On Amendments

to Certain Regulatory Legal Acts

of the National Bank of the Kyrgyz Republic

In accordance with Articles 5, 9 and 64 of the Constitutional Law of the Kyrgyz Republic "On the National Bank of the Kyrgyz Republic", the Board of the National Bank of the Kyrgyz Republic resolves:

1. To introduce amendments to the following resolutions of the Board of the National Bank of the Kyrgyz Republic (attached):

• "On Approval of the Regulation "On the Overnight Credit of the National Bank of the Kyrgyz Republic" of 28 March 2013 No. 10/7;

• "On Approval of the Regulation "On the 7-Day Credit of the National Bank of the Kyrgyz Republic" of 29 January 2014 No. 2/5.

2. To the Legal Department:

• from the day of receipt of the relevant documents, within 3 (three) working days, to publish this resolution on the official website of the National Bank of the Kyrgyz Republic;

• after official publication, to send this resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State Register of Regulatory Legal Acts of the Kyrgyz Republic.

3. This resolution enters into force upon the expiry of 7 (seven) working days from the day of official publication.

4. To the Monetary Operations Department, within 3 (three) working days, to bring this resolution to the attention of commercial banks and the Legal Entity Association "Union of Banks of Kyrgyzstan".

5. To the "Secretariat of the Board" Division, within 3 (three) working days, to bring this resolution to the attention of the Supervision Methodology Department, the Banking Supervision Department, the Accounting and Reporting Department, the Monetary Policy Department and the Legal Department of the National Bank of the Kyrgyz Republic.

6. To entrust control over the execution of this resolution to the member of the Board of the National Bank of the Kyrgyz Republic supervising the Monetary Operations Department.

Amendments to Certain Regulatory Legal Acts

of the National Bank of the Kyrgyz Republic

1. To introduce the following amendments to the resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On the Overnight Credit of the National Bank of the Kyrgyz Republic" of 28 March 2013 No. 10/7:

in the Regulation "On the Overnight Credit of the National Bank of the Kyrgyz Republic" approved by the above-mentioned resolution:

• 1) in paragraph 2, the words and figures "Articles 6 and 17" shall be replaced by the words and figures "Articles 6, 16 and 17";

• 2) the second sentence of paragraph 5 shall be set out in the following wording:

"The subject of the pledge shall be government securities of the Cabinet of Ministers of the Kyrgyz Republic, notes of the National Bank and securities of international financial organizations issued and placed on the territory of the Kyrgyz Republic, provided that the issuer has a long-term sovereign credit rating not lower than the highest (AAA) and the one following the highest (AA+), assigned by the rating agencies Moody's Investors Service (USA), Standard & Poors (USA), Fitch Ratings (United Kingdom) (hereinafter referred to as securities).";

• 3) paragraph 10 shall be supplemented with a sentence of the following content:

"For securities of international financial organizations, the Depository shall be CJSC "Central Depository".";

• 4) paragraph 17 shall be supplemented with a sentence of the following content:

"In the event that securities of international financial organizations serve as collateral, the Bank must, before 12-00 hours, submit an Application for an overnight credit through the ATS module "Interbank Lending.";

• 5) to supplement with paragraph 29-1 of the following content:

"29-1. The conditions and procedure for interaction on accepting securities of international financial organizations as collateral for an overnight credit shall be regulated by separate bilateral agreements between CJSC "Central Depository" and the National Bank of the Kyrgyz Republic and between CJSC "Central Depository" and the Bank.";

• 6) paragraph 35 shall be supplemented with a sentence of the following content:

"The release and transfer of securities of international financial organizations provided as collateral shall be carried out by CJSC "Central Depository".";

• 7) in Annex 1:

  • to supplement with paragraph 3.4. of the following content:

"3.4. The conditions and procedure for interaction on accepting securities of international financial organizations as collateral for an overnight credit shall be regulated by separate bilateral agreements between CJSC "Central Depository" and the National Bank of the Kyrgyz Republic and between CJSC "Central Depository" and the Bank.";

    - paragraph 4.2. shall be supplemented with a sentence of the following content:

"The release and transfer of securities of international financial organizations provided as collateral shall be carried out by CJSC "Central Depository".

2. To introduce the following amendments to the resolution of the Board of the National Bank of the Kyrgyz Republic "On Approval of the Regulation "On the 7-Day Credit of the National Bank of the Kyrgyz Republic" of 29 January 2014 No. 2/5:

in the Regulation "On the 7-Day Credit of the National Bank of the Kyrgyz Republic" approved by the above-mentioned resolution:

• 1) in paragraph 2, the words and figures "Articles 6 and 17" shall be replaced by the words and figures "Articles 6, 16 and 17";

• 2) paragraph 7 shall be supplemented with a sentence of the following content:

"For securities of international financial organizations, the Depository shall be CJSC "Central Depository".";

• 3) paragraph 29 shall be supplemented with a sentence of the following content:

"In the event that securities of international financial organizations are accepted as collateral, the transfer of securities shall be carried out by CJSC "Central Depository" in accordance with the general agreement between the National Bank and CJSC "Central Depository".";

• 4) paragraph 39 shall be supplemented with a sentence of the following content:

«In the event of acceptance of securities of international financial organizations as collateral, the transfer of securities shall be carried out by ZAO «Central Depository» in accordance with the general agreement between the National Bank and ZAO «Central Depository».»;

• 5) the fourth paragraph of paragraph 45, after the words «Depositories», shall be supplemented with the words «/ZAO «Central Depository»»;

• 6) shall be supplemented with paragraph 47-1 of the following content:

«47-1. The conditions and procedure for interaction on the acceptance of securities of international financial organizations as collateral security for a 7-day loan shall be regulated by separate bilateral agreements between ZAO «Central Depository» and the National Bank of the Kyrgyz Republic and between ZAO «Central Depository» and the Bank.»;

• 7) paragraph 52 shall be supplemented with a sentence of the following content:

«The release and transfer of securities of international financial organizations provided as collateral shall be carried out by ZAO «Central Depository».»;

• 8) in Appendix 1:

  • paragraph 2.6 shall be supplemented with a sentence of the following content:

«In the event of acceptance of securities of international financial organizations as collateral, the transfer of securities shall be carried out by ZAO «Central Depository» in accordance with the general agreement between the National Bank and ZAO «Central Depository».»;

    - the fourth paragraph of paragraph 3.3, after the word «Depositories», shall be supplemented with the words «/ZAO «Central Depository»»;

    - shall be supplemented with paragraph 3.4 of the following content:

«3.4. The conditions and procedure for interaction on the acceptance of securities of international financial organizations as collateral security for a 7-day loan shall be regulated by separate bilateral agreements between ZAO «Central Depository» and the National Bank of the Kyrgyz Republic and between ZAO «Central Depository» and the Bank.».

    - paragraph 4.3 shall be supplemented with a sentence of the following content:

«The release and transfer of securities of international financial organizations provided as collateral shall be carried out by ZAO «Central Depository.».».
