Subject: Compliance of Luxembourg establishments with ECB Regulation 2013/43 – Payment Statistics – and invitation to a working group
Dear Director,
The Governing Council of the European Central Bank (ECB) adopted ECB Regulation 2013/43 on payment statistics. It will be applicable from June 2015.
The BCL's obligation to provide the ECB with statistics in the field of payments stemmed from an ECB Guideline (ECB/2007/9). To this end, the BCL had published Regulation BCL/2011/9. In the context of a review of this collection, the ECB published a regulation (ECB 2013/43) at the end of 2013, which will be applicable from June 2015, as well as a guideline, published in April 2014 (ECB/2014/15), which constitutes a recasting of Guideline ECB/2007/9.
The BCL wishes to maintain the single framework for the collection of payment-related data, namely the direct collection of payment data (CDDP) introduced by Regulation BCL/2011/9.
ECB Regulation 2013/43 applies to all financial institutions active in the field of payments, that is to say, credit institutions, payment institutions, electronic money institutions, as well as technical agents and market infrastructures acting in the field of payments.

In order to comply with the aforementioned regulation, reporting agents will have to transmit the data required by the following existing BCL statistical collections:
Regarding point 1), it should be noted that the current version of the CDDP covers the vast majority of the statistics required by ECB Regulation 2013/43. A forthcoming update of the CDDP will cover the entirety of the statistical requirements of this ECB regulation. In the meantime, until complete information is available, the BCL will perform estimates based on ad hoc collections.
Furthermore, we inform you of the creation of a working group dedicated to the compliance of the CDDP with ECB Regulation 2013/43 and ECB Guideline 2014/15. This working group is created jointly by the BCL and the ABBL; membership in the ABBL is, however, not required.
All institutions are invited to participate in this working group, the first meeting of which will take place in February 2015. We ask interested institutions to communicate the name and e-mail address of the persons who will represent their institution, either to the Payment Infrastructures and Systems Section of the BCL (market_infrastructures@bcl.lu) or to Mr. Jean-Pierre Borsa of the ABBL (borsa@abbl.lu). Please also note that a draft of the future payment statistics requirements is available on our website:
