Regulation on Conditions, Procedure, and Documentation for Registration in the Register of Banks, Subsidiaries, Branches, and Representative Offices in the Brčko District of Bosnia and Herzegovina

On the basis of Article 68 of the Law on the Central Bank of Bosnia and Herzegovina ("Official Gazette of BiH", 1/97, 29/02, 8/03 and 13/03), and in connection with Articles 7 and 8 of the Law on Banks in the Brčko District of Bosnia and Herzegovina ("Official Gazette of the Brčko District of BiH", 5/03), the Governing Board of the Central Bank of Bosnia and Herzegovina, at its 8th meeting held on May 21, 2003, adopts

RULES on the conditions, procedure, and documentation for registration in the Register of Banks, Subsidiaries, Branches, and Representative Offices in the Brčko District of Bosnia and Herzegovina

1. These Rules establish the Register of Banks, Subsidiaries, Branches, and Representative Offices in the Brčko District of Bosnia and Herzegovina (hereinafter: "Register of Banks" and "District"), as well as the conditions, procedure, and documentation for registration in the Register of Banks.

2. The Register of Banks referred to in item 1 of these Rules is maintained by the Central Bank of Bosnia and Herzegovina, Branch in Brcko (hereinafter: Branch of the Central Bank).
   Registration in the Register of Banks under paragraph 1 of this item is a basic condition without which a bank, subsidiary, branch, or representative office (hereinafter: bank) cannot commence business operations.

3. Applications for registration in the Register of Banks are submitted by banks holding a permit issued by the competent banking agency to the Branch of the Central Bank after the entry into force of these Rules, and by other banks upon issuance of the permit by the competent banking agency.

4. The application referred to in item 3 of these Rules contains:

• the name and address or addresses of the bank in the District,
• a certified permit or authorization issued by the competent banking agency in accordance with the Law on Banks in the Brčko District of Bosnia and Herzegovina,
• a certified statute of the bank,
• a list of authorized persons responsible for the bank's operations in the District, along with deposited signatures and limitations regarding their authorizations,
• a certified statement confirming that the bank, with its headquarters in the country or abroad, guarantees its obligations arising from its operations in the District with its assets, if the bank's headquarters is outside the District.

5. Upon receipt, if the Branch of the Central Bank determines that the documentation submitted under item 4 of these Rules is in order, it shall register the bank in the Register of Banks within 8 (eight) working days, and issue a written notice to the bank thereof.
   If the Branch of the Central Bank determines upon receipt that the submitted documentation is incomplete or defective, it shall call upon the bank to complete or rectify the documentation within 8 (eight) days.
   If the bank does not complete or rectify the documentation within the period specified in paragraph 2 of this item, the Branch of the Central Bank shall notify the bank in writing that registration in the Register of Banks has not been carried out.

6. Registration in the Register of Banks is a condition for submitting an application for registration of the bank in the court registry in accordance with the prevailing regulations of the District, which must be submitted within 30 (thirty) days from the date of registration of the bank in the Register of Banks.
   The bank is obliged to submit a certified copy of the registration in the court registry to the Branch of the Central Bank within 8 (eight) days from the date of issuance of the decision on registration in the court registry.

7. A bank whose operating permit or authorization issued by the competent banking agency is revoked for any reason shall be deleted from the Register of Banks, and the Branch of the Central Bank shall notify the court in whose registry the bank is registered thereof.

8. The Governor of the Central Bank of Bosnia and Herzegovina may decide to publish the data from the Register of Banks in full or in part.

9. An integral part of these Rules is the form of the Register of Banks.

10. These Rules enter into force on the day of publication in the "Official Gazette of BiH", and shall also be published in the official gazettes of the Federation of Bosnia and Herzegovina, Republika Srpska, and the Brčko District.
