Securities account and the prohibition under Section 3:5 of the Wft

Securities accounts are prohibited from holding repayable funds under Section 3:5 of the Financial Supervision Act (Wft). De Nederlandsche Bank (DNB) does not grant dispensations from this prohibition, as confirmed by the Appeals Board for Trade and Industry. Advance payments and specific onward payments are not considered repayable funds provided they maintain a direct link to the underlying transaction.
