Advisory for Financial Sector Organizations regarding Software as a Service (SaaS) based solutions

Financial sector organizations, including stock brokers, depository participants, merchant bankers, and other intermediaries, are advised to ensure critical data remains within India's legal boundaries when using Software as a Service (SaaS) solutions for Governance, Risk & Compliance (GRC) functions. These entities must maintain complete protection and seamless control over critical systems through direct supervision while keeping data within India. Stock brokers and depository participants must report compliance in their half-yearly reports to exchanges and depositories, while direct intermediaries must report directly to SEBI with a specific undertaking. The advisory, forwarded by the Ministry of Electronics & Information Technology and the Indian Computer Emergency Response Team, is effective with immediate effect.
