On Amendments

to the Resolution of the Board of the National Bank of the Kyrgyz Republic

«On Establishing Requirements for Determining Subjects and the List of Offshore Zones» of 16 April 2003 No. 13/2

In accordance with Articles 5, 9 and 64 of the Constitutional Law of the Kyrgyz Republic «On the National Bank of the Kyrgyz Republic», the Board of the National Bank of the Kyrgyz Republic resolves:

• 1. To introduce the following amendments to the Resolution of the Board of the National Bank of the Kyrgyz Republic «On Establishing Requirements for Determining Subjects and the List of Offshore Zones» of 16 April 2003 No. 13/2:

  • to restate the preamble of the Resolution as follows:

«In order to ensure the security, reliability and stability of the banking system of the Kyrgyz Republic, protect the interests of depositors and other creditors of a commercial bank, ensure transparency of the ownership structure of banks on the basis of Articles 16 and 26 of the Law of the Kyrgyz Republic «On Banks and Banking Activity», prevent operations related to the financing of terrorist activities and the legalization (laundering) of criminal proceeds, the Board of the National Bank of the Kyrgyz Republic resolves:»;

• in the List of States and Territories Providing a Preferential Tax Regime and (or) Not Providing for Full Disclosure and Provision of Information to Banking Supervision Authorities (Offshore Zones), approved by the above-mentioned Resolution:

• item 11 shall be deemed to have lost force;

• item 20 shall be deemed to have lost force;

• item 28 shall be deemed to have lost force;

• item 42 shall be deemed to have lost force;

• to supplement with item 43 as follows:

«43. Curaçao».

• 2. This Resolution shall enter into force upon the expiration of fifteen days from the day of its official publication.

• 3. The Legal Department, after receiving the relevant documents, within 3 (three) working days:

  • to publish this Resolution on the official website of the National Bank of the Kyrgyz Republic;

  • after official publication, to send this Resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State Register of Normative Legal Acts of the Kyrgyz Republic.

• 4. The Licensing Department shall bring this Resolution to the attention of banks, OJSC «Financial Company of Credit Unions», ULE «Union of Banks of Kyrgyzstan», the State Development Bank of the Kyrgyz Republic and other legal entities supervised by the National Bank, within 3 (three) working days.

• 5. Control over the execution of this Resolution shall be assigned to the member of the Board of the National Bank of the Kyrgyz Republic supervising the supervision block.
