On Amendments to Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic
In accordance with Articles 20 and 68 of the Law of the Kyrgyz Republic "On the National Bank of the Kyrgyz Republic, Banks and Banking Activity," the Board of the National Bank of the Kyrgyz Republic resolves:
"On Approval of the Regulation "On the Small Retail and Regular Payments Batch Clearing System in the Kyrgyz Republic" dated December 15, 2005 No. 37/8;
"On Approval of the Instruction "On the Procedure for Conducting Payments in the Small Retail and Regular Payments Batch Clearing System" dated August 22, 2007 No. 38/11;

Amendments to Certain Regulatory Legal Acts of the National Bank of the Kyrgyz Republic
in the Regulation "On the Small Retail and Regular Payments Batch Clearing System in the Kyrgyz Republic," approved by the aforementioned resolution:

"7.14. Final net positions are transmitted to the Gross Settlement System in real-time mode for final settlement and are processed in the system according to the 'all or nothing' principle.
7.15. The recipient forms a return payment after final settlement in the event of receiving an erroneous document and submits it to the system no later than the next clearing day. Return payments are transmitted by the recipient to the system as new payment documents, containing additionally all details identifying the erroneous payment document of the sender.";
"7.17. For the payer-client, a payment is irrevocable from the moment of receiving confirmation and/or a copy of the payment document with the sender's mark of acceptance for execution and debiting of their account, and final after conducting final settlement of net positions in the gross settlement system in real-time mode and debiting the correspondent/current account of the sender.
7.18. For the sender, payments are irrevocable after the settlement period for final net positions for them and final after conducting final settlement of net positions in the gross settlement system in real-time mode and debiting their correspondent/current account.";

"4. Acceptance and processing of primary payment documents by the sender
4.1. The sender accepts a paper payment document from the client in at least two copies. One copy of the paper payment document remains with the sender, the other copy is returned to the client with a mark of acceptance for execution.
4.2. In the case of payments under 'salary' projects, utility payments, and budget payments, the sender checks the correctness and completeness of filling out all fields of the primary payment document, including sub-account and account fields, in accordance with the Instruction on the Procedure for Filling Out Payment Documents, approved by the Resolution of the Board of the National Bank of the Kyrgyz Republic dated July 25, 2007 No. 36/5, registered in the Ministry of Justice of the Kyrgyz Republic on September 3, 2007, registration number 82-07, for full disclosure of payments in the SPK.
4.3. In the event that the exchange of payment documents between the client and the sender is carried out in electronic form, the sender confirms receipt of the payment document to the client in accordance with the terms of the agreement between the sender and the client, as well as in accordance with the internal regulatory documents and procedures of the sender.
4.4. In the event of finding errors in the payment document, the sender returns the payment document to the client indicating the reason for return in accordance with the internal regulatory documents and procedures of the sender.";
"5. Preparation by the sender of packages of EPD, messages, and transmission to the system
5.1. The sender prepares packages of EPD and messages in accordance with the Rules for filling out formats. In the case of utility, budget, and salary payments, the sender forms an EPD for each payer.
5.2. After preparing the package of EPD or messages, the sender signs it with the electronic signature of authorized users and transmits it to the system via communication channels.
5.3. The sender transmits packages of EPD to the system in accordance with the schedule of the current clearing day. The number of packages of EPD transmitted by the sender during this period is not limited.
5.4. In the event of the impossibility of forming packages of EPD and messages, the sender may contact the CC to carry out the input of information from primary payment documents and the formation of packages of EPD and messages using the Service Bureau. Services for the formation and transmission of packages are reflected in contractual relations between the CC and system participants.
5.5. In addition to the services of the Service Bureau, it is possible to transmit packages of EPD and messages to the system using the communication channels of one of the participants having a direct connection with the system. The interaction of the sender regarding the transmission of packages of EPD and messages through a participant having a direct connection with the system is reflected in the corresponding contractual relations between the CC and its participants.
5.6. The number of payments in packages of EPD transmitted to the CC must correspond to the number of primary payment documents (on paper, in electronic form), consisting of the number of payment documents accepted by the sender from clients and the number of the sender's own payments.";
"6. Procedure for processing packages of EPD and messages".
"6.1. Clearing Day Schedule
6.1.1. Processing of packages of EPD and messages is carried out in accordance with the clearing day schedule, which consists of one clearing session and is divided into the following periods:

In accordance with the Regulation on the SPK, it is permitted to conduct several clearing sessions during the clearing day. If it is necessary to change the clearing day schedule (number of clearing sessions and their periods), the corresponding Resolution of the Board of the National Bank is adopted.
6.1.2. A system participant is responsible for compliance with the work schedule in accordance with the regulatory legal acts of the National Bank.
6.1.3. Extension of the clearing day schedule is possible only upon application by the participant, with the submission of an official letter stating the reasons for the delay of the operational day periods, signed by the head of the participant. At the same time, the participant's clients (legal entities, individuals, budget organizations) resolve all arising issues with the participant serving them in accordance with the concluded agreements and cannot directly contact the CC. Responsibility and control for compliance with this requirement are placed on the participant.
6.1.4. In the event that a participant does not work on any working days or on weekends (holidays) declared working by the Cabinet of Ministers of the Kyrgyz Republic, the participant must provide a letter to the CC signed by the head of the participant in advance, 3-5 days in advance, with mandatory notification of all SPK participants, including the Unified Interbank Processing Center (hereinafter - UIPC). In this case, all payments from/to the participant, including card payments, are rejected by the system.";
"6.2.2. The system automatically sets the calculation values for participants.";

"6.3.1. The CC accepts packages of EPD and messages from senders, checks the packages for the correctness of the electronic signature and compliance with established formats. Based on the results of checking each package, the system forms a message about the acceptance of the package, which reflects the date, time of acceptance, and processing of the package. For each package, a message is sent about its status, indicating the amount and total number of payments accepted and rejected by the system. Messages are signed with the electronic signature of the system and sent to the address of the sender via communication channels.
6.3.2. The CC may accept packages of net positions from the UIPC. Based on the results of checking each package, the system forms a message about the acceptance of the package, which reflects the date, time of acceptance, and processing of the package. For each separate package, a message is sent about its status, indicating the amount. Messages are signed with the electronic signature of the system and sent to the address of the UIPC via established communication channels. At the same time, a message about the amount, time of acceptance, and processing of the package is sent to system participants whose net positions were transmitted by the UIPC. In the event of exceeding the current net debit position (hereinafter - CNP) of the participant over the established calculation limit/reserve, packages of net positions of all participants are accepted into the system with the status 'Inactive'.
6.3.3. In the event of the impossibility of authenticating the electronic signature of the package received from the sender, or the discovery of errors in the package or individual payment that do not allow them to be processed, a corresponding message is formed indicating the errors. The message is signed with the electronic signature of the system and sent to the address of the sender via the corresponding communication channels. After receiving a message about the non-acceptance of the package or payment, within the established schedule of the clearing session, the sender can create and send a corrected package with a new package and payment identifier.";
6.3.10. "6.3.10. The sender, in the event of finding errors, can annul (recall) a package or individual payment previously transmitted to the system. If the annulled payment was previously included in the calculation of the CNP, the sender forms a message to cancel the payment, the system assigns it the status 'Cancelled', recalculates the CNP of participants by excluding this payment, and transmits a message about the cancellation of the payment to the sender. If this payment was not previously included in the calculation of the CNP, i.e., had the status 'Inactive', the system assigns it the status 'Cancelled' and transmits a message about the cancellation of the payment to the sender.
6.3.11. The recipient, in the event of erroneously credited funds in credit operations, can return these funds to the sender. This operation is intended for the return of funds received by the participant with an erroneously specified client account, in the event of blocking or closing the client's account.
6.3.12. Information about the status of payments, net positions, and calculation limit is provided to each participant in real-time mode, as well as upon request throughout the entire period of acceptance and processing of packages of EPD and messages. The participant is obliged to monitor the information provided by the system and timely reserve a portion of funds in their correspondent account in the amount necessary for conducting.
6.3.13. At the end of the period of acceptance and processing of packages of EPD and messages, payment documents are not accepted into the system.";
"6.4. Period for acceptance and processing of refused payments
6.4.1. During the period for acceptance and processing of refused payments, acceptance of packages of EPD is not carried out.
6.4.2. At the beginning of this period, the CC forms preliminary outgoing payment packages for recipients. Outgoing packages contain payments included in the calculation of the CNP. Payment packages with the status 'Inactive' due to exceeding the calculation limit or reserve and payment packages with a future settlement date are not included in outgoing packages. Each outgoing package is signed with the electronic signature of the system and sent to recipients via communication channels.
6.4.3. After receiving the preliminary outgoing package, the recipient may, during this period, refuse to accept the payment in the event of incorrectness of its details and form a refused payment.
6.4.4. After receiving the refused payment, the CC transmits messages about its exclusion to the sender and recipient, as well as recalculates the CNP of participants taking into account the refused payment.
6.4.5. Reserves are established for participants in the system based on the message received from the GSRRT.
6.4.6. At the end of the period, acceptance of refused payments is not carried out.";

"6.5.1. During the pre-clearing period, the system does not accept packages of EPD and messages.";

"6.5.4. In the event that any participant exceeds the reserve, the system assigns the status 'Inactive' to payments included in the CNP of the participant, recalculates and checks the CNP of all participants for exceeding the final reserves, and transmits a corresponding notification to all involved participants. The participant, until the end of this period, takes measures to ensure the sufficiency of funds in the correspondent account in the GSRRT to cover the net debit position by obtaining an intraday credit, borrowing in financial markets, or replenishing the correspondent account by depositing cash.";
rephrase point 6.5.5 as follows:
"6.5.5. In the event of sufficient reserve, payment packages accepted by the system but not included in the calculation of the CNP (inactive packages) are automatically included in the calculation of the CNP.";

"6.6. Clearing Period
6.6.1. The system checks the CNP against the reserve and forms final net positions (hereinafter - FNP) of participants.
6.6.2. If the debit CNP of the participant exceeds the final reserve, the system assigns the status 'Inactive' to payments included in the CNP of the participant in accordance with priorities and on a FIFO basis, and recalculates the FNP.
6.6.3. Upon completion of the calculation of the FNP of participants, the system forms a message on the FNP, signs it with the electronic signature of the system, and transmits it to the GSRRT for final settlement.
6.6.4. Final settlement of the FNP of participants is carried out in the GSRRT according to the 'all or nothing' principle by debiting and crediting funds on the correspondent accounts of system participants opened in the National Bank. Since the FNP are calculated using funds reserved for settlement purposes in the correspondent accounts of participants, the case of non-execution of the FNP is exceptional.
6.6.5. The System forms final outgoing packages. All payments included in the Net Position Calculation (NPC), including those sent at the stage of receipt and processing of rejections, are included in the final packages. Each outgoing package is signed with the system's electronic signature and distributed to system participants.
6.6.6. In the event of multiple clearing sessions, payment packages not included in the NPC are transferred to the next clearing session.
6.7. Final Settlement Period
6.7.1. At the beginning of the period, the System transfers statements on the NPC to participants.
6.7.2. During the final settlement period, all packages with the status "Inactive" are rejected by the System. Notifications of excluded payment packages are formed and sent to the sender and recipient."
"6.8. Clearing Day Closing Period
6.8.1. The Clearing Center (CC) forms statistical reports of the System and archives data (packages of Electronic Payment Documents (EPD), messages, and operations for processing payments) received and sent during the clearing day.
6.8.2. The CC sends a message to participants about the closing of the clearing day."

"8.3. In case of violation of the integrity or structure of the received incoming package, the Recipient contacts the CC. The CC re-sends the outgoing package to the address of the Recipient. In case of impossibility of receiving incoming packages, the Recipient may apply to the Service Bureau to receive incoming packages from the System through the Service Bureau."
"8.5. If the exchange of payment documents between the Recipient and the client is carried out in electronic form, the Recipient, based on the received EPD package, forms and transmits an electronic message to the client-recipient in accordance with the conditions of the contract between the Recipient and the client, internal regulatory documents, and procedures.
8.6. The Recipient, having received an EPD package with any errors (crediting funds for the wrong purpose, blocking or absence of an account, etc.), must return the funds via a credit transfer no later than the next clearing day. In this case, the errors committed are indicated in the payment purpose field."

"The status and positions of a participant are established by authorized personnel of the CC based on instructions from management and/or resolutions of the Board of the National Bank or the Committee for Supervision of the National Bank on the introduction of special regimes: direct banking supervision, temporary administration, liquidation.
The following participant statuses are defined in the system: "Active", "Suspended", "Inactive (blocked or deleted)".
The status "Active" is established for a participant when no restrictions on conducting payments in the system have been introduced. With this status, the participant's payments, regardless of the payment purpose, are subject to full-function processing and inclusion in the net position calculation.
The status "Suspended" is established for a participant when restrictions on participation in the SBC (System of Batch Clearing) are introduced, but no restrictions are introduced in the GSRPV (General System of Retail Payment Processing). With the participant status "Suspended", payments are processed as follows:
With the participant status "Inactive (blocked or deleted)", all payments of the participant and payments to the participant are rejected by the System.
When introducing restrictions on participation in both the SBC and the GSRPV, restrictions on participant positions are established in the system. The position has one of the following states: active, blocked for debiting/crediting.
"Active Position" - is established in the absence of restrictions and means full-function processing of all EPDs, regardless of the payment purpose.
"Blocked Position" - is established when restrictions on outgoing/incoming payments of the participant are introduced. With this position, payments from/to the participant included in the Net Position Calculation (NPC), and payments received into the system after the blocking of positions, take the payment status "Suspended" and are processed as follows:
the System recalculates the NPC of participants;
new payments take the status "Suspended";
upon unblocking debit/credit positions, payments received into the system are included in the NPC calculation in accordance with paragraph 2 of Appendix 1;
if debit/credit positions are not unblocked before the clearing period, payments with the status "Suspended" are rejected by the System during the final settlement period with subsequent notification of the participant."
