PS23/13: Introducing a gateway for firms who approve financial promotions
The Financial Conduct Authority establishes a regulatory gateway under section 21 of the Financial Services and Markets Act 2000, requiring all authorised persons to obtain permission before approving financial promotions for unauthorised persons. Applications for this permission are open from 6 November 2023 to 6 February 2024, with the new legislation coming fully into force on 7 February 2024. The regime imposes a bi-annual reporting requirement on approved firms and mandates notification within seven days for approvals involving mass-marketing bans or qualifying cryptoassets. Exemptions apply to promotions prepared by appointed representatives, those within the same corporate group, and a firm's own promotions.
