Article 1 Article 1
For the purposes of this Decree, the following terms shall be understood as:

For the purposes of this Decree, the regulation referred to in Article 2, § 3, 5° of the Law shall be understood as [the Royal Decree of 14 November 2003]. Art. 4 Art. 4 If insurance undertakings and institutions carry out insurance operations other than those relating to the retirement and survivor's pension for employees referred to in [the Royal Decree of 14 November 2003], they shall maintain separate accounting for these latter operations, unless they apply the same profit distribution method to these other operations. Art. 5 Art. 5
For the purposes of this Decree, Article 15bis, § 1, 3° of the Law shall be read as follows:

"reserves, whether statutory or free, and reserve funds that do not correspond to liabilities". "les réserves, légales ou libres, et les fonds de réserves ne correspondant pas aux engagements". Art. 6 Art. 6 For the purposes of this Decree, Article 92 of the Law, as amended by the Royal Decree of 12 August 1994, shall be read as follows:
Pour l'application du présent arrêté, l'article 92 de la loi, modifié par l'arrêté royal du 12 août 1994, doit se lire comme suit :
"Art. 92. Undertakings and institutions carrying out the operations referred to in Article 2, § 3, 5° of this Law at the time when the Royal Decree implementing this provision enters into force may continue their activity. "Art. 92. Les entreprises et organismes pratiquant les opérations visées à l'article 2, § 3, 5° de la présente loi, au moment de l'entrée en vigueur de l'arrêté royal portant exécution de ladite disposition, peuvent poursuivre cette activité. They must, within three months from the entry into force of the Decree referred to in the previous paragraph, submit the request referred to in Article 5 and establish the coverage values referred to in Article 16. Ils doivent dans les trois mois à compter de l'entrée en vigueur de l'arrêté visé à l'alinéa précédent, introduire la requête visée par l'article 5 et constituer les valeurs représentatives visées à l'article 16. Before the expiration of a period of six months starting from the end of the three-month period referred to in the previous paragraph, the King shall rule on the granting or refusal of authorization. Undertakings and institutions may continue their activity until then, unless they fail to submit their request for authorization or establish coverage values within the aforementioned three months. For the purposes of this Decree, Article 93 of the Law, as amended by the Royal Decrees of 9 June 1981 and 12 August 1994, shall be read as follows:
Pour l'application du présent arrêté, l'article 93 de la loi, modifié par les arrêtés royaux des 9 juin 1981 et 12 août 1994, doit se lire comme suit :
"Art. 93. Authorization may be granted to the undertakings or institutions referred to in Article 2, § 3, 5° of this Law, even if they do not comply with the obligations imposed by Article 15; to comply with the aforementioned obligations, they shall benefit from a two-year period, starting from the entry into force of the Decree implementing Article 2, § 3, 5° of this Law, on condition that they respect a financing plan approved by [the CBFA]." "Art. 93. Article 5 of the Royal Decree of 14 May 1969, as amended by the Royal Decree of 3 November 1975, is amended as follows:
L'article 5 de l'arrêté royal du 14 mai 1969, modifié par l'arrêté royal du 3 novembre 1975, est modifié comme suit :
1° in § 1, 2°, second paragraph, the words "the scale annexed to this Decree" are replaced by the words "the applicable technical bases which must be in conformity with the provisions of the regulation concerning life insurance activities, taken in implementation of the Law of 9 July 1975 concerning the control of insurance undertakings"; 1° au § 1er, 2°, alinéa 2, les mots "au barème
annexé au présent arrêté" sont remplacés par les
mots "aux bases techniques en vigueur qui devront être conformes aux dispositions de la réglementation relative à l'assurance sur la vie, prise en exécution de la loi du 9 juillet 1975 relative au contrôle des entreprises d'assurances"; 2° in § 2, second paragraph, the second sentence is deleted. 2° au § 2, alinéa 2, la deuxième phrase est supprimée. Article 9, § 1, second paragraph of the same Decree, as amended by the Royal Decree of 11 June 1987, is replaced by the following provision:

"In the event of early commencement of the old-age annuity in accordance with Article 7, second paragraph of this Decree, the application of the first paragraph may be made subject to the favorable outcome of a medical examination." Art. 11 Art. 11 In Article 10, § 2 of the same Decree, the words "the Minister" are replaced by the words "the [CBFA] established by the Law of 9 July 1975 concerning the control of insurance undertakings". Article 12 of the same Decree, as amended by the Royal Decree of 3 November 1975, is replaced by the following provision:

"Art. 12. § 1. Insurance institutions are required to use the same technical bases for the entirety of male insured persons and for the entirety of female insured persons. "Art. 12. § 1er. Les organismes d'assurances sont tenus d'utiliser des bases techniques identiques pour l'ensemble des assurés masculins et pour l'ensemble des assurés féminins. Death insurance may not contain excluded risks, except for suicide occurring less than one year after the entry into force of the contract. Les assurances en cas de décès ne peuvent contenir de risques exclus, à l'exception du suicide survenu moins d'un an après la prise d'effet du contrat.

§ 2. Unless the [CBFA] grants a derogation, the loadings may not exceed the following percentages:

a) regarding the establishment of the annuity and insurance provided for in Article 5, § 1, 1° and 2°:

• loadings for the payment of annuities: 1%;

  b) regarding the one-year temporary insurance referred to in Article 5, § 1, 3°:

• loadings: 0.0005 of the insured capital."

  Article 18 of the same Decree is replaced by the following provision:

The Royal Decree of 8 June 1931 establishing the general regulation applicable to the Law of 18 June 1930 concerning insurance against the financial consequences of old age and premature death of employees, is not applicable to the operations referred to by this Decree."   Article 22 of the same Decree, as amended by the Royal Decree of 26 October 1973, is amended as follows:
  L'article 22 du même arrêté, modifié par l'arrêté royal du 26 octobre 1973, est modifié comme suit :
  1° the first paragraph is supplemented with the following provision:
  1° l'alinéa 1er est complété par la disposition suivante :
  "When only a part of the distribution fund is paid out, the balance is carried forward for a later distribution."; "Si seulement une partie du fonds de répartition, a été distribuée, le solde est reporté pour une distribution ultérieure."; 2° the fifth paragraph is deleted. 2° l'alinéa 5 est supprimé.

Article 26 of the same Decree is supplemented with the following words:

"with the exception of the obligations arising from Articles 12, 21 and 22 and which are controlled by [the CBFA]". 1° the Royal Decree of 24 December 1930 establishing the organic regulation of the Higher Commission for old-age pensions, referred to in Articles 60 and following of the Law of 14 July 1930, as amended by the Royal Decree of 22 September 1931; 1° l'arrêté royal du 24 décembre 1930 formant règlement organique de la Commission supérieure des pensions de vieillesse, prévue par les articles 60 et suivants de la loi du 14 juillet 1930, modifié par l'arrêté royal du 22 septembre 1931; 2° the Royal Decree of 9 June 1931 taken in implementation of Article 26 of the Law of 18 June 1930 concerning insurance against the financial consequences of old age and premature death of employees, fixing the rates of annuities that must be guaranteed by authorized insurance institutions, as amended by the Royal Decree of 15 March 1939; 2° l'arrêté royal du 9 juin 1931 pris en exécution de l'article 26 de la loi du 18 juin 1930 relative à l'assurance en vue de la vieillesse et du décès prématuré des employés, fixant les tarifs des rentes que doivent garantir les établissements d'assurances agréés, modifié par l'arrêté royal du 15 mars 1939; 3° the Royal Decree of 10 June 1931 taken in implementation of Article 26 of the Law of 18 June 1930 concerning insurance against the financial consequences of old age and premature death of employees regarding the conditions for the admission of insurance institutions, provided for in Article 24 of that Law, as amended by the Royal Decree of 26 November 1931 and the Regent's Decree of 30 March 1948; 3° l'arrêté royal du 10 juin 1931 pris en exécution de l'article 26 de la loi du 18 juin 1930 relative à l'assurance en vue de la vieillesse et du décès prématuré des employés en ce qui concerne les conditions d'agréation des établissements d'assurances prévues à l'article 24 de cette loi, modifié par l'arrêté royal du 26 novembre 1931 et l'arrêté du Régent du 30 mars 1948;

4° the following provisions of the Royal Decree of 14 May 1969 concerning the granting of extra-legal benefits to employees referred to in Royal Decree No. 50 of 24 October 1967 concerning the retirement and survivor's pension for employees:

Art. 18 Art. 18 Our Minister responsible for Economic Affairs, Our Minister of Finance, Our Minister of Pensions and Our Minister of Social Affairs are each charged, within their respective competences, with the implementation of this Decree.
