Order on Application for Directions on US Debtors' Information Request
The Securities Commission of The Bahamas is authorized to provide information regarding digital assets held in secure wallets to the debtors in the pending US Chapter 11 bankruptcy proceedings, provided they qualify as an overseas regulatory authority or designated third party under the Digital Assets and Registered Exchanges Act. This assistance is permitted only if the debtors or their representatives meet the specific definitions set out in section 41(10) of the Act. The Joint Provisional Liquidators remain free to cooperate with the debtors, subject to court orders that preserve confidentiality and do not impede the Securities Commission's regulatory functions.
