FIFTH CLAUSE TRANSFER OF THE CIAP AND THE CGS INFORMATION RECORD TO ANOTHER PENSION FUND ADMINISTRATOR The Affiliate may transfer their CIAP and the CGS information records to another Administrator upon meeting the following conditions:
a) That they have made at least twelve monthly contributions to the Origin Administrator, through their employer if it is a dependent worker, or directly in the case of independent workers; b) That the Administrator breached any of the clauses of this contract. In this case, the Affiliate must present their complaint in writing to the Superintendency, who will resolve in each case if the complaint proceeds and if the Affiliate is authorized to transfer to another Administrator for this cause; or c) That the Administrator enters a process of dissolution/liquidation or merger with another Administrator. Beneficiaries may only transfer when the pension is definitive, i.e., they cannot do so while receiving preliminary pensions.
SIXTH CLAUSE - COMPLAINTS
In case the Affiliate wishes to file a Complaint, they may do so with the Administrator or in the User Attention Office of the Superintendency of the Financial System; in both cases, the respective forms will be provided to them.
SEVENTH CLAUSE DOMICILE OF THE ADMINISTRATOR The Administrator designates as its special domicile the city of San Salvador, to the jurisdiction of whose courts it expressly submits.
EIGHTH CLAUSE TERMINATION OF THE CONTRACT
This contract may be terminated in any of the following cases:
a) When the Affiliate transfers the funds of their CIAP and the CGS information record to another Administrator. In this case, the contract with the Administrator will remain in force until the day prior inclusive to that on which the contract with the other Administrator enters into force; b) When the right to receive a pension ends for the last of the survivors' beneficiaries of the Affiliate and is claimed due to inheritance, or when they transfer to another AFP; c) When the Affiliate dies and the balance of their CIAP is granted as inheritance, according to the SP Law; and d) When the total balance of the CIAP is returned, for the cases established in the SP Law. In cases where, having the contract terminated, recoveries of overdue contributions or arrears corresponding to the validity of the contract are presented, these will be processed in accordance with the pertinent Standards.
NINTH CLAUSE GROUNDS TO RENDER THE CONTRACT VOID The transfer will be declared void by the Superintendency, upon proving that at least one of the grounds detailed in the pertinent Technical Standards has occurred. The cessation of the contract proceeds, without prejudice to other legal sanctions or fines that may be applied to those responsible, according to the respective Legislation. When proceeding at the request of a party, the affiliate or AFP will present to the Superintendency or to the Destination Administrator, a request to render the contract void in the respective form, within a period of one year counted from when the Origin Administrator has made the respective notifications of confirmation of the transfer. In case of the death of the affiliate, the transfer process is interrupted and automatically becomes void.
TENTH CLAUSE
The parties expressly submit to the provisions established in the Law on Supervision and Regulation of the Financial System, the Comprehensive Pension System Law, and the Technical Standards issued by the Central Bank through its Standards Committee and by their future modifications.
