Rule · SIBOIF · 25 Jan 2011 · CD-SIBOIF-655-1-NOV24-2010
Financial institutions are prohibited from creating any encumbrance on deposits maintained in, or investments in securities issued by, other entities, except encumbrances for direct financing or contingent operations and those required by a depositary entity for confirming contingent operations where clients provide liquid collateral at least equal to the encumbered amount or a previously authorized loan supports it. For deposits with foreign financial entities not supervised by the Superintendency, depositing institutions must obtain the depositary's certification, sent directly to the Superintendent, that it was informed of and accepts the prohibition; if the depositary is a related party, its supervisory body must certify likewise. The standard replaces Articles 9 and 13 of Resolution No. CD-SIBOIF-650-2-OCT20-2010 and enters into force upon notification.
