Resolution of the Board of the Central Bank of the Republic of Uzbekistan

On Introducing Amendments and Additions to the Regulation on Registration of Credit Bureaus and Licensing of Their Activities

[Registered by the Ministry of Justice of the Republic of Uzbekistan on January 23, 2023, registration number 3042-3]

In accordance with the Laws of the Republic of Uzbekistan "On the Central Bank of the Republic of Uzbekistan", "On Credit Information Exchange" and "On Licensing, Permitting and Notification Procedures" and Decree of the President of the Republic of Uzbekistan No. PF-6044 dated August 24, 2020 "On Measures to Drastically Improve Licensing and Permitting Procedures", the Board of the Central Bank of the Republic of Uzbekistan resolves:

1. Amendments and additions shall be introduced to the Regulation on Registration of Credit Bureaus and Licensing of Their Activities, approved by Resolution No. 16/23 of the Board of the Central Bank of the Republic of Uzbekistan dated April 28, 2018 (registration number 3042, July 25, 2018) (National Database of Legislative Documents, 25.07.2018, No. 10/18/3042/1573), in accordance with the Appendix.

2. This resolution has been coordinated with the Ministry of Development of Information Technologies and Communications of the Republic of Uzbekistan and the Chamber of Commerce and Industry of the Republic of Uzbekistan.

3. This resolution shall enter into force from the day of its official publication.

APPENDIX

to the Resolution No. 30/25 of the Board of the Central Bank of the Republic of Uzbekistan dated December 30, 2022

Amendments and Additions Being Introduced to the Regulation on Registration of Credit Bureaus and Licensing of Their Activities

1. The Preamble shall be stated in the following wording:

"This Regulation establishes the procedure for registration of credit bureaus and licensing of their activities.".

2. In the fourth indent of paragraph 8, the word "bankruptcy" shall be replaced with the words "insolvency".

3. Paragraph 9 shall be supplemented with a twelfth indent of the following content:

"A credit bureau must have scoring software that is an integral part of licensed and certified software and technical means for information security and protection used in the bureau's information systems.".

4. It shall be supplemented with paragraph 9^1 of the following content:

"9^1. The credit bureau's scoring software must allow assessing the creditworthiness level of a potential borrower and provide the ability to integrate with the existing credit information exchange system, and must include the following:

questionnaire questions;

scoring procedure;

coefficients used (indicators confirming the reliability level of models, probable default indicators);

mathematical models.".

5. In paragraph 19:

the words "founder documents" in the third indent shall be replaced with the words "constituent documents";

the sixth indent shall be removed;

the seventh — ninth indents shall be considered the sixth — eighth indents, respectively.

6. In paragraph 23:

the second indent shall be stated in the following wording:

"when the documents specified in paragraph 19 of this Regulation necessary for state registration and licensing are not submitted;";

the sixth indent shall be removed;

the seventh indent shall be considered the sixth indent.

7. Paragraph 29 shall be stated in the following wording:

"29. The Central Bank must notify in writing within one business day from the day the decision is made about the adoption of a decision on state registration of the applicant and issuance of a license.".

8. Paragraph 30 shall be supplemented with a second indent of the following content:

"The license is issued in the form of an electronic document containing a QR code (matrix barcode) with a link to the relevant information resource address on the Internet global information network that allows online verification of its validity.".

9. The name of Chapter 5 shall be stated in the following wording:

"Chapter 5. Procedure for Suspension, Termination, Cancellation and Re-registration of the License".

10. Paragraph 33 shall be stated in the following wording:

"33. Suspension, termination, cancellation and re-registration of the license shall be carried out in the cases and procedure provided for by the Law of the Republic of Uzbekistan "On Licensing, Permitting and Notification Procedures".".

11. Paragraphs 34 — 36 shall be deemed invalid.
