Circular Letter No. 3730 — Discloses procedures to be observed for the registration of information regarding guarantees constituted on real estate related to credit operations under Resolution No. 4,088 of May 24, 2012, as regulated by Circular No. 3,747 of February 27, 2015

The Head of the Department of Financial System Regulation (Denor) and the Head of the Department of Financial System Monitoring (Desig), in the exercise of the authority conferred upon them by Article 23, item I, letter "a", of the Internal Regulations of the Central Bank of Brazil, annexed to Ordinance No. 84,287 of February 27, 2015, based on Article 3 of Circular No. 3,747 of February 27, 2015,

R E S O L V E:

Art. 1 The registration of information relating to guarantees constituted on real estate in credit operations governed by Resolution No. 4,088 of May 24, 2012, as regulated by Circular No. 3,747 of February 27, 2015, must comply with the format and layout established in the regulations of the registration system in which it is carried out.

Sole Paragraph. With respect to the information referred to in Article 1, § 1, items I to IV, of Circular No. 3,747 of 2015, the layout referred to in the main text must observe the guidelines related to the corresponding fields of document code 3040 – Credit Risk Data, according to the version available on the Central Bank of Brazil's website at the electronic address http://www.bcb.gov.br/?DOC3040.

Art. 2 The entities responsible for the registration systems must send to the Central Bank of Brazil, by the tenth business day of each month, the information registered therein, via the ACNV1501 file, in XML format (extensible markup language), in accordance with the layout and other documents available on the Central Bank of Brazil's website at the electronic address http://www.bcb.gov.br/?INFOL.

Sole Paragraph. The file referred to in the main text must include information from records made up to the last business day of the immediately preceding month, disregarding records linked to credit operations that have been settled and have already been sent with the inclusion of the settlement date.
