S.B.S. Resolution No. 1771- 2020

The Superintendent of Banking, Insurance and Private Pension Fund Administrators

WHEREAS:

That, by SBS Resolution No. 4464-2016, the Regulation governing the services provided by the SBS to citizens and the handling of complaints against supervised companies was approved;

That, by SBS Resolution No. 1309-2019, several administrative procedures regulated in the provisions mentioned in the preceding recital were amended, by virtue of the Single Ordered Text of Law No. 27444, General Administrative Procedure Law, approved by Supreme Decree No. 004-2019-JUS;

That, by the Regulation governing the Certificate of deposits or other passive products of deceased persons approved by SBS Resolution No. 1188-2014 and its amending regulations, the handling of the request for information that heirs make, through this Superintendency, regarding the existence of deposits or other passive products in the name of their deceased relatives in financial companies was regulated, in accordance with Law No. 30152, Law on heirs informed in passive financial services;

That, the requirements related to accreditation as heir of the citizen requesting the certificate of deposit and other passive product of a deceased person must be subject to online validation of the registry publicity, as well as comply with the criteria of administrative simplification;

That, consequently, it is necessary to consider the aforementioned requirement in the regulations governing the attention to citizens by this Superintendency, for the issuance of the certificate of deposits or other passive products of deceased persons;

That, likewise, it is necessary to update the Single Text of Administrative Procedures of the Superintendency of Banking, Insurance and Private Pension Fund Administrators, approved by Resolution No. 1678-2018 with the aforementioned administrative procedures and services provided exclusively, in accordance with this Resolution and SBS Resolution No. 1309-2019 which amended SBS Resolution No. 4464-2016 which regulates the services provided to citizens and the processing of complaints against supervised companies;

With the approval of the Superintendencies
Attached of Legal Advice and Market Conduct and Financial Inclusion and the Management of Planning and Organization; and,

In use of the powers conferred in numerals 7 and 9 of article 349 of the General Law of the Financial System and the Insurance System and Organic of the Superintendency of Banking and Insurance, Law No. 26702 and its amending regulations and in use of the exception established in numeral 3.2 of article 14 of the Regulation approved by Supreme Decree No. 001-2009-JUS;

RESOLVES:

Article One.- To replace subsection f) of paragraph 12.2. of article 12 on Issuance of certificate of deposits or other passive products of deceased persons of the Regulation governing the services provided by the SBS to citizens and the handling of complaints against supervised companies approved by SBS Resolution No. 4464-2016 and amended by SBS Resolution No. 1309-2019, according to the following text:

"Article 12.- Issuance of certificate of deposits or other passive products of deceased persons

(…)

12.2. The requirements for the handling of this service are the following:

(…)

f) Number of the Electronic Entry or Record of the Registration of Intestate Succession in SUNARP, specifying the Registry Office, or simple copy of the registration of the Will in SUNARP; where the status of heir of the requesting citizen is accredited."

Article Two.- To amend literals f) and g) of numeral 1 of article 4 of the Regulation governing the Certificate of deposits or other passive products of deceased persons approved by SBS Resolution No. 1188-2014 and its amending regulations with the following text:.

"Article 4.- Procedure.

1. The heirs must request the certificate of deposits in the financial system from the Superintendency, attaching the following documentation:

(…)

f) Number of the Electronic Entry or Record of the Registration of Intestate Succession in SUNARP, specifying the Registry Office, or simple copy of the registration of the Will in SUNARP; where the status of heir of the requesting citizen is accredited.

g) Accreditation of representation: i) simple power of attorney letter, and ii) data of the representative: names and surnames; and, type and number of identity document.

Article Three.- To amend the following administrative procedure that is part of the TUPA of the Superintendency:

Article Five.- To incorporate into the TUPA of the Superintendency the following service provided exclusively:

Article Six.- The aforementioned administrative procedures and services provided exclusively are regulated in accordance with the texts attached to this Resolution, in the Single Text of Administrative Procedures of the Superintendency of Banking, Insurance and Private Pension Fund Administrators, approved by Resolution No. 1678-2018, and are published on the institutional portal (www.sbs.gob.pe), in accordance with the provisions of the Regulation of Law No. 29091, approved by Supreme Decree No. 004-2008-PCM.

Article Seven.- This Resolution enters into force on the day following its publication in the Official Gazette El Peruano.
