Resolution CMN No. 839 — Sets Commission to Cover Operating Expenses Incurred by Banco do Brasil and CEF for PIS/PASEP Fund Tasks

RESOLUTION No. 000839

THE CENTRAL BANK OF BRAZIL, in accordance with Article 9 of Law No. 4,595, of December 31, 1964, makes public that the MONETARY COUNCIL, in a session held on this date, having regard to the provisions of Article 2 of Complementary Law No. 19, of June 25, 1974, Article 2, sole paragraph, of Complementary Law No. 26, of September 11, 1975, and Articles 11, sole paragraph, and 12, sole paragraph, of Decree No. 78,276, of August 17, 1976,

RESOLVES:

I - To fix at 0.750% (seven hundred and fifty thousandths percent) the commission to cover the operating expenses incurred by Banco do Brasil S.A. and Caixa Econômica Federal, relating to the services of collection, control of contributions and distribution of results, as well as all other tasks provided for in the Regulation of the PIS-PASEP Participation Fund, which shall be calculated on the net equity of the Fund (determined at the end of its financial year), and may be debited in monthly installments.

II - To determine that, of the 0.750% (seven hundred and fifty thousandths percent) referred to in item I, 0.375% (three hundred and seventy-five thousandths percent) shall be due to Banco do Brasil S.A. and 0.375% (three hundred and seventy-five thousandths percent) to Caixa Econômica Federal, in their capacity as administrators of the Public Servant Wealth Formation Program (PASEP) and the Social Integration Program (PIS), respectively.

III - To establish that those participants who received, in the immediately preceding year, a salary equal to or less than 5 (five) times the average value of the regional minimum wages in force during the base year, determined through the Annual Social Information Report (RAIS), shall be entitled to the minimum deposit equivalent to the regional minimum wage, as provided for in the sole paragraph of Article 2 of Complementary Law No. 26, of September 11, 1975.

IV - To determine that the transfers of resources originating from the collection of PIS and PASEP, made by Caixa Econômica Federal and Banco do Brasil S.A. in favor of the National Bank for Economic and Social Development - BNDES, shall follow a scheme previously established by the Ministry of Finance in conjunction with the Secretariat of Planning of the Presidency of the Republic.

V - This Resolution shall enter into force on the date of its publication and shall produce effects:

a) with respect to items I and II, from January 1, 1983;

b) with respect to item III, from July 1, 1983; and

c) with respect to item IV, immediately.

VI - Items III and IV of Resolution No. 298, of July 30, 1974, as amended by Resolution No. 343, of October 1, 1975, and subsequent regulations, are hereby revoked, maintained, for the period from July 1, 1982 to December 31, 1982, the same levels of commission established by Resolution No. 701, of August 26, 1981.
