH.- That the Real Estate Utilization Committee of the Institute of Administration and Appraisal of National Assets, in its Fourth Ordinary Session, held on December 11, 2025, approved AGREEMENT 39/2025 CAI, through which it was determined the actions for the best use and utilization of the federal properties subject to this Agreement, for their disincorporation from the public domain regime of the Federation and contribution to the patrimony of the Fideicomiso Fondo Nacional de Fomento Ejidal, in terms of what is provided by article 84 fraction VI of the General Law of National Assets.

TWELFTH.- That by letter DGPGI/689/2025 dated December 19, 2025, the General Directorate of Policy and Real Estate Management issued Opinion number DAAD/2025/039, in which it determined that the properties object of this present are not cataloged as goods of common use, listed in article 7 of the General Law of National Assets, therefore, based on the request and justification raised by the Fideicomiso Fondo Nacional de Fomento Ejidal, to acquire the merits properties in order to incorporate them into a Sustainable Development Project, the determination adopted by the Real Estate Utilization Committee proved appropriate, considering that, in the concrete case, the normative hypothesis provided for in fraction VI of article 84 of the General Law of National Assets is updated.

THIRTEENTH.-

That the General Directorate of Federal Real Estate Patrimony Administration, in accordance with what is provided by article 10, fraction IV of the Internal Regulations of this Institute, authorized technically this operation. The administrative documentation of the properties, as well as of this Agreement, is in the processing file integrated by said General Directorate and was duly checked with that which is found in the Federal and Para-State Real Estate Information System.

Based on article 8 fraction XIV of the Internal Regulations of the Institute of Administration and Appraisal of National Assets, the Legal Unit issued an opinion proceeding regarding this present; therefore, based on the considerations referred to, I have deemed it appropriate to issue the following:

A G R E E M E N T

FIRST.- They are disincorporated from the public domain regime of the Federation for their contribution to the patrimony of the Fideicomiso Fondo Nacional de Fomento Ejidal, 81 federal real estate properties, of which, 3 are individually identified as: Parcel 1352 Z2 P1/2, Parcel 1370 Z1 P2/2 and Parcel 1380 Z1 P2/2, with Federal Real Estate Registry 15-15174-5, 15-15060-3 and 15-15177-2, respectively, as well as 78 additional properties grouped in the polygons named: Polygon 1 Stage 2, Polygon 5 Stage 2, Polygon 6 Stage 2, Polygon 7 Stage 2, Polygon 8 Stage 2, Polygon 9 Stage 2 and Polygon 10 Stage 2, with Federal Real Estate Registry 15-15175-4, 15- 15053-2, 15-15323-0, 15-15470-0, 15-15500-0, 15-15160-0 and 15-15616-0, respectively, all located in the Municipality of Atenco, State of Mexico and total surface of 545,366.16 square meters, to establish a project of socially just, economically viable and environmentally sustainable development, with the purpose of promoting the priority areas of development, strengthening the community life of the ejidos and carrying out the necessary promotion actions to raise their level of life and constitute themselves as lands of common use, being destined solely and exclusively for agrarian development projects.

SECOND.- The Institute of Administration and Appraisal of National Assets will exercise, on behalf and representation of the Federation, the corresponding acts to carry out the compliance of this Agreement in the terms presented.

THIRD.- The taxes, rights, fees and expenses that arise from the operation authorized, will be covered by the Fideicomiso Fondo Nacional de Fomento Ejidal.

FOURTH.- In case that construction works, reconstruction, modification, adaptation, conservation, maintenance, repair and demolition are projected in the properties whose contribution to the patrimony of the Fideicomiso Fondo Nacional de Fomento Ejidal is authorized, prior to their realization, said entity of the Para-State Public Administration must manage before local and federal authorities, the obtaining of licenses, permits, authorizations or any other similar that is required, specifically before the Directorate of Archaeological Salvage of the National Institute of Anthropology and History.

FIFTH.- Any act of administration or disposition, work or activity that the Fideicomiso Fondo Nacional de Fomento Ejidal intends to carry out regarding the properties object of this Agreement, must be subject to what is provided in the General Law of Ecological Equilibrium and Environmental Protection, as well as to the modalities and guidelines established in the "Decree by which a protected natural area with the character of Natural Resources Protection Area is declared, the area known as Lake of Texcoco, in the municipalities of Texcoco, Atenco, Chimalhuacán, Ecatepec de Morelos and Nezahualcóyotl in the State of Mexico" and in the other applicable legal provisions.

SIXTH.- If the Fideicomiso Fondo Nacional de Fomento Ejidal ceases to use the properties whose contribution to its patrimony is authorized, gives them a use different from that established in this Agreement, without the prior authorization of this Institute, or if it ceases to need them, said properties with all their improvements and accessions will revert to the patrimony of the Federation. This condition must be inserted in the corresponding contract that is issued for this effect.

SEVENTH.- If within the year following the entry into force of this Agreement, the corresponding formalization of the operation authorized has not been carried out, due to causes attributable to the Fideicomiso Fondo Nacional de Fomento Ejidal, determined by the Institute of Administration and Appraisal of National Assets, this Agreement will become void, and this Institute must publish in the Official Journal of the Federation a notice in which this circumstance is made known, as well as notify it to said entity of the Para-State Public Administration.

EIGHTH.- Publish this Agreement in the Official Journal of the Federation and register it in the Federal Property Public Registry.

This Agreement will enter into force the day after its publication in the Official Journal of the Federation.
