CSSF Regulation No 15-05 Exempting SME Investment Firms from Capital Buffers

The regulation exempts investment firms qualifying as small and medium-sized enterprises from the requirements to maintain a capital conservation buffer and a countercyclical capital buffer. An investment firm qualifies as small and medium-sized if it employs fewer than 250 persons and has an annual total income not exceeding EUR 50 million or an annual balance sheet total not exceeding EUR 43 million. The exemption applies provided that the balance sheet total of these firms is below 0.02% of the banks' balance sheet total and does not threaten the stability of the national financial system. This regulation enters into force on 1 January 2016.
