RESOLUTION issuing the official format for the reporting of relevant, unusual, and internally concerning operations contemplated in the general provisions referred to in Article 115 of the Credit Institutions Law in relation to Article 87-D of the General Law of Credit Institutions Auxiliary Organizations and Activities and Article 95 Bis of the latter legislation, applicable to multiple-object financial societies, with respect to unregulated multiple-object financial societies, and for the reporting of unusual and internally concerning operations contemplated in the General Provisions referred to in Article 226 Bis of the Securities Market Law, applicable to investment advisors, as well as the instructions for its completion.

RESOLUTION ISSUING THE OFFICIAL FORMAT FOR THE REPORTING OF RELEVANT, UNUSUAL, AND INTERNALLY CONCERNING OPERATIONS CONTEMPLATED IN THE GENERAL PROVISIONS REFERRED TO IN ARTICLES 115 OF THE CREDIT INSTITUTIONS LAW IN RELATION TO 87-D OF THE GENERAL LAW OF CREDIT INSTITUTIONS AUXILIARY ORGANIZATIONS AND ACTIVITIES AND 95 BIS OF THIS LATTER LEGISLATION, APPLICABLE TO MULTIPLE-OBJECT FINANCIAL SOCIETIES, WITH RESPECT TO UNREGULATED MULTIPLE-OBJECT FINANCIAL SOCIETIES AND FOR THE REPORTING OF UNUSUAL AND INTERNALLY CONCERNING OPERATIONS CONTEMPLATED IN THE GENERAL PROVISIONS REFERRED TO IN ARTICLE 226 BIS OF THE SECURITIES MARKET LAW, APPLICABLE TO INVESTMENT ADVISORS, AS WELL AS THE INSTRUCTIONS FOR ITS COMPLETION.

ALBERTO BAZBAZ SACAL, Head of the Financial Intelligence Unit of the Ministry of Finance and Public Credit, pursuant to the provisions of Articles 95 Bis of the General Law of Credit Institutions Auxiliary Organizations and Activities and 226 Bis of the Securities Market Law; 28th, 29th, and 34th of the General Provisions referred to in Article 115 of the Credit Institutions Law in relation to 87-D of the General Law of Credit Institutions Auxiliary Organizations and Activities and 95 Bis of the latter legislation, applicable to multiple-object financial societies, and 20th and 24th of the General Provisions referred to in Article 226 Bis of the Securities Market Law, applicable to investment advisors, in exercise of the powers conferred upon me by Article 15, fraction IV, of the Internal Regulations of the Ministry of Finance and Public Credit; and

CONSIDERING

That on March 17, 2011, the General Provisions referred to in Article 115 of the Credit Institutions Law in relation to 87-D of the General Law of Credit Institutions Auxiliary Organizations and Activities and 95 Bis of the latter legislation, applicable to multiple-object financial societies, were published in the Official Gazette of the Federation, which were last modified on December 31, 2014, the same date on which the General Provisions referred to in Article 226 Bis of the Securities Market Law, applicable to investment advisors, were published in that official dissemination organ, and which were reformed by publication on December 29, 2015, in the aforementioned official medium, by virtue of which the harmonization of standards applicable to different entities and financial activities in Mexico continued, in matters of prevention, detection, and reporting of operations possibly related to crimes involving proceeds of illicit resources or terrorism financing;

That in accordance with the aforementioned General Provisions, the Ministry of Finance and Public Credit must issue the official format, as well as establish the terms and specifications so that the obligated subjects referred to in said Provisions remit to this Department, through the National Banking and Securities Commission, their reports of Relevant, Unusual, and Internally Concerning Operations, as appropriate;

That on May 31, 2012, the Resolution issuing the official format for the reporting of relevant, unusual, and internally concerning operations contemplated in the General Provisions referred to in Article 115 of the Credit Institutions Law in relation to 87-D of the General Law of Credit Institutions Auxiliary Organizations and Activities and 95 Bis of the latter legislation, applicable to multiple-object financial societies, as well as the instructions for its completion, with respect to unregulated multiple-object financial societies, was published in the Official Gazette of the Federation;

That in accordance with Article 15, fraction IV, of the Internal Regulations of the Ministry of Finance and Public Credit, the Financial Intelligence Unit is an Administrative Unit of this Department authorized to determine and issue, in coordination with the competent decentralized organs of the Ministry of Finance and Public Credit, the official forms for the presentation of reports on the acts, operations, and services that the entities obliged to do so carry out with their clients and users, relating to the establishment of measures and procedures to prevent and detect acts, omissions, or operations that could favor, provide help, assistance, or cooperation of any kind for the commission of crimes of terrorism financing or operations with proceeds of illicit resources;

That it is convenient to continue with the automation of the corresponding information, in order to allow the obligated subjects to generate it in a sufficient, complete, and timely manner, as well as to achieve greater efficiency in its sending and reception, through the issuance of formats, whose technical characteristics will facilitate the delivery of the information, as well as its analysis by the competent authorities, which will contribute to the prevention and detection of operations that could be located in any of the scenarios provided for in Articles 139 Quater or 400 Bis of the Federal Penal Code, and

That after hearing the opinion of the National Banking and Securities Commission, formulated through letter number 221/DGPORPIA-171642/2016 dated April 6, 2016, I have deemed it appropriate to issue the following:

SINGLE ARTICLE.- The official format for the reporting of Relevant, Unusual, and Internally Concerning Operations contemplated in the General Provisions referred to in Article 115 of the Credit Institutions Law in relation to 87-D of the General Law of Credit Institutions Auxiliary Organizations and Activities and 95 Bis of the latter legislation, applicable to multiple-object financial societies, with respect to unregulated multiple-object financial societies, and for the reporting of unusual and internally concerning operations contemplated in the General Provisions referred to in Article 226 Bis of the Securities Market Law, applicable to investment advisors, as well as the instructions for its completion, are hereby issued.

Article 1.- This Resolution aims to establish the official format provided for in Articles 28th, 29th, and 34th of the General Provisions referred to in Article 115 of the Credit Institutions Law in relation to 87-D of the General Law of Credit Institutions Auxiliary Organizations and Activities and 95 Bis of the latter legislation, applicable to multiple-object financial societies, with respect to unregulated multiple-object financial societies, and Articles 20th and 24th of the General Provisions referred to in Article 226 Bis of the Securities Market Law, applicable to investment advisors, as well as the instructions for its completion.

For the purposes of this Resolution, as well as its Annexes, the definitions established in Article 2 of the Provisions referred to in the preceding paragraph shall apply, in addition to the following, which may be used in singular or plural:

I. Provisions, to the General Provisions referred to in Article 115 of the Credit Institutions Law in relation to 87-D of the General Law of Credit Institutions Auxiliary Organizations and Activities and 95 Bis of the latter legislation, applicable to multiple-object financial societies, published in the Official Gazette of the Federation on March 17, 2011, and last modified by resolution published in that same official dissemination organ on December 31, 2014, and to the General Provisions referred to in Article 226 Bis of the Securities Market Law, applicable to investment advisors, published in the Official Gazette of the Federation on December 31, 2014, and reformed by resolution published on December 29, 2015, in the aforementioned dissemination medium.

II. Layout, to the electronic format referred to in Article 2 of this Resolution, and

III. Unit, to the Financial Intelligence Unit of the Ministry.

Article 2.- Unregulated multiple-object financial societies and investment advisors referred to in the Provisions shall remit to the Unit, through the Commission, the reports of Relevant, Unusual, and Internally Concerning Operations provided for therein, as appropriate, using for such effect the Layout and its filling instructions attached to this Resolution as Annexes 1 and 2, respectively.

The aforementioned information shall be presented in the terms and periodicity established in the Provisions.

Article 3.- Unregulated multiple-object financial societies and investment advisors referred to in the Provisions shall present the reports referred to in the previous article, by transmitting them electronically to the Commission. Such information shall be sent only once and will be received assuming it meets all required characteristics, in which case it cannot be modified, with the transmission system generating an electronic receipt stating the name of the unregulated multiple-object financial society or trade name, name of the investment advisor, folio number, type of report, reporting period, date and time of receipt, as well as the total number of records received.

Unregulated multiple-object financial societies and investment advisors shall be responsible for the sending of the financial information in question, as well as ensuring that it meets the quality and characteristics required.

Article 4.- Unregulated multiple-object financial societies in which no Relevant Operations have been carried out during the corresponding period shall send the respective report, capturing only the information corresponding to columns 1 "Type of Report", 2 "Reporting Period", 4 "Supervisory Body", and 5 "Obligated Subject Key", using for such effect the Layout and its filling instructions attached to this Resolution as Annexes 1 and 2.

The aforementioned information shall be presented in the terms and periodicity established in the Provisions.

Article 5.- Unregulated multiple-object financial societies and investment advisors referred to in the Provisions shall present the reports indicated in this Resolution through the Compliance Officer or Representative, as appropriate for each of them.

Article 6.- Unregulated multiple-object financial societies and investment advisors referred to in the Provisions shall maintain the confidentiality and secrecy of the information of their Clients and Users in accordance with applicable provisions, and shall be responsible for the information submitted in accordance with this Resolution, without prejudice to the supervisory powers of the Commission.

TRANSITIONAL PROVISIONS

FIRST.- This Resolution shall enter into force the day following its publication in the Official Gazette of the Federation.

SECOND.- The Resolution issuing the official format for the reporting of relevant, unusual, and internally concerning operations contemplated in the General Provisions referred to in Article 115 of the Credit Institutions Law in relation to 87-D of the General Law of Credit Institutions Auxiliary Organizations and Activities and 95 Bis of the latter legislation, applicable to multiple-object financial societies, as well as the instructions for its completion, with respect to unregulated multiple-object financial societies, published in the Official Gazette of the Federation on May 31, 2012, is hereby repealed.

THIRD.- Unregulated multiple-object financial societies shall remit reports of Relevant, Unusual, and Internally Concerning Operations in accordance with Articles 2, 3, and 4 of this Resolution, using for such effect the Layout and its filling instructions attached as Annexes 1 and 2, from the entry into force thereof, in accordance with the terms and periodicity provided for in the corresponding Provisions.

FOURTH.- Investment advisors shall begin to provide information regarding reports of Unusual and Internally Concerning Operations, in accordance with this Resolution and subject to the deadlines, terms, and conditions provided for in the Provisions.

FIFTH.- From the date of entry into force of this Resolution, the Commission shall make available to the obligated subjects the Layout referred to in Article 2 of this Resolution, as well as its corresponding filling instructions, for consultation and use.

Within the period referred to in the preceding paragraph, said decentralized organ shall make known to unregulated multiple-object financial societies and investment advisors the catalogs indicated in Annex 1 of this Resolution.

ANNEX 1

LAYOUT OF RELEVANT, UNUSUAL, AND INTERNALLY CONCERNING OPERATION INTEGRATED

As a column separator, the semicolon (";") shall be used. For this reason, the improper use of this character in the description of text-type fields such as: "Description of the Operation", "Reasons why the act or operation is considered Internally Concerning or Unusual", "Address", etc., must be avoided, as this could cause problems in the validation of the information resulting in an incorrect file. Consequently, said character shall be used solely and exclusively to separate one column from another. In the case of not having information for any field, the semicolon shall be used consecutively without leaving blank spaces.

Example: ;JUAN JOSE;MARTINEZ;HERNANDEZ;;;19701024;

Where the name and two surnames are being provided but the RFC and CURP are not available, however the date of birth is available, therefore the semicolons were used to separate the corresponding columns.

When the size of any field is greater than that defined in the Layout, the information will be truncated to the number of characters defined in the instructions and will end with the (;).

All information contained in the file must be reported in uppercase letters.

In the case of related persons and/or accounts involved in reports of Unusual and Internally Concerning Operations, only columns 29 to 34 shall be filled, without it being necessary to repeat the information of the main account, with the exception of the information contained in columns 1 to 5, which correspond to the reference data of the report.

Note: for the main operation, the consecutive number of related accounts and/or persons (column 29) will contain the double zero (00).

It must be considered that the catalogs will be distributed by the Ministry of Finance and Public Credit through the National Banking and Securities Commission.
