Rule · BCR · 30 Dec 2022 · NSP-70
The Central Bank of Reserve of El Salvador establishes the requirements, procedures, and calculation methodologies for granting survivor pensions under the Public Pension System. The regulations define eligible beneficiaries, including spouses, cohabitants, children, and parents, and specify contribution time thresholds such as three years of contributions within five years or ten years of effective contributions. It mandates that the Salvadoran Institute of Pensions and the Salvadoran Institute of Social Security administer these benefits, while explicitly excluding coverage for deaths caused by professional risks.

CHAPTER II
GENERAL ASPECTS
Scope of Application
Art. 4.- It shall be the responsibility of the IVM Regime administered by the ISSS or ISP, or both, if applicable, for the survivor benefits referred to in these Standards, when generated in any of the following cases:
a) In the case of death of an active affiliate, provided that the origin of death is a common illness or accident; b) In the case of death of a pensioner due to common disability or disability due to professional risks; and c) By death of a pensioner due to old age, regardless of the cause or origin of death, will also generate the right to a survivor pension in the SPP. In all cases of letters a) and b) of this article, benefits will be granted provided that the deceased had met the contribution time requirements set forth in the SP Law and Article 8 of these Standards.
Art. 5.- The survivor benefits referred to in these Standards will not be applicable in the case of active affiliates of the ISSS or ISP, when they die due to illness or accident from professional risk.
Art. 6.- The Pension Institutes must consider the incompatibility between benefits granted by the ISSS Health Regime with those granted by the IVM Regime of the ISSS or ISP originating from the same risk. (1)
Art. 7.- To establish the origin of death of an active affiliate and determine the Disease, Maternity, and Professional Risks Regime or IVM Regime that will be responsible for paying the corresponding benefits, the information contained in the Death Certificate of the affiliate, the Medical-Legal Recognition Certificate, the Forensic Report, as applicable, will be used. If the analysis of the information results that the cause of death was a work accident or professional illness, it will correspond to the Disease, Maternity, and Professional Risks Regime of the ISSS to grant the corresponding survivor benefits.
CHAPTER III
ON THE REQUIREMENTS TO GENERATE SURVIVOR PENSION IN THE SPP
Requirements
Art. 8.- For an active affiliate or insured to generate the right to a survivor pension, the Pension Institutes must consider any of the following requirements:
a) Three years of contributions during the five years prior to the date of death; b) Being contributing at the time of death, in case of death by accident or common illness, or having contributed at least six months during the last twelve and the accident or illness having occurred after their affiliation; and c) Registering a minimum of ten years of effective contributions on the date of death.
On the applicability or not of the accumulation of periods to grant survivor pension Art. 9.- When the deceased had contributed, during their working life, to both Pension Institutes and the times registered in one of them are sufficient for the granting of survivor pension to the beneficiary family group, the accumulation of periods that the deceased registered in the other Pension Institute will not be used. This provision will give rise to two independent benefits, which may be any of the following combinations:
a) One pension in one Institute and an assignment in the other, and b) Two survivor pensions, considering the compatibility between them in the SPP.
In both cases, the beneficiaries of the deceased must request the respective benefits independently. In the case of the assignment referred to in letter a), the work history of the deceased must register at least twelve months of continuous or discontinuous contributions.
Art. 10.- Additionally to what is established in the previous article, if there are simultaneous contributions to both Pension Institutes, they will be counted independently.
When the independent times in each of the IVM Regimes of the ISSS and ISP are insufficient for an affiliate to generate survivor pensions, the periods contributed to the ISSS can be accumulated with the times contributed to the ISP and vice versa, thus completing the required contribution time requirement. In the case where there are periods in which the affiliate made simultaneous contributions to both Pension Institutes, these will be counted only once.
Art. 11.- In the case of voluntary contributors who die due to common risks, they will have the right to Survivor Benefits in the SPP provided they meet any of the contribution time requirements established in Article 8 of these Standards, as applicable. In case that on the date of their death, the voluntary contributor was without making contributions for up to a period of twelve months, they will generate the right to survivor pensions provided they prove in their Work History a minimum of five years of contributions, continuous or discontinuous, from their affiliation with the ISSS or ISP. In case of death due to professional risk of an affiliate, voluntary contributor, the IVM Regime administered by the ISSS or ISP, as applicable, will have no responsibility for the payment of benefits to the survivors. In any case, it will be the Disease, Maternity, and Professional Risks Regime of the ISSS that will grant the benefit to which they have the right provided the deceased has met the requirements established by said regime.
CHAPTER IV
ON THE BENEFICIARIES AND THE REQUIREMENTS THEY MUST MEET TO ACQUIRE THE RIGHT TO SURVIVOR PENSION
Beneficiaries
Art. 12.- In accordance with Article 111 of the SP Law, the following will have the right to survivor pension:
a) The children of the affiliate up to the age of 18 years; or up to 24 years if they are studying basic, secondary, technical, or higher education; or of any age if they have any disability as determined by the Disability Assessment Commission; b) The widow or widower; the cohabitant or cohabitant of non-marital union declared judicially in accordance with the provisions of the Family Code. Such declaration will not be required if there are common children, born or conceived, except when two or more persons present themselves claiming to be the cohabitant of the deceased affiliate; nevertheless, the Pension Institutes are authorized to verify if there was material cohabitation; and c) The parents of the deceased, if they were economically dependent on the affiliate; notwithstanding the above, if the parents have a disability condition before the date of death of the deceased, this requirement will not be required.
Requirements that beneficiaries of survivor pension must meet Art. 13.- To be able to access the survivor pension, the beneficiaries must meet the following:
a) For the Spouse or Cohabitant:
i. Have married the deceased;
ii. In the case of non-marital union, they must demonstrate their status as cohabitant in accordance with Article 118 of the Family Code, for which they must follow a trial in the corresponding instances, who will certify the cohabitation. This will not be required in cases where there are common children, whether born or conceived, without other requirements, except when two or more persons present themselves claiming to be the cohabitant of the deceased affiliate, notwithstanding, the Institute is authorized to verify if there was material cohabitation.
b) For the children:
i. Be under 18 years of age;
ii. Be a student of basic, secondary, technical, or higher education if their age is between 18 and 24 years.
iii. Be an invalid child, regardless of their age, for which they must undergo an opinion from the Disability Assessment Commission.
c) For the parents:
i. Be economically dependent on the deceased, provable by the Pension Institutes through the result of a socioeconomic study.
Notwithstanding the above, if the parents have a disability condition before the date of death of the deceased, the previous requirement will not be required and they must undergo the disability assessment process, so that the Disability Assessment Commission issues the corresponding opinion.
Probative documentation to access the right to a survivor benefit Art. 14.- The person(s) responsible for the management of survivor benefits must present the corresponding documentation regarding the identification, affiliation, and death of the deceased, as follows:
a) ISSS or ISP affiliation card, or both, if applicable; b) Unique Identity Document; c) Certification of the Death Certificate; d) In case of accidental death, the Medical-Legal Recognition Certificate will be required; issued by the competent authority and in cases of presumption of death by disappearance, what is established in the Civil Code and the Civil and Commercial Procedural Code will apply; e) Forensic Report, if applicable; f) Certification of the birth certificate, which must be issued no more than six months prior; and (3) g) When it concerns the death of a pensioner of the Health Regime, a copy of the documentation stating their status as a pensioner due to Professional Risks of the ISSS must also be presented.
CHAPTER V
ON THE APPLICATION FOR SURVIVOR BENEFITS
Art. 15.- When the beneficiary or beneficiaries, or their legal representative, present themselves to initiate the processing of the survivor benefit, the Pension Institute will verify in the Work History System the compliance with the contribution time requirements of the deceased, in accordance with Article 8 of these Standards. After verifying the compliance with the contribution time requirements of the deceased, the Pension Institute will inform the beneficiaries according to each case about the following:
a) That the deceased indeed accumulated the required contribution time, thereby generating the right to a survivor pension; b) That the deceased did not meet the required contribution times, but registered at least twelve months of contributions, so it is appropriate to grant a Survivor Assignment, whose calculation method is the same as that indicated for the case of old age assignment; or c) That the affiliate did not register the necessary contribution times to obtain pension or assignment by survivorship, so no benefit is granted. If the beneficiary, or their representative, disagrees with the contribution time registered by the deceased, they must file their claim with the Pension Institute, attaching the probative documents of said times and contributed salaries. If the deceased had accumulated the necessary time to generate a survivor benefit, it will not be an impediment to calculate the respective benefit that there are declared but unpaid contributions or contributions in arrears. In any case, it will be the option of the interested party, or their representative, whether the final calculation of the pension is carried out omitting said contributions in arrears or if said calculation remains suspended until the date when the contributions and contributions that should have been made on behalf of the deceased are recovered. The recovery of said contributions and contributions will be managed by the Pension Institute upon request of the interested party (or parties).

TECHNICAL STANDARDS FOR THE GRANTING OF SURVIVORSHIP BENEFITS IN THE PUBLIC PENSION SYSTEM Approval: 30/12/2022 Validity: 30/12/2022
In cases where periods with issues serve to complete the times required to obtain the right to a pension, this situation must be reported to the interested party(ies), in order to give them the option between a survivorship allowance or initiating the management to collect the delinquent periods. If they opt for the latter, the calculation of the pension will be suspended, restarting on the date when those contributions have been recovered. If, after completing the administrative or judicial collection actions, the recovery of the delinquent contributions has not been obtained, the possibility of granting a Survivorship Allowance must be determined.
Notwithstanding the foregoing, delinquent contributions attributable to the employer may be paid directly by the beneficiary(ies), provided that it is demonstrated that there was an employment relationship with the deceased; in such cases, the beneficiary(ies) will pay the necessary contributions at nominal value, to access the corresponding benefit in accordance with what is established in the SP Law, without prejudice to the sanctions that may be applied, and to the legal actions that may be brought against the employer. The payment of contributions may be made through the mechanisms established by the Pension Institutes.
Art. 16.- In any of the situations described in literals a) or b) of the previous article, the Pension Institute must grant the beneficiaries or their legal representative the Application for Pecuniary Survivorship Benefit, in accordance with Annex No. 1 of these Standards.
Such Application must be verified and signed by the beneficiary or their legal representative, as a sign of agreement.
In case that, within the entitled family group, there is a beneficiary who requires a disability qualification, the interested party or their legal representative must be given the respective Disability Qualification Application. The Application for Pecuniary Survivorship Benefit must be completed on a later date, only if the opinion issued by the Disability Qualifying Commission is favorable.
The Application(s) for Pecuniary Survivorship Benefit must be submitted attaching the probative documentation of the affiliation and death status of the affiliate, as well as the corresponding documentation for each of them. When there are several beneficiaries, it is sufficient for one of them to present such documentation corresponding to the deceased.
The Pension Institute must take into consideration that adult children will fill out an Application for Pecuniary Survivorship Benefit, for each one. Similarly, in the case where there are children entitled to a survivorship pension, belonging to different family groups, the interested party(ies) or their representative will fill out and sign the Application for Pecuniary Survivorship Benefit independently.
For cases of Applications for Pecuniary Survivorship Benefit, the date of commencement of the accrual of the survivorship pension will be established as the day following the death of the deceased; however, when it concerns a deceased considered to be an elderly person, the full month in which the death occurred must be paid, and the payment of the corresponding benefit will begin to accrate from the month following said death, in accordance with what is established in literal e) of article 18 of the Special Law for the Protection of the Rights of Elderly Persons. (2)
Art. 17.- When two or more persons who prove to have married the deceased (or the deceased) are presented before the Pension Institute, the determination of the person to whom the survivorship benefit will be granted will be carried out in accordance with the opinion issued by the Family Judge, or by the competent authority.
When two or more persons who prove, documentally, that they procreated children in common with the deceased, without having contracted marriage, but lived in a non-marital union, are presented before the Pension Institute, the determination of the person to whom the survivorship benefit will be granted will be carried out in accordance with the certification issued by the Family Judge, or by the competent authority.
From the Application for Pecuniary Survivorship Benefit
Art. 18.- The Pension Institutes will make available to beneficiaries, in their administrative, regional, and departmental offices, the form for the Application for Pecuniary Survivorship Benefit, considering that the dimensions of this form are at the discretion of each Pension Institute. However, the format of this form will be mandatory for Pension Institutes, in design and content in accordance with Annex No. 1 of these Standards.
The Pension Institute must keep the Application in original and deliver a copy, to the beneficiary or their representative, as applicable. The use of a form different from that established in these Standards will render the procedure void for which it was created. Likewise, it will not take effect when it includes information that does not correspond or omits part of it.
Documents accompanying the Application
Art. 19.- The quality of beneficiary of each of the members of the family group entitled to a survivorship benefit must be proven by presenting the documentation that establishes the family or parental link with the deceased affiliate or their marital relationship derived from their civil status of married or by the cohabitation situation recognized by the Family Code, attaching the following:
a) The widow or widower:
i. Certification of the marriage certificate;
ii. Pregnancy certificate signed and stamped by a medical professional, if necessary;
iii. Certification of the birth certificate of the children, when these are in common and minors; and
iv. Unique Identity Document (for Salvadoran persons); Passport or Residence Card (for foreign persons), valid and in good condition.
b) The cohabitant:
i. Certification of the judicial declaration of cohabitation;
ii. Pregnancy certificate signed and stamped by a medical professional, if necessary;
iii. Certification of the birth certificate of the children, when these are in common and minors; and
iv. Unique Identity Document (for Salvadoran persons); Passport or Residence Card (for foreign persons), valid and in good condition.
c) Children under 18 years of age:
i. Certification of the birth certificate; and
ii. Disability opinion, if necessary.
d) Children from 18 to 24 years of age:
i. Certification of the birth certificate;
ii. Disability opinion, if necessary;
iii. Unique Identity Document (for Salvadoran persons); Passport or Residence Card (for foreign persons), valid and in good condition; and
iv. Certificate that they carry out studies, whether basic, secondary, technical, or higher education, which must be duly signed and stamped by the competent authority in which such studies are carried out.
e) Parents:
i. Unique Identity Document (for Salvadoran persons); Passport or Residence Card (for foreign persons), valid and in good condition;
ii. Disability opinion; and
iii. Certification of the birth certificate of the deceased child.
In cases where a pension for ascendants should be granted and one of the parents has died by the date the benefit is managed (or if they die on a date subsequent to the date it is granted), the surviving beneficiary must present the certification of the death certificate of the deceased only in cases where the affiliate's file does not register such information.
In the case of Certifications of birth certificates, these must have an age no greater than six months with respect to the date of submission of the application. (3)
CHAPTER VI
ON THE METHOD OF CALCULATION OF SURVIVORSHIP PENSIONS
Art. 20.- Once the required information is complete and the right is established, the Pension Institute will determine the respective survivorship benefit.
To calculate survivorship pensions, it is necessary to establish the time the affiliate accredited in their Work History, which must be considered in exact years and fractions of a year. The responsible Pension Institute must obtain the number of days computed and then divide them by 365.25.
Pension of Active Affiliates
Art. 21.- The amount on which survivorship pensions generated by Active affiliates will be calculated will be determined as a percentage of the SBR according to what is established in article 101 of the SP Law and in accordance with what is established in the “Technical Standards on Components of Financing of Benefits, Regulator Basic Salary and Years of Contribution” (NSP-48), issued by the Central Bank through its Standards Committee, taking into account the following mathematical formula:
PRNP = SBR * 50% [Eq. 1]
Where:
PRNP: Reference pension amount for survivorship for an unpensioned affiliate.
SBR: Regulator Basic Salary.
In the case that the resulting calculation of reference pensions is lower than the value of the current minimum survivorship pensions, these must be adjusted to said minimum amounts. Subsequently, the respective percentages will be applied to this amount for each beneficiary, this in accordance with article 112 of the SP Law.
In any case, the sum of the pensions of each of the beneficiaries cannot be lower than the amount of the full old-age minimum pension. The adjustment to the minimum survivorship pension will consist of redistributing, proportionally, the difference between the sum of the pensions and the amount of the minimum pension, assigned to each beneficiary, until reaching 100% of said minimum pension.
Pension of Insured Persons
Art. 22.- The calculation base on which the respective percentages of survivorship pension will be determined, generated upon the death of a pensioned affiliate, will be the amount of the disability or old-age pension that the affiliate had been accruing the month prior to the month in which the death of the same occurred, taking into account the following mathematical formula: (1)
PRP = PD [Eq. 2]
Where:
PRP: Reference pension amount for survivorship for a pensioned affiliate.
PD: Amount of disability or old-age pension that the pensioned affiliate had been accruing the month prior to the month of their death.
Once said amount has been determined, it will be distributed among the number of beneficiaries applying the benefit percentage, as applicable, thus obtaining the pension amounts that correspond.
CHAPTER VII
PERCENTAGE DISTRIBUTION OF SURVIVORSHIP PENSIONS
Art. 23.- The survivorship benefit will be distributed according to the following percentages of the reference pension of the deceased affiliate:
a) 60% for the spouse or partner, when there are no children entitled to a pension; b) 50% for the spouse or partner, with children who have the right to a pension. This percentage will increase to 60% when such children cease to have the right to a pension; c) 25% for each of the children entitled to a pension; and d) 20% for the father and 20% for the mother, or 30% if only one of them exists.
When there is no spouse or partner entitled to a pension, the percentage established in literal b) will be distributed among the children entitled to a pension.
When there are no spouse, partner, or children entitled to a pension, the percentages established in literal d) will be 40% for the father and 40% for the mother, or 80% if only one exists with the right to a pension.
In no case will the sum of the reference pensions exceed 100% of the reference pension of the deceased affiliate; in case of exceeding said percentage, the weighting will be made based on the percentages established in this article.
Art. 24.- The Pension Institutes must create a registry of beneficiaries and keep it updated, in order to obtain month by month, the information of the beneficiaries of orphan pensions, who within the next three months will turn 18 years of age, date from which the granting of pension is subject to the proof of the student status.
The Pension Institute must inform beneficiaries on the payment dates of the last three pensions, about the expiration of their right to the payment of the pension and the opportunity to recover the continuity in the right to the same if they documentally prove that they are studying. Additionally, they must be informed about the date on which their right expires and that they have a period of thirty days, counted from such date, to present the required documentation.
In case of not presenting it in a timely manner, the temporary suspension of the pension will proceed.
General provision applicable to the appearance of new beneficiaries
Art. 25.- The ISSS or ISP will have no responsibility whatsoever for the total or partial payment of pensions or survivorship allowances, when subsequently other persons prove to have equal or better rights to them; in such a situation, the payment of the pensions already granted must be suspended, relevant recalculation must be performed, and the benefits corresponding to the corrected amounts must be granted.
The modification in the amount of the pensions will not give rise to refunds to the new beneficiaries, leaving intact the right to initiate the corresponding judicial actions. The respective Pension Institute will adopt the corresponding resolutions, which must be transcribed to the Superintendency, after three business days from having been notified to the interested parties.
CHAPTER VIII
REQUIREMENTS TO MAINTAIN CONTINUITY IN THE RIGHT TO SURVIVORSHIP PENSION IN THE SPP
Art. 26.- To maintain the continuity of the right to survivorship pension, beneficiaries must comply with the following:
a) For children under 18 years of age:
i. Verify their survival every six months, by the means that the respective Institute establishes through the regulation for such purposes established by the Central Bank through its Standards Committee; and
ii. Present the Residence Certification, if it is the case of children under 18 years of age who reside abroad. Such certification must be presented during the first month of each year.
b) For children between 18 and 24 years of age:
i. Prove that they carry out studies, whether basic, secondary, technical, or higher education, with the presentation of a certificate issued by the competent authority in which such studies are carried out, during the first month of each cycle or academic year, which must be duly signed and stamped by said authority; and
ii. During the duration of the cycle being studied, the grade report or its equivalent corresponding to the previous cycle must be presented to establish the continuity in their quality as a student. If the presentation of said report is omitted, they will not have the right to the pension payments corresponding to the current cycle nor to those corresponding to the next cycle, even if they present the documentation that proves their enrollment. The Pension Institute must initiate the collection actions for the pensions paid unduly, or in its case, deduct them from future payments.
The continuity in the right to survivorship pension is independent of the approval of the subjects enrolled, by the beneficiary.
When the beneficiary does not present during the first month of each cycle or academic year the probative documentation of their quality as a student, the payment of the pension will be temporarily suspended, for an additional period of six months, and will be resumed, with retroactive effects in what corresponds, when they meet the aforementioned condition. c) For the widow, widower, partner or cohabitant:
i. Prove their survival every six months, by the means that the respective Institute establishes through the regulation for such purposes established by the Central Bank through its Standards Committee.
Art. 27.- Notwithstanding what is provided in the previous article, for child beneficiaries between 18 and 24 years of age, they may recover the right to survivorship pension when they have been temporarily unable to carry out studies due to illness or having suffered an incapacity. In these cases, the following procedure will be followed:
a) If it is a beneficiary who at the same time as studying, exercised a remunerated activity for which they had the right to the benefits of the Health Regime, they must present the Disability Certificate issued by the ISSS Regime for Illness, Maternity and Occupational Risks. In this case, the date on which the right to survivorship pension will be recovered will be the date on which they resume their studies, provided that on the date they cease to receive the disability subsidy they have not yet turned twenty-four years old. b) If it is a beneficiary who did not exercise a remunerated activity at the date they suffered the illness or incapacity, or did not have coverage of the benefits of the ISSS Health Regime, they must initiate the disability qualification process with the Disability Qualifying Commission, in order to establish the date from which the beneficiary may resume studies, if the illness or incapacity is temporary. In any case, the result of the opinion may also establish whether the right to survivorship pension is lifelong, when the illness or incapacity has caused in the beneficiary a loss in physical or intellectual capacity equal to or greater than 50%.
If the Disability Qualifying Commission has established that the illness or incapacity is temporary, the date on which the right to the pension will be resumed will be the date on which they resume their studies, provided that they have not yet turned twenty-four years old.
In both cases, the temporary suspension of the pension will be applied, even if the right to it is recovered on a subsequent date.
CHAPTER IX
LOSS OF RIGHT AND RECALCULATIONS OF SURVIVORSHIP PENSIONS
Loss of Right to Survivorship Pensions
Art. 28.- The right to pensions is lost for any of the following causes:
a) For children:
i. Death;
ii. Reaching the age of 18 years and not documentally proving their quality as a student;
iii. Being between 18 and 24 years of age and not documentally proving the quality of student in accordance with the conditions established in these Standards; or
iv. Cessation of the state of Disability in the case of children over 24 years of age. The right will be lost if, through inspection, the Pension Institute verifies such condition.
b) For the widow, widower, partner or cohabitant:
i. Death.
c) For parents, the right to pensions is lost by the death of the beneficiary.

TECHNICAL STANDARDS FOR THE GRANTING OF SURVIVOR BENEFITS IN THE PUBLIC PENSION SYSTEM Approval: 30/12/2022 Validity: 30/12/2022
If the deceased registered at least twelve months of contributions, whether continuous or discontinuous, in the ISSS or ISP, or in both, their beneficiaries will be entitled to receive a "Survivor Allowance," which will consist of a single payment, equivalent to 10% of the SBR for each month contributed.
In the event that due to the number of eligible survivors the 100% of the allowance is not distributed and a remainder remains, this will be retained by the corresponding Pension Institution for a period of two years, counted from the date of death of the deceased. If during said period no other eligible beneficiaries present themselves, the 100% of said remainder will be distributed among the number of beneficiaries existing on the date the deadline expires.
In the case of Survivor Allowance for the father and mother of the deceased, the retention of the allowance remainder will not proceed, but the 100% will be distributed. However, if only one ascendant has presented themselves, the remainder must be retained and delivered to the sole parent, after the two-year term has expired.
Art. 32.- The corresponding Pension Institute must consult the beneficiary on the form of disbursement of the benefit, which will be specified by the beneficiary. The disbursement must be made by credit to an account in the name of the beneficiary, as appropriate, by deposit into a checking or savings account, in any financial institution authorized to capture public deposits subject to regulation and supervision in accordance with the Law on Supervision and Regulation of the Financial System, indicated by the beneficiary; in exceptional cases, payment may be made by non-negotiable check or other payment mechanisms authorized for the financial institution.

This procedure will also apply in cases where the beneficiary is a minor and the legal representative or tutor is in the conditions mentioned above, for which the latter must demonstrate being unable to take the minor to the Pension Institute. The Pension Institutions must leave a written record of the procedure carried out. (1)
