CIRCULAR LETTER OF THE FINANCIAL SERVICES AUTHORITY NUMBER 18/SEOJK.03/2023 CONCERNING PROCEDURES FOR THE USE OF PUBLIC ACCOUNTANTS AND PUBLIC ACCOUNTING FIRMS IN FINANCIAL SERVICES ACTIVITIES
In connection with the issuance of Financial Services Authority Regulation Number 9 of 2023 concerning the Use of Public Accountants and Public Accounting Firms in Financial Services Activities (State Gazette of the Republic of Indonesia Year 2023 Number 17/OJK, Supplement to the State Gazette of the Republic of Indonesia Number 42/OJK) which is hereinafter referred to as POJK AP and KAP, it is necessary to regulate implementation provisions regarding the procedures for the use of public accountants and public accounting firms in financial services activities in this Financial Services Authority Circular as follows:
I. GENERAL PROVISIONS
persons included in the audit, review, other assurance, and/or non-assurance assignments, namely:
a) Partner; b) Leader; c) Professional staff; and/or d) Reviewer, who participate in the assignment;
persons included in the chain of execution or command, namely the KAP leader and all persons who:
a) supervise or have direct management responsibility for the audit; b) evaluate performance or recommend compensation for Partners in the audit assignment; or c) provide quality control or other oversight over the audit; and
any other Partner, leader, or other professional staff of the KAP and affiliates of the KAP who have provided audit, review, other assurance, and/or non-assurance services to the Party being audited or examined (client).
f. Key Employee is an individual who has the authority and responsibility to plan, lead, and control the business activities of the Party, including members of the Board of Commissioners, members of the Board of Directors, and executive officials of the company. g. Close Family Members are spouses, parents, children, and siblings. h. Continuing Professional Education, hereinafter abbreviated as PPL, is continuous professional education and/or training for APs aimed at maintaining competence.
In the interest of transparency of financial conditions and improvement of financial information quality, Parties use the services of APs and KAPs registered and recorded in the list of active APs and KAPs at the Financial Services Authority and possessing competence in accordance with the complexity of the Party's business as referred to in Article 2 paragraph (1) of POJK AP and KAP.
The Financial Services Authority conducts administrative management activities to provide a list of APs and KAPs that can be used by Parties.
The use of APs and KAPs as referred to in item 2 relates to reports that must be audited, examined, or other assignments by APs based on statutory regulations in the financial services sector or written instructions from the Financial Services Authority, as contained in Appendix I which is an integral part of this Financial Services Authority Circular.
II. AP AND/OR KAP APPOINTMENT AND THE ROLE OF THE AUDIT COMMITTEE
The appointment of APs and/or KAPs to provide audit services over annual historical financial information is decided by the General Meeting of Shareholders convened by the Party, considering proposals from the Board of Commissioners, Board of Supervisors, or parties performing supervisory functions as performed by the Board of Commissioners.
Proposals for the appointment of APs and/or KAPs submitted by the Board of Commissioners, Board of Supervisors, or parties performing supervisory functions as performed by the Board of Commissioners must take into account the recommendations of the Audit Committee. In formulating recommendations, the Audit Committee must consider:
a. the independence of the AP, KAP, and Persons Within KAP; b. the scope of the audit;
c. audit fees;
d. the expertise and experience of the AP, KAP, and the KAP audit team; e. the methodology, techniques, and audit tools used by the KAP; f. the benefits of a new perspective to be obtained through the replacement of the AP, KAP, and KAP audit team; g. the potential risks of using the same KAP's audit services consecutively for a sufficiently long period; and h. the results of evaluations regarding the provision of audit services over annual historical financial information by APs and KAPs in previous periods, if any.
The Audit Committee evaluates the provision of audit services over annual historical financial information by APs and/or KAPs, which must at least cover:
a. the conformity of the audit implementation by APs and/or KAPs with applicable audit standards; b. the adequacy of fieldwork time;
c. the assessment of the scope of services provided and the adequacy of sampling; and
d. improvement recommendations provided by APs and/or KAPs.
A KAP may be categorized as the same KAP in the event:
a. the KAP name has not changed and there has been no change in AP composition of more than 50% (fifty percent); or b. there is the establishment or name change of a KAP, but 50% (fifty percent) or more of the AP composition originates from the previous KAP.
III. RESTRICTIONS ON THE USE OF AUDIT SERVICES
Example of the calculation of restrictions on the use of audit services over annual historical financial information from the same AP for Parties consisting of commercial banks, issuers, and public companies is as follows:
PT Lembaga Pembiayaan “ABC” Tbk uses audit services over annual historical financial information from AP “L” and AP “N” from 2017 to 2025 as follows:

In 2025, PT Lembaga Pembiayaan “ABC” Tbk has used audit services over annual historical financial information from AP “L” for 7 (seven) cumulative years. PT Lembaga Pembiayaan “ABC” Tbk may reuse audit services over annual historical financial information from AP “L” in:
a. 2031 if AP “L” acts as the Engagement Partner; b. 2029 if AP “L” acts as the Engagement Quality Control Reviewer; and
c. 2028 if AP “L” acts as other Engagement Audit Partners.
Example of the calculation of the cooling-off period for the use of audit services over annual historical financial information from the same AP with a combination of various roles in accordance with the Code of Ethics of the Public Accountant Professional Association is as follows:
a. If the AP acts as the Engagement Partner for 4 (four) years and other Engagement Audit Partners for 3 (three) years, the cooling-off period is 5 (five) consecutive years. b. If the AP acts as the Engagement Partner for 2 (two) years, the Engagement Quality Control Reviewer for 4 (four) years, and other Engagement Audit Partners for 1 (one) year, the cooling-off period is 3 (three) consecutive years.
c. If the AP acts as the Engagement Partner for 2 (two) years, the Engagement Quality Control Reviewer for 1 (one) year, and other Engagement Audit Partners for 4 (four) years, the cooling-off period is 2 (two) consecutive years.
Example of the calculation of restrictions on the use of audit services over annual historical financial information from the same AP for parties other than commercial banks, issuers, and public companies is as follows:
Bank Perekonomian Rakyat “ABC” uses audit services over annual historical financial information from AP “Y” from 2023 to 2027 as follows:

In 2027, Bank Perekonomian Rakyat “ABC” has used audit services over annual historical financial information from AP “Y” for 5 (five) consecutive fiscal reporting years. Bank Perekonomian Rakyat “ABC” may reuse audit services over annual historical financial information from AP “Y” in 2030.
IV. WORK AGREEMENT AND AUDIT SCOPE
Work Agreement between the Party and KAP
a. APs and/or KAPs conduct audits over annual historical financial information based on a work agreement between the Party and the KAP. b. Specifically for Parties that are banks, investment managers, insurance companies, reinsurance companies, pension funds, and financing institutions, the work agreement between the Party and the KAP must include specific audit scope.
Specific Audit Scope
a. Banking Sector
Specific audit scope for Conventional Commercial Banks (BUK) or Sharia Commercial Banks (BUS) must at least cover:
a) review of management assertions regarding:
(1) assessment and determination of productive asset quality and calculation of Asset Quality Impairment Provisions (PPKA) in accordance with Financial Services Authority Regulations concerning the assessment of asset quality of commercial banks or Sharia Commercial Banks and Sharia Business Units; (2) assessment of Foreclosed Assets (AYDA) in accordance with Financial Services Authority Regulations concerning the assessment of asset quality of commercial banks or Sharia Commercial Banks and Sharia Business Units; (3) details of violations of the Maximum Limit on Credit Provision (BMPK) or Maximum Limit on Fund Disbursement (BMPD) in accordance with Financial Services Authority Regulations concerning maximum limits on credit provision and large fund provision for commercial banks or Sharia Commercial Banks and Sharia Business Units, including the name of the debtor or customer, quality of fund provision or disbursement, percentage, and number of BMPK or BMPD violations; (4) details of exceeding BMPK or BMPD in accordance with Financial Services Authority Regulations concerning maximum limits on credit provision and large fund provision for commercial banks or Sharia Commercial Banks and Sharia Business Units, including the name of the debtor or customer, quality of fund provision or disbursement, percentage, and number of BMPK or BMPD exceedances; (5) the amount and quality of fund provision or disbursement to related parties in accordance with Financial Services Authority Regulations concerning maximum limits on credit provision and large fund provision for commercial banks or Sharia Commercial Banks and Sharia Business Units; (6) calculation of Risk-Weighted Assets (ATMR) in accordance with Financial Services Authority Regulations concerning minimum capital provision obligations for commercial banks or Sharia Commercial Banks, for each risk; (7) calculation of Minimum Capital Provision Obligations (KPMM) in accordance with Financial Services Authority Regulations concerning minimum capital provision obligations for commercial banks or Sharia Commercial Banks; and (8) Net Foreign Exchange Position ratio (PDN) in accordance with statutory regulations concerning the net foreign exchange position of commercial banks; b) review of management disclosures regarding the fairness of transactions with related parties and transactions conducted with special treatment; c) review of the fair value of spot transactions and derivative transactions for BUK or spot transactions and forward transactions for BUS and Sharia Business Units (UUS), and their disclosure; d) specifically for BUS and UUS, review of management calculations regarding:
(1) sources and disbursement of zakat and waqf funds, and sources and use of charitable funds; and (2) profit distribution; e) reliability of the financial reporting information system for BUK or BUS; f) other matters determined based on the results of communication between the Financial Services Authority and APs and/or KAPs as referred to in Article 34 of POJK AP and KAP; and g) other matters regulated in Financial Accounting Standards (SAK) and related accounting regulations issued by the Financial Services Authority, including the Banking Accounting Guide for Conventional Commercial Banks (BPAK) and the Indonesian Sharia Banking Accounting Guidelines (PAPSI), including notes to the financial statements.
Specific audit scope for People's Economic Banks (BPR) or Sharia People's Economic Banks (BPRS) must at least cover:
a) review of management assertions regarding:
(1) assessment of the classification of productive asset quality and adequacy of productive asset write-off provisions in accordance with Financial Services Authority Regulations concerning productive asset quality and formation of productive asset write-off provisions for people's economic banks or Sharia people's economic banks, as formed by BPR or BPRS; (2) assessment of BPR or BPRS Foreclosed Assets (AYDA) in accordance with Financial Services Authority Regulations concerning productive asset quality and formation of productive asset write-off provisions for people's economic banks or Sharia people's economic banks; (3) details of violations of BMPK or BMPD in accordance with Financial Services Authority Regulations concerning maximum limits on credit provision for people's economic banks and maximum limits on fund disbursement for Sharia people's economic banks, including the name of the customer, quality of fund provision or disbursement, percentage, and number of BMPK or BMPD violations; (4) details of exceeding BMPK or BMPD in accordance with Financial Services Authority Regulations concerning maximum limits on credit provision for people's economic banks and maximum limits on fund disbursement for Sharia people's economic banks, including the name of the customer, quality of fund provision or disbursement, percentage, and number of BMPK or BMPD exceedances; (5) the amount and quality of fund provision or disbursement to related parties in accordance with Financial Services Authority Regulations concerning maximum limits on credit provision for people's economic banks and maximum limits on fund disbursement for Sharia people's economic banks; and (6) calculation of KPMM and ATMR in accordance with Financial Services Authority Regulations concerning minimum capital provision obligations and minimum core capital fulfillment for people's economic banks or Sharia people's economic banks; b) review of management disclosures regarding the fairness of transactions with related parties and transactions conducted with special treatment; c) reliability of the financial reporting information system for BPR or BPRS; d) other matters determined based on the results of communication between the Financial Services Authority and APs and/or KAPs as referred to in Article 34 of POJK AP and KAP; and e) other matters regulated in applicable SAK and related accounting regulations issued by the Financial Services Authority, including the BPR Accounting Guide or BPRS Accounting Guide, including notes to the financial statements.
Specifically for banks conducting business activities based on Sharia principles, including Sharia business units, the specific audit scope also includes audit procedures involving communication with the Sharia Supervisory Board before issuing the audit report on the bank's financial statements for:
a) obtaining audit evidence in the form of opinions from the Sharia Supervisory Board regarding the bank's compliance with the implementation of Sharia principles; and b) obtaining information from the Sharia Supervisory Board regarding advice and suggestions provided to the Board of Directors.
b. Capital Market Sector
Specific audit scope for investment managers must at least cover:
a) review of management assertions regarding the going concern of the investment manager; b) review of management disclosures regarding transactions with related parties; c) understanding of transactions involving conflicts of interest conducted by the investment manager in managing funds and considering their impact on financial statements; d) other material information, whether qualitative or quantitative, that has the potential to impact the condition of the investment manager; and e) other matters determined based on the results of communication between the Financial Services Authority and KAPs as referred to in Article 34 of POJK AP and KAP.
Specifically for Sharia investment managers, the specific audit scope also includes audit procedures involving communication with the Sharia Supervisory Board before issuing the audit report on the Sharia investment manager's financial statements for:
a) obtaining audit evidence in the form of opinions from the Sharia Supervisory Board regarding the Sharia investment manager's compliance with the implementation of Sharia principles; and b) obtaining information from the Sharia Supervisory Board regarding advice and suggestions provided to the Board of Directors.
c. IKNB Sector
Procedures for the Use of Public Accountants and Public Accounting Firms in Financial Services Activities
(d) the fairness of transactions with related parties and investment recipients in accordance with the Financial Services Authority Regulation on the financial health level of insurance companies and reinsurance companies and the Financial Services Authority Regulation on the financial health level of insurance companies and reinsurance companies with Sharia principles;
(3) the reliability of the financial reporting information system of insurance companies and reinsurance companies;
(4) other matters determined based on the results of communication between the Financial Services Authority and the AP and/or KAP as referred to in Article 34 of the POJK on AP and KAP; and
(5) other matters regulated in the Financial Accounting Standards (SAK) and related accounting regulations issued by the Financial Services Authority.
(1) determining the sample size through the application of a statistical-based formula or through professional consideration considering risks and types of investments;
(2) review of management assertions regarding:
(a) classification and valuation of investment assets in accordance with the Financial Services Authority Regulation on pension fund investments;
(b) the amount of investments in affiliated parties in accordance with the Financial Services Authority Regulation on pension fund investments;
(c) testing of investment limits per party and per type of investment in accordance with the Financial Services Authority Regulation on pension fund investments;
(d) the accuracy of pension benefit payments in accordance with the Law on the Development and Strengthening of the Financial Sector;
(e) the accuracy of the allocation of development results to each participant for pension funds with defined contribution programs in accordance with the Financial Services Authority Regulation on contributions, pension benefits, and other benefits administered by pension funds;
(f) the assessment of the age of contribution receivables based on maturity and the calculation of returns or sanctions in the form of fines in accordance with the Law on the Development and Strengthening of the Financial Sector;
(g) the separation of recording between pension benefits and other benefits in the event that pension funds administer or provide other benefits in accordance with the Financial Services Authority Regulation on contributions, pension benefits, and other benefits administered by pension funds; and
(h) the separation of recording of pension program assets and liabilities from other benefit assets and liabilities in the event that pension funds provide other benefits as an addition to pension programs in accordance with the Law on the Development and Strengthening of the Financial Sector;
review of management disclosures regarding the fairness of transactions with affiliated parties or transactions conducted with special treatment;
review of the calculation and distribution of ta’zir funds for Sharia pension funds and pension funds with Sharia business units in accordance with the Financial Services Authority Regulation on the administration of pension programs based on Sharia principles;
other matters determined based on the results of communication between the Financial Services Authority and the AP and/or KAP as referred to in Article 34 of the POJK on AP and KAP; and
other matters regulated in the applicable Financial Accounting Standards (SAK) and investment valuation in accordance with Financial Services Authority regulations on the basis of pension fund investment valuation, form and structure, and procedures for submitting annual investment reports.
Financing Institutions
The scope of specific audits for financing institutions, including financing institutions with Sharia principles, must at least include:
a) determining the sample size through the application of a statistical-based formula or through professional consideration considering risks, product types, and debtor segments of financing companies, venture capital companies, and infrastructure financing companies;
b) review of management assertions regarding:
(1) valuation and determination of:
(a) the quality of financing receivables or the quality of productive assets; and
(b) the calculation of provisions for write-off of financing receivables or provisions for write-off of productive assets,
in accordance with the Financial Services Authority Regulation on the administration of financing company business, the Financial Services Authority Regulation on the administration of Sharia financing company business and Sharia business units of financing companies, the Financial Services Authority Regulation on the administration of venture capital company business, and the Financial Services Authority Regulation on infrastructure financing companies;
(2) the amount and quality of funding provided to related parties in accordance with the Financial Services Authority Regulation on the administration of financing company business, the Financial Services Authority Regulation on the administration of Sharia financing company business and Sharia business units of financing companies, the Financial Services Authority Regulation on the administration of venture capital company business, and the Financial Services Authority Regulation on infrastructure financing companies;
(3) Calculation of ratios for:
(a) financing institutions administering financing company business in accordance with the Financial Services Authority Regulation on the administration of financing company business, including the net non-performing financing ratio and the capital adequacy ratio;
(b) financing institutions administering Sharia financing company business and Sharia business units in accordance with the Financial Services Authority Regulation on the administration of Sharia financing company business and Sharia business units of financing companies, including the net non-performing productive asset ratio and the capital adequacy ratio;
(c) financing institutions administering infrastructure financing company business in accordance with the Financial Services Authority Regulation on infrastructure financing companies, including the net non-performing financing ratio and the capital adequacy ratio;
c) review of management disclosures regarding the fairness of transactions with related parties or transactions conducted with special treatment;
d) other matters determined based on the results of communication between the Financial Services Authority and the AP and/or KAP as referred to in Article 34 of the POJK on AP and KAP; and
e) other matters regulated in the Financial Accounting Standards (SAK) and related accounting regulations issued by the Financial Services Authority.
a) obtaining audit evidence in the form of opinions from the Sharia Supervisory Board regarding the compliance of insurance companies, reinsurance companies, pension funds, and financing institutions with the implementation of Sharia principles; and
b) obtaining information from the Sharia Supervisory Board regarding advice and suggestions provided to the Board of Directors.
V. SUBMISSION OF REPORTS FROM PARTIES TO THE FINANCIAL SERVICES AUTHORITY
a. the appointment of APs and KAPs for audits of annual historical financial information; and
b. the realization of the use of AP and KAP services,
electronically through the Financial Services Authority's reporting system.
The report on the appointment of APs and KAPs as referred to in item 1 letter a is prepared with reference to Form 1 as stated in Appendix II, which is an integral part of this Circular Letter of the Financial Services Authority.
The report on the appointment of APs and KAPs must be submitted no later than 10 (ten) working days after the work agreement between the Party and the KAP is signed, attaching:
a. documents appointing APs and KAPs, including minutes of the General Meeting of Shareholders and work agreements between the Party and the KAP;
b. Audit Committee recommendations and considerations used in providing recommendations; and
c. self-assessment results regarding the fulfillment of restrictions on the use of audit services and cooling-off periods received from the KAP.
a. the Audit Committee's evaluation results regarding the implementation of audit services for annual historical financial information; and
b. information on KAP service usage transactions.
The Audit Committee's evaluation results regarding the implementation of audit services for annual historical financial information as referred to in item 4 letter a are the results of the Audit Committee's evaluation of the implementation of audit services for annual historical financial information by APs and KAPs for the previous fiscal year. For example, Bank “DEF” uses audit services for annual historical financial information from AP “G” and KAP “H” for the 2023 fiscal year ending in December 2023. Bank “DEF” reports the Audit Committee's evaluation results of audit services for historical financial information from AP “G” and KAP “H” no later than June 30, 2024. In the event that the report submission deadline falls on a Saturday, Sunday, and/or other holidays, Bank “DEF” submits the report no later than the next working day.
The report on the realization of the use of AP and KAP services as referred to in item 1 letter b is prepared with reference to Form 2 as stated in Appendix II, which is an integral part of this Circular Letter of the Financial Services Authority.
Parties prepare and submit corrections for errors in information in reports as referred to in item 1 letters a and b electronically through the Financial Services Authority's reporting system. Corrections to reports submitted by Parties to the Financial Services Authority can be made by considering the results of communication between the Party and the Financial Services Authority.
The procedures for submitting reports and/or report corrections electronically through the Financial Services Authority's reporting system as referred to in items 1 and 7 are carried out for:
a. Parties other than issuers and public companies via a website with the address https://apolo.ojk.go.id; and
b. Parties that are issuers and public companies via a website with the address https://spe.ojk.go.id.
In the event that Parties conduct activities in more than 1 (one) financial services sector, reports and/or report corrections are submitted in accordance with the type of financial services sector institution.
For example, PT Insurance “ABC” Tbk conducts activities in the IKNB and Capital Market sectors, so PT Insurance “ABC” Tbk submits reports and/or report corrections via a website with the address https://apolo.ojk.go.id because PT Insurance “ABC” Tbk has an institutional structure in the form of an insurance company.
a. for banks, submitting reports and/or report corrections via a website with the address https://sipenaojk.ojk.go.id or other addresses designated by the Financial Services Authority for commercial banks or offline for Rural Banks (BPR) and Sharia Rural Banks (BPRS);
b. for Parties in the Capital Market sector:
for Parties that are securities brokers and underwriters, submitting reports and/or report corrections via a website with the address https://ojk.go.id/ereporting or other addresses designated by the Financial Services Authority;
for Parties that are investment managers, submitting reports and/or report corrections via a website with the address https://aria.ojk.go.id or other addresses designated by the Financial Services Authority;
c. for Parties in the IKNB sector, submitting reports and/or report corrections via a website with the address https://ojk.go.id/ereporting, other addresses designated by the Financial Services Authority, or offline, until the Financial Services Authority's reporting system via a website with the address https://apolo.ojk.go.id is available.
a. banks, with addresses:
the relevant Bank Supervision Department for banks headquartered or branch offices of banks located abroad within the Special Capital Region of Jakarta Province; or
the Regional Office of the Financial Services Authority or the local Financial Services Authority Office in accordance with the area where the bank's headquarters is located;
b. Parties in the Capital Market sector, addressed to the relevant Capital Market Supervision Department; and
c. Parties in the IKNB sector, addressed to the relevant IKNB Supervision Department.
For example, PT Bank “ABC” Tbk, headquartered in the Special Capital Region of Jakarta Province, submits reports to the relevant Bank Supervision Department because PT Bank “ABC” Tbk has an institutional structure in the form of a bank.
Parties appoint reporting responsible officers on the Financial Services Authority's reporting system via a website with the address https://apolo.ojk.go.id as administrator responsible officers who have the authority to appoint reporting implementation officers with access rights to create, modify, or delete user IDs of reporting implementation officers as responsible officers on the Financial Services Authority's reporting system.
Reporting responsible officers and reporting implementation officers have access rights to submit reports through the Financial Services Authority's reporting system.
VI. PROFESSIONAL EDUCATION PROGRAM AND CONTINUING PROFESSIONAL LEARNING (PPL)
APs must have competence and knowledge in the field of financial services and industries using AP services, fulfilled through professional education programs and PPL administered by institutions recognized by the Financial Services Authority.
Professional Education Programs
a. Professional education programs are educational programs for APs to enhance competence and knowledge in the field of financial services and industries using AP services.
b. The material covered in professional education programs must be at least 20 (twenty) professional credit units for each financial services sector, including:
general knowledge regarding the functions, duties, and authorities of the Financial Services Authority;
knowledge of Financial Services Authority Regulations related to APs, KAPs, accounting, auditing, and services that can be provided to Parties;
knowledge of Financial Services Authority Regulations regarding the obligations of Parties that must be disclosed in financial statements; and
knowledge of Sharia principles, at least covering Sharia principles in the business activities of Parties and Sharia financial accounting standards.
For example, APs applying for registration with the Financial Services Authority in the Capital Market and IKNB sectors must fulfill professional education program activities of at least 40 (forty) professional credit units, namely at least 20 (twenty) professional credit units for the Capital Market sector and at least 20 (twenty) professional credit units for the IKNB sector.
For example, APs registered with the Financial Services Authority in the Banking and Capital Market sectors must fulfill PPL activities of at least 10 (ten) professional continuing education credit units every year, namely at least 5 (five) professional continuing education credit units for the Banking sector and at least 5 (five) professional continuing education credit units for the Capital Market sector.
b. APs registered with the Financial Services Authority follow PPL starting in the year following the year the AP obtains the Registered Letter (STTD) from the Financial Services Authority with the number of professional continuing education credit units as referred to in letter a.
c. For APs registered with the Financial Services Authority in the Banking sector who, based on the POJK on AP and KAP, do not yet have Sharia accounting knowledge certificates, may follow PPL covering Sharia material until December 31, 2023, to fulfill transition requirements regarding Sharia accounting certification as regulated in Article 23 of the POJK on AP and KAP.
b. Institutions as referred to in letter a and the Financial Services Authority coordinate in:
determining the material and number of professional credits or professional continuing education credits from professional education and PPL programs; and
submitting recapitulation data of participants in professional education and PPL programs to the Financial Services Authority.
VII. ADMINISTRATION MANAGEMENT OF APs AND KAPs
a. Registration of APs and/or KAPs
Registration applications for APs and/or KAPs must be submitted to the Financial Services Authority as follows:
a) valid permits from the Minister;
b) the latest resume signed on sufficient stamp paper. The resume includes educational background and work experience as an auditor, completed with explanations of assignments received in the last 3 (three) years at the KAP, as well as information on the names of audited companies, assignment years, and types of assignments;
c) Identity Card (KTP);
d) recent color passport photos sized 4x6 cm;
e) Taxpayer Identification Number (NPWP);
f) professional education program certificates in accordance with the chosen financial services sector obtained within the last 2 (two) years;
g) notarized cooperation agreements regarding APs as Partners in partnerships or permits as sole proprietorship KAPs registered with the Financial Services Authority;
h) AP statements signed on sufficient stamp paper with reference to Form 3.2 as stated in Appendix II, which is an integral part of this Circular Letter of the Financial Services Authority, stating that the AP:
(1) has never been subject to administrative sanctions in the form of cancellation of the STTD by the Financial Services Authority or previous authorities;
(2) is not listed in the list of credits and/or non-performing financing;
(3) is not included as a party prohibited from becoming a main party in accordance with the Financial Services Authority Regulation on the reassessment of main parties of financial services institutions; and
(4) does not hold dual positions, namely:
(a) does not work at other KAPs or other supporting professions in financial services registered with the Financial Services Authority; and/or
(b) does not work at client companies or client business groups with reports to be consolidated;
i) other requirement documents requested by the Financial Services Authority when necessary. For example, proof of registration payment, settlement letters from financial institutions if APs are listed in the credits or non-performing financing list, resignation letters from positions so that there are no dual positions, and proof that APs have registered as reporting parties in the application system for the implementation of anti-money laundering and counter-terrorism financing programs administered by the Center for Reporting and Analysis of Financial Transactions.
a) valid business permits from the Minister;
b. the establishment deed of the KAP along with the latest amendments;
c) Taxpayer Identification Number (NPWP);
d) approval letters from the Minister regarding the inclusion of foreign public accountant office names or foreign audit organizations, if the KAP cooperates with foreign public accountant offices or foreign audit organizations;
e) cooperation agreements between KAPs and foreign public accountant offices or foreign audit organizations, for KAPs that cooperate with foreign public accountant offices or foreign audit organizations, at least covering quality review obligations and training from foreign public accountant offices or foreign audit organizations to KAPs;
f) KAP statements signed on sufficient stamp paper by the KAP leader with reference to Form 3.4 as stated in
in Appendix II which is an integral part of this Financial Services Authority Circular, stating that the Public Accounting Firm (KAP):
(1) has never been subject to administrative sanctions in the form of revocation of the STTD by the Financial Services Authority or previous authorities; (2) is not listed in the list of non-performing credits and/or financing; and (3) is not currently cooperating with foreign public accounting offices or foreign audit organizations that are undergoing sanctions in the form of cooperation restrictions with the Public Accounting Firm by the Financial Services Authority; g) other requirement documents requested by the Financial Services Authority when necessary. b. Addition and/or Reduction of Service Scope Provision by AP in Financial Services Sector
significant violations of legislation provisions by Parties;
significant weaknesses in the control processes for the preparation and presentation of Parties’ financial reports;
significant weaknesses in Parties’ internal controls;
conditions or estimated conditions that may endanger Parties’ business continuity; and/or
other information whenever requested by the Financial Services Authority.
b. The significance of the impact of a problem considers among others:
negative impacts of problems and/or legal violations on Parties’ business continuity or performance;
indications of intentional violations of regulations;
indications of intentional non-fulfillment of commitments; and/or
the number and/or frequency of violations.
c. Conditions of significant violations of legislation provisions for:
banks, including:
a) violations of BMPK or BMPD; or b) deficiency in minimum reserve requirements;
Parties in the Capital Market sector, including:
a) indications of committing criminal violations in the Capital Market sector such as fraud; or b) disclosure of information known to mislead readers and/or users of financial reports;
Entities in the Non-Bank Financial Sector (IKNB), including for:
a) insurance companies:
(1) violations of minimum equity fulfillment requirements; (2) establishment of guarantee funds with amounts below requirements in accordance with Financial Services Authority Regulations regarding the financial health of insurance and reinsurance companies; or (3) investment placements exceeding limits in accordance with Financial Services Authority Regulations regarding the financial health of insurance and reinsurance companies; b) pension funds:
(1) payments (pension benefits, operational costs, and other expenditures) that do not comply with pension fund regulations; (2) lending or pledging pension fund assets to any party, except those categorized as investment portfolio management; (3) investment placements exceeding limits in accordance with Financial Services Authority Regulations regarding pension fund investments; (4) investment placements in prohibited investment types in accordance with Financial Services Authority Regulations regarding pension fund investments; (5) conducting derivative transactions, except for hedging derivative transactions in accordance with Financial Services Authority Regulations regarding pension fund investments; or (6) holding derivative instruments, except for derivative instruments obtained from the ownership of other instruments in accordance with Financial Services Authority Regulations regarding pension fund investments; c) financing companies, violations of maximum financing limits, non-performing financing, gearing ratio, or financing to asset ratio in accordance with Financial Services Authority Regulations regarding the conduct of financing business; d) venture capital companies, violations of gearing ratio or investment and financing to asset ratio in accordance with Financial Services Authority Regulations regarding the conduct of venture capital business; and e) guarantee institutions, violations of gearing ratio, claim reserves, claim payment obligations, or liquidity ratios in accordance with Financial Services Authority Regulations regarding the conduct of guarantee institution business.
