The deadline for foreign institutional investors to re-register under Resolution CMN No. 2,689/2000 is extended to September 30, 2000. Investors failing to complete this re-registration will have their operational codes blocked starting October 1, 2000, preventing them from conducting operations in Brazilian financial and capital markets. To unblock codes after the deadline, investors must submit a copy of the form attached to Resolution CMN No. 2,689/2000, signed by the investor, to the CVM, subject to standard analysis timelines rather than the 24-hour new registration period. The CVM assumes no responsibility for losses resulting from blocked codes.
CIRCULAR LETTER/CVM/SIN/No. 005/2000
Rio de Janeiro, 07/25/2000
Subject: Re-registration of Foreign Institutional Investors – Annex IV
Dear Sir,
As provided in CMN Resolution No. 2,742, of 06/28/00, the deadline for foreign institutional investors registered under the terms of the Annex IV Regulation to CMN Resolution No. 1,289, of 03/20/87, to adapt to the new investment system provided for in CMN Resolution No. 2,689, of 01/26/00, has been extended until September 30, 2000.
Thus, we alert you to the fact that investors who do not re-register in accordance with the guidelines in the "Non-resident Investors" item on the CVM website (www.cvm.gov.br) will have their operational codes blocked starting 10/01/2000, which will prevent them from carrying out operations in the Brazilian financial and capital markets.
In order for the codes to be unblocked after 09/30/2000, the investor's representative must file with the CVM a copy of the form attached to CMN Resolution No. 2,689/2000, duly signed by the investor.
It is emphasized, however, that the analysis of code unblocking requests will be subject to the CVM's normal analysis deadlines and not to the 24-hour deadline provided for in the registration of new investors in Article 3 of CVM Instruction No. 325/00.
Therefore, we request that representatives make efforts with investors to ensure that they complete the re-registration by 09/30/2000, since this CVM will not be responsible for any damages resulting from operations that may be rendered unfeasible due to the blocking of operational codes.
Sincerely,
