Rule · OJK · 28 Dec 2015 · 37/POJK.05/2015
The regulation mandates the Financial Services Authority (OJK) to conduct direct examinations of Venture Capital Companies (PMV), Sharia Venture Capital Companies (PMVS), and Sharia Business Units (UUS) to ensure compliance and verify periodic reports. Examinations are performed at least once every three years or as needed, following specific procedural steps including notification, document review, and reporting. Non-compliance or obstruction of these examinations triggers a tiered administrative sanction system ranging from written warnings to business suspension and license revocation, with specific provisions for entities operating Sharia units.

FINANCIAL SERVICES AUTHORITY REGULATION
NUMBER 37/POJK.05/2015
ON
DIRECT EXAMINATION OF VENTURE CAPITAL COMPANIES
I. GENERAL
Venture Capital Company (PMV) or Sharia Venture Capital Company (PMVS) is one of the non-bank financial institutions expected to be one of the alternative financial services that can be utilized by partner businesses and/or debtors to finance their business activities. With the existence of PMV or PMVS, it is expected to provide an impact on national economic growth. Therefore, effective and efficient management of business activities is required, implemented by PMV or PMVS to achieve the aforementioned objectives. To ensure the effectiveness of the management of PMV or PMVS business activities, including compliance with applicable regulations, supervision in the form of on-site supervision through Direct Examination is necessary.
With the ratification of Law Number 21 of 2011 on the Financial Services Authority on 22 November 2011, the supervisory duties over PMV or PMVS shifted to the Financial Services Authority as of 31 December 2012. Certainly, a legal basis is required for the Financial Services Authority to exercise its functions and authorities to supervise PMV or PMVS in the form of Direct Examination.
In this regard, the Financial Services Authority establishes the Financial Services Authority Regulation on Direct Examination of Venture Capital Companies.
