Amendments to the Regulations of the Bank of Latvia No. 332 of 28 October 2024 "Rules for Preparing the Annual Report of Credit Unions" /No. 412/
Issued in accordance with the first part of Article 23 of the Credit Union Law
Make the following amendments to the Regulations of the Bank of Latvia No. 332 of 28 October 2024 "Rules for Preparing the Annual Report of Credit Unions" (Latvijas Vēstnesis, 2024, No. 212):
Replace the word "loan" (in the corresponding number and case) in the text of the regulations with the word "credit" (in the corresponding number and case).
Express point 9.5 in the following wording:
"9.5. information on the number of existing members in accordance with the data of the member register and the number and nominal value of shares owned by them, as well as the number and nominal value of shares whose owners have withdrawn or been excluded from the credit union or have alienated them to the credit union during the reporting year;".
"9.9. information on the provision of lending services to persons mentioned in points 2 and 3 of the fifth part of Article 5 of the Credit Union Law."
"10. A credit union whose assets in the reporting year do not exceed the amount specified in the second part of Article 23 of the Credit Union Law may not provide the information mentioned in sub-point 9.2.2 of these regulations."
"If the amount of claims against credit unions in the item "Other assets" is material, these claims are shown in a separate sub-item."
"If the amount of liabilities to credit unions in the item "Other liabilities" is material, these liabilities are shown in a separate sub-item."
Strike out the words "belonging to members" in the introductory part of point 30.
Replace the words "total nominal value of shares" in sub-point 30.1 with the words and numbers "share capital in accordance with the provisions of the first and fifth parts of Article 15 of the Credit Union Law".
Replace the words "from the profit of the reporting year and previous years, entrance fees" in sub-point 30.2 with the words and numbers "in accordance with the provisions of Article 16 of the Credit Union Law".
Express the second sentence of point 82 in the following wording:
"In the notes to the financial statements, disclose the types, nature and amount of transactions that the credit union has entered into with persons mentioned in the tenth part of Article 20 of the Credit Union Law."
Replace the word "liabilities" in sub-point 83.1 with the words "transactions included in items".
Supplement the regulations with points 86.1 and 86.2 in the following wording:
"86.1 In the notes to the financial statements, provide information on the total amount of paid-up share capital, including separately showing the total amount of the credit union's share capital financed from borrowed funds (if applicable).
86.2 If a credit union provides lending services to persons mentioned in points 2 and 3 of the fifth part of Article 5 of the Credit Union Law, it provides information in the notes to the financial statements on the amount of equity calculated in accordance with the second part of Article 14 of the Credit Union Law."
