Capital Markets and Securities (Amendments) Act, 2010

The Capital Markets Authority has enacted the 2010 Amendments to significantly expand regulatory oversight and modernize the Capital Markets and Securities Act. The legislation redefines key market participants, substantially increases financial penalties and imprisonment terms for securities offenses, and transfers appellate jurisdiction from the Minister and High Court to the Capital Markets Tribunal. It further mandates stricter licensing for market intermediaries, establishes prospectus approval procedures for securities issuances including the Enterprise Growth Market, and grants the Authority comprehensive powers to supervise market conduct and protect investor interests.
