RESOLUTION

On Amending the Resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Rules for Making Money Transfers through Money Transfer Systems in the Kyrgyz Republic" of 15 July 2009 No. 30/6

In accordance with Articles 20 and 68 of the Law of the Kyrgyz Republic "On the National Bank of the Kyrgyz Republic, Banks and Banking Activities", the Board of the National Bank of the Kyrgyz Republic resolves:

1. To introduce amendments to the resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Rules for Making Money Transfers through Money Transfer Systems in the Kyrgyz Republic" of 15 July 2009 No. 30/6 (attached).

2. To the Legal Department:

• to publish this resolution on the official website of the National Bank of the Kyrgyz Republic;

• after official publication, to send this resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State Register of Normative Legal Acts of the Kyrgyz Republic.

3. This resolution enters into force on 19 April 2022 and remains in effect until the Board of the National Bank of the Kyrgyz Republic adopts a corresponding decision.

4. To the Payment Systems Department to bring this resolution to the attention of commercial banks and operators of money transfer systems.

5. To the Department for the Development of the State Language and Document Management to bring this resolution to the attention of the relevant structural subdivisions, regional departments and the representative office of the National Bank of the Kyrgyz Republic in Batken Oblast.

6. To assign control over the execution of this resolution to the member of the Board of the National Bank of the Kyrgyz Republic supervising the Payment Systems Department.

AMENDMENTS to the resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Rules for Making Money Transfers through Money Transfer Systems in the Kyrgyz Republic" of 15 July 2009 No. 30/6

To introduce the following amendments to the resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Rules for Making Money Transfers through Money Transfer Systems in the Kyrgyz Republic" of 15 July 2009 No. 30/6:

in the Rules for Making Money Transfers through Money Transfer Systems in the Kyrgyz Republic approved by the above-mentioned resolution:

• to restate the third paragraph of clause 1.2 as follows:

"A money transfer through an international money transfer system on the territory of the Kyrgyz Republic shall be provided to the recipient in the currency of the sender's country, other than the national currency of the Kyrgyz Republic - the som.

A money transfer through an international money transfer system may be recalled/cancelled from the territory of the Kyrgyz Republic only in the currency of the sender's country or in the national currency.";

• in the fifth paragraph of clause 2.3, to replace the words "in foreign currency" with the words "in the currency of the sender's country";

• to supplement the Rules with clause 3.9 as follows:

"3.9. A money transfer system operator shall be obliged to notify the National Bank in writing of any changes in the rules of operation of the systems within 1 (one) business day from the moment the changes occur.";

• to restate subparagraph 3 of clause 4.6 as follows:

"3) on the exchange rate of the currency of the transferred funds and possible restrictions, including currency restrictions, when sending/receiving funds;".
