RESOLUTION NO. 3042
Provides for the application of resources from reserves, provisions, and funds of specialized health insurance companies, as well as regarding the acceptance of corresponding assets as guarantors of such resources, in accordance with the legislation and regulations in force.
The CENTRAL BANK OF BRAZIL, in accordance with Art. 9 of Law No. 4,595, of December 31, 1964, makes it public that the MONETARY NATIONAL COUNCIL, in a session held on November 28, 2002, considering the provisions of Art. 1, paragraph 5, of Law 10,185, of February 12, 2001,
HAS RESOLVED:
Art. 1. Establish that the resources of the reserves, provisions, and funds of specialized health insurance companies, constituted in accordance with the criteria fixed by the National Council of Supplementary Health - CONSU, must be invested with observance of the guidelines and conditions provided for in Resolution 3,034, of October 29, 2002, and its annexed Regulation, except for those contained in Art. 2, paragraph 1, of the resolution and Arts. 5 to 9 and 12, paragraph 2, item III, of the regulation.
Sole Paragraph. The assets corresponding to the investments of the resources referred to in this article are considered guarantors thereof, in accordance with the legislation and regulations in force.
Art. 2. For the purposes of this Resolution, the competencies attributed to the National Council of Private Insurance (CNSP) and the Superintendence of Private Insurance (SUSEP) under the terms of Resolution 3,034, of 2002, must be exercised, respectively, by the CONSU and by the National Supplementary Health Agency - ANS.
Art. 3. The ANS, the Central Bank of Brazil, and the Securities and Exchange Commission are authorized, within their respective areas of competence, to adopt the measures and issue the norms necessary for the execution of the provisions of this Resolution.
Art. 4. This Resolution enters into force on the date of its publication.
