The Superintendent of the Securities Market

HAVING SEEN:

File No. 2026012499 with Report No. 776-2026-SMV/08.2 from the Human Resources Unit, which has the approval of the Administration Office, regarding the coverage of a position of trust;

CONSIDERING:

That Law No. 30057, the Civil Service Law, aims to establish a unique and exclusive regime for persons who provide services in public entities of the State, as well as for those persons who are in charge of their management, the exercise of their powers, and the provision of services under their charge;

That Article 2 of Law No. 30057 establishes that civil servants of public entities are classified into the groups: Public Officials, Public Executives, Career Civil Servants, and Civil Servants in complementary activities, specifying that in any of these groups there may be positions of trust;

That, likewise, Article 79 of the aforementioned Law establishes that the link between positions of trust and the entity is established in a written contract of a temporary nature, whose validity is conditioned by the trust of the appointing authority; while their designation is carried out through the corresponding administrative act according to law or through the administrative act contemplated in the law, as the case may be, corresponding for the act to be published on the entity's website;

That, through Superintendent Resolution No. 016-2025-SMV/02, the section of positions of trust of the Direct Contracting Registry of the Superintendency of the Securities Market was approved, which is updated by Human Resources Resolution No. 003-2026-SMV/08.2, whose annex contains the Position CA40090 – Executive of the Logistics Unit;

That, the position of Executive of the Logistics Unit, position code CA40090, classified as Career Civil Servant in the Position Chart of the Entity of the Superintendency of the Securities Market, approved by Executive Presidency Resolution No. 133-2024-SERVIR-PE, is vacant, and the position is designated as a position of trust in the section of positions of trust of the Direct Contracting Registry of the Superintendency of the Securities Market;

That, through Report No. 776-2026-SMV/08.2, the Human Resources Unit informs regarding the proposal made with Memorandum No. 28-2026-SMV/02 of the Superintendent of the Securities Market, that Mr. Jorge Heraclio García Paz meets the profile for the position of trust of Executive of the Logistics Unit, according to the SMV Position Profiles Manual and that he has no impediments to exercise public function;

That, the proposal formulated with the document seen has budgetary availability according to SIAF Certification No. 276-2026 and the information in Memorandum No. 2326-2026-SMV/08.1 from the SMV Finance Unit;

That, in exercise of the prerogatives granted by the current regulations, the Executive of the Logistics Unit is appointed, who in the performance of his functions and responsibilities shall be subject to the Political Constitution of Peru and other legal regulations, Law No. 30057, Civil Service Law, its General Regulations and Compensation Regulations; their modifying, development and related norms; and,

In accordance with what is established in letter e) of Article 3, concorded with Article 79 of Law No. 30057 - Civil Service Law, as well as numeral 20 of Article 12 of the Organization and Functions Regulations of the SMV, approved by Supreme Decree No. 216-2011-EF and its amendments;

RESOLVES:

Article 1.- To designate, under the regime of Law 30057 – Civil Service Law, Mr. Jorge Heraclio García Paz, in the position of Executive of the Logistics Unit, position code CA40090, corresponding to the Position Family of Planning and Expenditure Management, with the classification of Civil Servant of Trust, whose permanence will be from June 8, 2026 and until the termination of the term is communicated by discretionary decision.

Article 2.- To order the publication of this Resolution on the institutional intranet and on the Institutional Page of the Superintendency of the Securities Market on the unique digital platform of the Peruvian State (https://www.gob.pe/smv).
