Amendments to Latvijas Banka Regulations No. 319 of September 30, 2024 "Rules on the Preparation and Submission of Statistical Data and Supervisory Reports for Private Pension Funds" /No. 417/

Issued in accordance with Article 26, paragraph 11, Article 31, paragraph 3, Article 36, paragraph 9, and Article 40, paragraph 11 of the Private Pension Funds Law, and Article 63, paragraph 2 and Article 68, paragraph 3 of the Latvijas Banka Law

1. Make the following amendments to Latvijas Banka Regulations No. 319 of September 30, 2024 "Rules on the Preparation and Submission of Statistical Data and Supervisory Reports for Private Pension Funds" (Latvijas Vēstnesis, 2024, No. 192):

1.1. rephrase the title of the regulations as follows:

"Rules on the Preparation and Submission of Statistical Data and Supervisory Reports for Private Pension Funds and PEPP Providers";

1.2. rephrase the reference to the legal basis for issuing the regulations as follows:

"Issued in accordance with Article 26, paragraph 11, Article 31, paragraph 3, Article 36, paragraph 9, and Article 40, paragraph 11 of the Private Pension Funds Law, and Article 63, paragraph 2 and Article 68, paragraph 3 of the Latvijas Banka Law";

1.3. supplement the regulations with point 1.1.1 in the following wording:

"1.1.1 the procedure by which a PEPP provider or an open pension fund provides information to Latvijas Banka regarding the results of the operation of its registered pension plan or PEPP plan, as well as the content of the information provided;";

1.4. supplement the regulations with point 5.1 in the following wording:

"5.1 An open pension fund or PEPP provider prepares a 'Report on the Results of the Operation of a Pension Plan or PEPP Plan' (Appendix 12.1).";

1.5. supplement the regulations with point 8.1 in the following wording:

"8.1 An open pension fund or PEPP provider prepares the report mentioned in point 5.1 of these regulations regarding the results of operations for each working day and submits it to Latvijas Banka by 17:00 on the working day following the reporting working day.";

1.6. supplement point 10 after the words "pension fund" with the words "or PEPP provider";

1.7. supplement point 11 after the words "pension fund" with the words "or PEPP provider";

1.8. supplement point 12.2 with the words and number "except for the case mentioned in point 26.1.2 of these regulations";

1.9. supplement the regulations with Chapter VII.1 in the following wording:

"VII.1

"Procedure for Submitting the 'Report on the Results of the Operation of a Pension Plan or PEPP Plan'"

26.1 The 'Report on the Results of the Operation of a Pension Plan or PEPP Plan' is prepared taking into account the following requirements:

26.1.1 In position "Plan Code", the code assigned by Latvijas Banka at the time of registration of the pension plan or PEPP plan is indicated;

26.1.2 In position "Number of Plan Shares", a value up to four decimal places is indicated; in position "Plan Net Assets", sums in euros are indicated up to two decimal places; in position "Plan Share Value (euro)", sums in euros are indicated up to four decimal places;

26.1.3 The position "Plan Share Value (euro)" is calculated by dividing the value indicated in position "Plan Net Assets (euro)" by the number indicated in position "Number of Plan Shares".

26.2 If inaccuracies are identified in the submitted report, the preparer of the report must immediately inform Latvijas Banka by sending a message to the email address manapensija@bank.lv. The corrected report must be submitted to Latvijas Banka immediately in the manner specified in point 10 of these regulations.";

1.10. supplement the regulations with Appendix 12.1 in the following wording:

"Appendix 12.1 to Latvijas Banka Regulations No. 319 of September 30, 2024
