Update on Regulatory Policy Proposals from the Third-party Cell Captive Insurance and Similar Arrangements Discussion Paper, 2013

Insurers must be accountable for each cell structure’s financial soundness, assess cell owners’ fitness, propriety and creditworthiness, and enter written cell agreements. Third-party cell captive arrangements may only be with a binder holder that is an underwriting manager or non-mandated intermediary under an approved affinity scheme; first-party and third-party risks may not share a cell, and similar arrangements must convert to a dedicated licence. Minimum capital is R1 million, or R250 000 for micro cell captives. Non-compliant insurers must engage the PA within 60 days of 1 July 2018.
