INFORMATION NOTE
Regulation Matters – Amends BCB Instruction No. 385 of May 30, 2023.
BCB Resolution No. 54 of December 16, 2020, establishes that the Pillar 3 Report must be disclosed by institutions on their websites and also in an open data format, to allow capture and use by technological systems. The Central Bank of Brazil is responsible for making available the layout of the tables for disclosure on the website, as well as the catalog with the parametrization (API) of the data for availability in the open data format.
In 2023, there was a significant update to the tables of the Pillar 3 Report, both due to normative alignment with the new recommendations of the Basel Committee on Banking Supervision and the consolidation of others, so that the catalog with the parametrization valid until the reporting date of June 30, 2023, became obsolete. This required the development of a new catalog that, due to restrictions faced by the Central Bank of Brazil, experienced a delay in its completion. Thus, Instruction No. 425 of November 29, 2023, temporarily suspended the mandatory disclosure of information in open data format.
With the completion of the elaboration of the new catalog, it is necessary to revoke the suspension and specify the reference reporting date for the resumption of disclosure in the open data format. I recall that in the act of suspension, it was informed that this was a temporary measure and that, upon the return of the obligation, disclosure in open data relative to the suspension period would be necessary. However, during this period, the Pillar 3 Report underwent three important changes, so that the reconstruction of the information would imply the creation of catalogs for each of them, which proves to be an impractical measure due to its scarce utility. Thus, no deadline will be established for the reconstruction, in open data format, of the Pillar 3 Reports disclosed by institutions during the suspension period.
Additionally, on this occasion, the layout of table OR2 – Composition of the Business Indicator (BI) was altered, and specific corrections were made to the definitions of the components of tables OR1 and OR2.
Finally, I highlight that art. 4º, item II, of Decree No. 10,411 of June 30, 2020, which establishes the need for Regulatory Impact Analysis (AIR) in the issuance of normative acts by bodies and entities of the direct, autarchic, and foundational federal public administration, exempts the hypothesis of AIR for normative acts intended to regulate rights or obligations defined in a hierarchically superior norm that does not allow, technically or legally, different regulatory alternatives. Thus, considering that the obligation to disclose information has already been regulated by BCB Resolution No. 54 of 2020, the performance of AIR relative to the regulation of the normative instruction now issued was dispensed with.
