The Superintendent of the Securities Market

HAVING SEEN:

CONSIDERING:

That, Article 1 of the Single Consolidated Text of Law No. 27806, Law on Transparency and Access to Public Information, approved by Supreme Decree No. 021-2019-JUS, (hereinafter, Transparency Law), provides that this norm aims to promote the transparency of State acts and regulate the fundamental right of access to information, enshrined in paragraph 5 of Article 2 of the Political Constitution of Peru;

That, in accordance with the principle of publicity regulated in Article 3 of the Transparency Law, all information held by the State is presumed public, except for the exceptions expressly provided for in Articles 15, 16 and 17 of the aforementioned law; likewise, the State must adopt basic measures that guarantee and promote transparency in the actions of entities of the Public Administration, having to deliver the information demanded by persons in application of the principle of publicity, for which public entities designate the official responsible for delivering the requested information;

That, Article 5 of the Transparency Law provides that entities of the public administration will progressively establish the dissemination via the internet of the information contained in said device, for which the public entity must identify the official responsible for the elaboration of the internet portals;

That, Article 8 of the Regulations of the Law on Transparency and Access to Public Information, approved by Supreme Decree No. 007-2024-JUS (hereinafter, Regulations), provides that the designation of the official responsible for attending requests for access to information and the official responsible for the implementation and updating of the Standard Transparency Portal, is carried out by resolution of the highest authority of the entity. This designation will be published in the Standard Transparency Portal of the entity and, optionally, in the Official Gazette El Peruano;

That, by Superintendent Resolution No. 091-2013-SMV/02, Miss Nery Salas Acosta was appointed as responsible for the Transparency Portal and its update, and responsible for the delivery of information, pursuant to the provisions of the Transparency Law;

That, because Miss Nery Salas Acosta has ceased to be a worker of this Superintendency of the Securities Market due to retirement, it is necessary to designate the new responsible person for the Transparency Portal and its update, as well as for the delivery of Information, pursuant to the provisions of the Transparency Law;

That, likewise, paragraphs 1.2 and 1.3 of Article 1 of the Regulations establish that entities may optionally designate substitute officials;

That, by Superintendent Resolution No. 088-2023-SMV/02, Mrs. Ada Isabel Noblecilla Castro was designated as substitute responsible;

That, likewise, by Superintendent Resolution No. 125-2024-SMV/02, Mr. José Omar Paz Eusebio was designated as substitute responsible in the event of absence of Mrs. Ada Isabel Noblecilla Castro;

That, finally, by Superintendent Resolution No. 105-2025-SMV/02, Mrs. Adriana Fabiola Paucar Flores was designated as substitute responsible in the event of absence of Mr. José Omar Paz Eusebio;

That, because Mrs. Ada Isabel Noblecilla Castro has also ceased to be a worker of this Superintendency of the Securities Market due to retirement, it corresponds to designate her replacement;

That, for the aforementioned reasons, in order to maintain uninterrupted the service of information delivery to the general public, and the constant update of the Standard Transparency Portal, it is also necessary to designate the civil servants who will assume the responsibility of substitutes for the Transparency Portal and its update, as well as for the delivery of information, pursuant to the provisions of the Transparency Law; and,

Being in accordance with the provisions of Article 2 of the Concorded Single Text of the Organic Law of the Superintendency of the Securities Market, approved by Legislative Decree No. 26126, Articles 3 and 5 of the Single Consolidated Text of Law No. 27806, Law on Transparency and Access to Public Information, approved by Supreme Decree No. 021-2019-JUS and Articles 1 and 8 of the Regulations of the Law on Transparency and Access to Public Information, approved by Supreme Decree No. 007-2024-JUS;

RESOLVES:

Article 1°.- To revoke the designations contained in Superintendent Resolution No. 091-2013-SMV/02, Superintendent Resolution No. 088-2023-SMV/02, Superintendent Resolution No. 125-2024-SMV/02, and Superintendent Resolution No. 105-2025-SMV/02.

Article 2°.- To designate Mr. José Omar Paz Eusebio as responsible for the Standard Transparency Portal and its update, as well as for the delivery of information, pursuant to the provisions of Law No. 27806, Law on Transparency and Access to Public Information.

Article 3°.- To designate Mr. Roberto Enrique Pereda Gálvez, as substitute responsible for the Standard Transparency Portal and its update, as well as for the delivery of Information, pursuant to the provisions of Law No. 27806, Law on Transparency and Access to Public Information, in the event of absence of Mr. José Omar Paz Eusebio.

Article 4°.- To designate Miss Shirley Joanna Martinez Rivera, as substitute responsible for the Transparency Portal and its update, as well as for the delivery of Information, pursuant to the provisions of Law No. 27806, Law on Transparency and Access to Public Information, in the event of absence of Mr. Roberto Enrique Pereda Gálvez.

Article 5°.- To designate Mrs. Adriana Fabiola Paucar Flores as substitute responsible for the Transparency Portal and its update, as well as for the delivery of Information, pursuant to the provisions of Law No. 27806, Law on Transparency and Access to Public Information, in the event of absence of Miss Shirley Joanna Martinez Rivera.

Article 6°.- This resolution enters into force from the day following its publication.
