Virtual Assets Act, 2025
The Virtual Assets Act, 2025 establishes the Non-Bank Financial Institutions Regulatory Authority as the regulator for virtual asset businesses and issuers of initial token offerings in Botswana. It prohibits unlicensed activities and mandates that licence holders maintain a physical office in Botswana, adhere to minimum capital requirements, and protect customer assets. The Act grants the Regulatory Authority powers to license entities, request information, appoint inspectors, and enforce compliance through suspensions, revocations, and administrative sanctions.
