Voluntary Pension System Rules, 2005

These rules require a company to register with the Commission before commencing business as a Pension Fund Manager; applicants must be a life insurance company or asset management company, financially solvent, and meet fit-and-proper criteria, with a non-refundable processing fee of fifty thousand rupees. Registration is liable to cancellation if pension business does not commence within six months. Pension Fund Managers must manage pension fund assets in participants' interest, account to the trustee for losses caused by gross negligence or willful acts, maintain records, and transmit annual reports within four months of the accounting period's close and quarterly accounts within one and two months. The Commission may cancel or suspend registration, remove the manager, issue cease and desist orders, order compensation, ban defaulters, or impose fines after offering a hearing.
