RESOLUTION

of July 25, 2007 No. 36/6

On the Regulation on Licensing Activities for the Provision of Payment Services Using Electronic Money

(As amended by the resolution of the Board of the National Bank of the Kyrgyz Republic of [March 12, 2008 No. 10/3])

In order to define the procedure and requirements for obtaining a license for the right to carry out activities for the provision of payment services using electronic money in the form of prepaid cards, on the territory of the Kyrgyz Republic, guided by Articles 7, 43 of the Law of the Kyrgyz Republic "On the National Bank of the Kyrgyz Republic", the Board of the National Bank, having considered the submitted draft "Regulation on Licensing Activities for the Provision of Payment Services Using Electronic Money in the Form of Prepaid Cards", resolves:

1. To approve the "Regulation on Licensing Activities for the Provision of Payment Services Using Electronic Money in the Form of Prepaid Cards" (attached).

2. The Payment Systems Department, together with the Legal Department, shall carry out the state registration of this resolution with the Ministry of Justice of the Kyrgyz Republic in the prescribed manner.

3. This resolution shall enter into force from the moment of official publication, after state registration with the Ministry of Justice of the Kyrgyz Republic.

4. After the official publication of the registered regulatory legal act, the Legal Department shall inform the Ministry of Justice of the Kyrgyz Republic about the source of publication (name of publication, its number and date).

5. Legal entities and individual entrepreneurs providing payment services using electronic money shall bring their activities into compliance with the procedure established in the Regulation "On Licensing Activities for the Provision of Payment Services Using Electronic Money" by September 1, 2008.

6. The licensing of activities for the provision of payment services using electronic money in the form of prepaid cards on the territory of the Kyrgyz Republic shall be entrusted to the Supervision Methodology and Licensing Department.

7. The Payment Systems Department shall bring this resolution to the attention of commercial banks, OJSC "Settlement and Savings Company", regional departments and the representative office of the National Bank of the Kyrgyz Republic in Batken Oblast.

8. Control over the execution of this resolution shall be entrusted to Board Member of the National Bank of the Kyrgyz Republic Imankulova Ch.K.
