Rule · BCB · 24 Jan 2005 · Carta Circular 3160
Financial institutions, other entities authorized by the Central Bank of Brazil, and consortium administrators must update data in the Unicad Information System’s Basic Data, Installations, Links, and Organizational Structure modules by March 31, 2005. Entities with over 1,200 installations must use specific filters to verify all locations, while credit cooperatives have specific exemptions or requirements for auditor links. Compliance registration requires selecting "Various" in the compliance module and noting "Unqualified Compliance" if no issues exist. Failure to meet these deadlines or register incorrect data subjects entities to penalties under Resolution 2,901 of October 31, 2001.
Discloses procedures necessary for updating and ensuring data compliance in the Central Bank's Unicad Information System.
In accordance with Article 1, paragraph 3, of Circular 3,165 of December 4, 2002, we communicate that financial institutions, other entities authorized to operate by the Central Bank of Brazil, and consortium administrators must, by March 31, 2005, carry out the following procedures necessary for registering compliance with the data contained in the Basic Data, Installations, Links - Independent Auditor, and Organizational Structure Modules of Unicad:
I - BASIC DATA MODULE:
Access the basic registration data of the entity, consulting the "Basic Data - Consultation/Alteration - Legal Entity" module for its statutory members and those responsible for sending information, as well as the "Basic Data - Consultation/Alteration - Natural Person" module, and proceed to verify all this data, registering any necessary updates and corrections.
II - INSTALLATIONS MODULE
Access the data related to installations, consulting the "Installations - Consultation/Alteration" module and selecting, on the initial consultation screen, in the "Other Criteria" box, in the "situation" field, the option "in operation." If the entity has more than 1,200 installations, the search must be carried out in as many stages as necessary to obtain all installations registered in the system, using the available filters, namely: "Type of Installation," "Type of Dependency," "State (UF)," and "Municipality."
After verifying all data, proceed as follows:
a) make corrections using the "Installations Consultation / Alteration" module; and
b) register the inclusion of an existing installation not currently in the system, accessing the "Installations - Inclusion" module.
To assist in the verification process, institutions/companies wishing to obtain a list of their installation data may request, by February 18, 2005, via the electronic address dinfo.defin@bcb.gov.br, a magnetic file containing such information.
III - LINKS MODULE - Independent Auditor:
Access data on the independent auditor, until obtaining detailed visualization of the data regarding the hiring of the auditor, consulting the "Links - Consultation/Alteration - Identification Criteria - Type of Identifier of the Linked Entity" module (provide the entity's identification) - "Other Criteria - Type of Link" (select "Independent Auditor") and "Status of the Link" (select "Current"), proceeding as follows:
a) register data regarding the contract signed with the independent auditor, if not already registered, using the "Links - Inclusion - Independent Auditor" module; and
b) register the termination of an audit contract, if not already registered, using the "Links - Consultation/Alteration - Independent Auditor" module.
Singular credit cooperatives not affiliated with central cooperatives that opted for the hiring of a central credit cooperative in accordance with the sole paragraph of Article 27 of the regulation annexed to Resolution 3,106 of June 25, 2003, must select "Audit by Central Cooperative" in "Type of Link," to comply with the provisions of items "a" and "b" above.
Singular credit cooperatives affiliated with central cooperatives are exempt from the above procedures regarding independent auditor in the "Links" Module.
IV - ORGANIZATIONAL STRUCTURE MODULE:
Access the data of statutory members, directors responsible for areas of operation, and those responsible for sending information, until detailed visualization, containing data on election/appointment or indication of each natural person, consulting the "Organizational Structure - Consultation - Administrators - Entity Identification" module, and, after verifying all data, proceed as follows:
a) register the date of assumption of office of a statutory member, if not previously provided, using the "Occurrences - Inclusion - Communication - Link Communication (Contracts, Funds, Positions, Date of Assumption) - Communication of Date of Assumption of Statutory Member" module;
b) register the indication of a director responsible for an area of operation, if not previously provided, using the "Links - Inclusion - Director Responsible for Area of Operation" module;
c) register the indication of a person responsible for sending information, if not previously provided, using the "Links - Inclusion - Person Responsible for Sending Information" module;
d) register the termination of the term of a statutory member, if not previously provided, using the "Links - Consultation/Alteration - Statutory Member" module;
e) register the termination of the indication of a director responsible for an area of operation, if not previously provided, using the "Links - Consultation/Alteration - Director Responsible for Area of Operation" module; and
f) register the termination of the indication of a person responsible for sending information, if not previously provided, using the "Links - Consultation/Alteration - Person Responsible for Sending Information" module.
Other corrections possibly necessary in the data of the referenced modules and not covered by these instructions must be reported via electronic message (transaction PMSG 750 of Sisbacen) or by correspondence signed by a statutory director of the entity, addressed to the component of the Information Management Department of the Financial System to which it is subject.
The registration of compliance with registration data must be carried out using the "Occurrences - Inclusion - Control - Compliance - Compliance with Request for Compliance" module, selecting "Various" in the "Type of Compliance" field, inserting the current date in the "Compliance Date" field, the date of this Circular Letter in the "Base Compliance Date" field, and filling in the "Observation" field as follows:
a) with the expression "Unqualified Compliance," if there are no pending issues; or
b) with the expression "Qualified Compliance," accompanied by the number of the electronic message or the date of the letter, if there is a pending issue communicated during the validity period of this compliance request via message or correspondence addressed to the Central Bank;
Additional clarifications regarding the use of the System may be obtained on the Central Bank's website - icon "National Financial System - Unicad - User Manual" or from the component of the Information Management Department of the Financial System to which it is subject.
