File N° 2026039642 and Memorandum N° 4224-2026-SMV/09, from the Information Technology Office, which supports the need to appoint the Artificial Intelligence Officer (AIO) of the Superintendency of Securities Market; CONSIDERING:
That, Legislative Decree N° 1412, Digital Government Law, establishes the digital government governance framework for the adequate management of digital identity, digital services, digital architecture, interoperability, digital security and data, as well as the legal regime applicable to the transversal use of digital technologies in the digitalization of processes and provision of digital services by Public Administration entities at all three levels of government; That, Article 4 of Law N° 31814, Law promoting the use of artificial intelligence for the economic and social development of the country, establishes that the Presidency of the Council of Ministers, through the Secretariat of Government and Digital Transformation, is the national technical-normative authority responsible for directing, evaluating, and supervising the use and promotion of the development of artificial intelligence and emerging technologies; That, Ministerial Resolution N° 152-2026-PCM approves the National Artificial Intelligence Strategy 2026-2030 (NAIS) and provides that public entities designate their Artificial Intelligence Officer (AIO) by act of their highest administrative authority, indicating that the role of AIO falls to a member of the Digital Government and Transformation Committee; That, the Superintendency of Securities Market (SMV) has a Digital Government and Transformation Committee constituted in accordance with digital government regulations, which leads, directs, evaluates, and supervises strategic digital transformation projects, including those involving the use of artificial intelligence; That, it is necessary to formally appoint the Artificial Intelligence Officer (AIO) of the SMV, in order to have an institutional responsible person to coordinate the governance and management of artificial intelligence, formulate the Artificial Intelligence Action Plan, and ensure articulation with the NAIS and current regulations; and, In accordance with the provisions of Law N° 31814, Law promoting the use of artificial intelligence and its Regulations approved by Supreme Decree N° 115-2025-PCM, Ministerial Resolution N° 152-2026-PCM, the Integrated Text of the Regulations of Organization and Functions of the Superintendency of Securities Market, and other applicable norms; RESOLVES:
Article 1.- Appointment of the Artificial Intelligence Officer (AIO)
Appoint Mr. Alejandro Julio Rabanal Sobrino, who serves as Deputy Superintendent of the Deputy Superintendency of Risks, as Artificial Intelligence Officer (AIO) of the Superintendency of Securities Market (SMV), in compliance with the provisions of Ministerial Resolution N° 152-2026-PCM.
Article 2.- Functions of the AIO
The Artificial Intelligence Officer (AIO) shall have, at a minimum, the following functions:
a) Coordinate the governance and management of artificial intelligence within the SMV. b) Formulate the entity's Artificial Intelligence Action Plan, in coordination with the Information Technology Office, the Planning, Management and Integrity Office, the Digital Security and Trust Officer, the Data Governance Officer, the Personal Data Officer, and other competent organic units. c) Supervise and evaluate that the models and algorithms used in high-risk artificial intelligence-based systems comply with the quality and ethical standards defined by sectoral regulations and those related to digital government, transformation, security, and trust. d) Monitor the implementation of the Artificial Intelligence Action Plan and report quarterly to the Digital Government and Transformation Committee. e) Record progress in the implementation of the Artificial Intelligence Action Plan on the Digital Compliance Platform, in accordance with current regulations.
Article 3.- Publication and Dissemination
Order the publication of this Resolution on the institutional portal of the SMV and its dissemination to the corresponding organic units for their knowledge and compliance.
