Agreement No. 5-2026: Amending Article 17 of Agreement No. 1-2015 on Capital Adequacy Rules for Banks and Banking Groups

Article 17 of Agreement No. 1-2015 is amended to define the exposure of derivatives as Counterparty Risk Exposure (CRE) for the calculation of the leverage ratio. The leverage ratio, calculated as the ratio between ordinary primary capital and total unweighted exposure, must not fall below 3% at any time. Regulated entities are required to report compliance with this ratio to the Superintendency of Banks at the frequency determined by the regulator. These provisions enter into force upon promulgation on June 23, 2026.
