RESOLUTION

No. 6/1 of 1 February 2012

On the Interpretation (Clarification) of Clause 3.1 of the Regulation on Pre-Trial Settlement of Disputes between the National Bank of the Kyrgyz Republic and Commercial Banks, Organizations Conducting Certain Types of Banking Operations, and Their Founders (Participants), Legal Entities and Individuals, approved by Resolution of the Board of the National Bank of the Kyrgyz Republic No. 5/5 of 18 March 2005

In connection with applications from banks, organizations conducting certain types of banking operations, individuals and legal entities with statements appealing against decisions of the Deputy Chairman of the National Bank supervising the supervisory block and the Supervisory Committee of the National Bank of the Kyrgyz Republic, guided by Article 31 of the Law of the Kyrgyz Republic "On Normative Legal Acts of the Kyrgyz Republic", Articles 7 and 43 of the Law of the Kyrgyz Republic "On the National Bank of the Kyrgyz Republic", the Board of the National Bank of the Kyrgyz Republic

RESOLVES:

To approve the attached interpretation (clarification) of clause 3.1 of the Regulation on Pre-Trial Settlement of Disputes between the National Bank of the Kyrgyz Republic and Commercial Banks, Organizations Conducting Certain Types of Banking Operations, and Their Founders (Participants), Legal Entities and Individuals, approved by Resolution of the Board of the National Bank of the Kyrgyz Republic No. 5/5 of 18 March 2005 (reg. No. MJ KR 59-05 of 29.04.2005).
This resolution enters into force on the day of its publication and applies to public relations arising from the moment the interpreted provision entered into force.
The Legal Department shall, within 3 days:

publish this resolution on the official website of the National Bank;
after official publication, send this resolution to the Ministry of Justice of the Kyrgyz Republic for inclusion in the State Register of Normative Legal Acts of the Kyrgyz Republic.

The Supervision and Licensing Methodology Department of the National Bank of the Kyrgyz Republic shall bring this resolution to the attention of commercial banks.
Control over the execution of this resolution shall be assigned to Deputy Chairman Chokoev Z.L.

INTERPRETATION (CLARIFICATION) of clause 3.1 of the Regulation on Pre-Trial Settlement of Disputes between the National Bank of the Kyrgyz Republic and Commercial Banks, Organizations Conducting Certain Types of Banking Operations, and Their Founders (Participants), Legal Entities and Individuals, approved by Resolution of the Board of the National Bank of the Kyrgyz Republic No. 5/5 of 18 March 2005 (reg. No. MJ KR 59-05 of 29.04.2005)

Clause 3.1 of the Regulation on Pre-Trial Settlement of Disputes between the National Bank of the Kyrgyz Republic and Commercial Banks, Organizations Conducting Certain Types of Banking Operations, and Their Founders (Participants), Legal Entities and Individuals provides that the review procedure begins upon receipt of a written statement of appeal. The statement of appeal must be submitted within 20 working days after receipt of the decision of the Deputy Chairman of the National Bank supervising the supervisory block or the Supervisory Committee.

The meaning of the words "after receipt of the decision" shall be understood as "after receipt of proper notification". At the same time, notification is considered proper, among other cases, when the National Bank sends a registered letter with acknowledgment of receipt by mail to the address specified by the Appellant in the bank/other financial-credit institution.
