Amends Resolution CMN No. 5,095, of August 24, 2023, which provides for financing under the support of resources from the National Fund on Climate Change – FNMC.
The Central Bank of Brazil, in accordance with Article 9 of Law No. 4,595, of December 31, 1964, makes public that the National Monetary Council, in a session held on December 19, 2024, based on Articles 9 of Law No. 12,114, of December 9, 2009, and 16 of Decree No. 9,578, of November 22, 2018,
RESOLVES:
Article 1. Resolution CMN No. 5,095, of August 24, 2023, published in the Official Gazette of the Union on August 25, 2023, shall enter into force with the following alterations:

a) for the purposes referred to in Article 1, caput, items I, II, III and VI: 6.50 p.p. (six and fifty hundredths percentage points); or
b) for the purposes referred to in Article 1, caput, item IV:
9.50 p.p. (nine and fifty hundredths percentage points) for the following specific purpose: solar energy generation; or
6.50 p.p. (six and fifty hundredths percentage points) for the following specific purposes: new renewable sources and isolated systems with renewables; wind energy generation; biomass and waste energy generation; energy storage, energy efficiency and grid modernization; and development of productive chains; or

d) up to sixteen years, including up to six years of grace period, for application in the purpose provided for in Article 1, caput, item IV, excluding wind energy generation;

f) up to twenty-five years, including up to eight years of grace period, for application in the purpose provided for in Article 1, caput, item V; and
g) up to twelve years, including up to two years of grace period, for application in the purpose provided for in Article 1, caput, item VI; and

Article 2. Financing operations approved by the National Bank for Economic and Social Development – BNDES until December 31, 2024 may, at the borrower's discretion, be contracted with the financial conditions in force in Resolution CMN No. 5,095, of August 24, 2023, before the alterations introduced by this Resolution, up to the limit of the budgetary resource availability of the 2024 fiscal year.
Sole Paragraph. If the operations referred to in the caput are not contracted under the financial conditions defined prior to the publication of this norm, all financial conditions established in this Resolution must be observed.
Article 3. Article 3 of Resolution CMN No. 5,095, of August 24, 2023, published in the Official Gazette of the Union on August 25, 2023, is hereby repealed.
Article 4. This Resolution enters into force on the date of its publication.
