CONCERNING
REPORTING BY ISLAMIC COMMERCIAL BANKS AND ISLAMIC BUSINESS UNITS THROUGH THE FINANCIAL SERVICES AUTHORITY REPORTING SYSTEM
In view of the establishment of the Financial Services Authority Regulation Number 63/POJK.03/2020 concerning Reporting by Commercial Banks through the Financial Services Authority Reporting System (State Gazette of the Republic of Indonesia Year 2020 Number 297, Supplement to the State Gazette of the Republic of Indonesia Number 6604), it is necessary to regulate the implementation of the aforementioned Financial Services Authority Regulation in the following Circular Letter of the Financial Services Authority:
I. GENERAL PROVISIONS
Islamic Commercial Banks (BUS) and Islamic Business Units (UUS) compile and submit Reports to the Financial Services Authority that are complete, accurate, current, whole, and comparable.
The Reports referred to in item 1 consist of:
a. Structured Reports; and b. Unstructured Reports.
The compilation and submission of Structured Reports as referred to in item 2 letter a is conducted when BUS and UUS have obligations, meet criteria, and/or carry out specific activities in accordance with the provisions of legislation.
Example:
Periodic bancassurance reports are submitted by BUS that has a license and carries out bancassurance activities.
The provisions of legislation as referred to in item 3 for Structured Reports include, among others:
a. Financial Services Authority Regulation concerning the obligation to provide minimum capital for Islamic commercial banks; b. Financial Services Authority Regulation concerning the assessment of the quality of assets of Islamic commercial banks and Islamic business units;
c. Financial Services Authority Regulation concerning the application of consolidated risk management for banks that exercise control over subsidiary companies; and
d. provisions of legislation concerning the maximum limits for granting credit and providing large funds for commercial banks.
The obligation to submit Structured Reports by BUS on a consolidated basis only applies to BUS that exercises control over subsidiary companies. The criteria for control in the consolidated Structured Reports of BUS are:
a. for Reports related to the risk and capital information group in accordance with the Financial Services Authority Regulation concerning the application of consolidated risk management for banks that exercise control over subsidiary companies; or b. for Reports related to the financial information group referring to accounting standards concerning consolidated financial statements.
BUS and UUS that have obligations, meet criteria, and/or carry out specific activities as referred to in item 3 but do not have data or transactions related to the data position of Structured Reports, must still submit tables without entries and/or filled with “NIHIL” (NULL/VOID).
Example 1:
BUS that does not have market risk exposure data for a certain period is still required to submit a table without entries, i.e., a table containing only the header of the risk-weighted asset calculation table for market risk in the minimum capital provision obligation report and risk-weighted assets.
Example 2:
BUS that does not have data on violations or exceedance of the Maximum Limit for Fund Disbursement (BMPD) for a certain period submits Reports with the entry “NIHIL” in the report on violations or exceedance of BMPD.
BUS and UUS are deemed to have submitted Reports if they have passed server validation, evidenced by proof of receipt from the Financial Services Authority Reporting System.
The reporting responsible official is a responsible officer who has the authority to designate reporting implementation officers with access rights to create, modify, or delete user IDs of reporting implementation officers as responsible officers in the Financial Services Authority Reporting System.
The reporting responsible official and reporting implementation officers have access rights to submit Reports through the Financial Services Authority Reporting System.
II. STRUCTURED REPORTS
f) for annual data positions, consisting of:
(1) Period I, Reports submitted no later than October 31 before the planned work year; (2) Period II, Reports submitted no later than November 30 before the planned work year; (3) Period III, Reports submitted no later than January 31 of the following year; and (4) Period IV, Reports submitted no later than April 30 of the following year, if there are reports that can be submitted. b. For UUS in the form of detailed financial information groups of UUS, namely:
b) Period II, Reports submitted no later than the 15th after the Report month, if there are reports that can be submitted; c) Period III, Reports submitted no later than the 21st after the Report month, if there are reports that can be submitted; d) Period IV, Reports submitted no later than:
(1) April 30 of the current year for the first quarter; (2) July 31 of the current year for the second quarter; (3) October 31 of the current year for the third quarter; and (4) January 31 of the following year for the fourth quarter, namely Business plan realization report; e) Period V, Reports submitted no later than:
(1) May 15 of the current year for the first quarter; (2) August 15 of the current year for the second quarter; (3) November 15 of the current year for the third quarter; and (4) February 15 of the following year for the fourth quarter, namely:
(1) Business plan realization report, for UUS owned by BUK whose inter-branch system is not online and has more than 100 (one hundred) branch offices in accordance with the Financial Services Authority Regulation on bank business plans; and (2) Financial publication report and quarterly financial performance information for the first, second, and third quarter positions; and
f) Period VI, Reports submitted no later than March 31 of the following year, namely Financial publication report and quarterly financial performance information for the fourth quarter position;
5) for semi-annual data positions, consisting of:
a) Period I, Reports submitted no later than the end of the month after the Report month, if there are reports that can be submitted; b) Period II, Reports submitted no later than the 15th of the second month after the Report month, if there are reports that can be submitted; and c) Period III, Reports submitted no later than:
(1) August 31 of the current year for the first semester; and (2) End of February of the following year for the second semester, namely Business plan supervision report; and
6) for annual data positions, consisting of:
a) Period I, Reports submitted no later than October 31 before the planned work year, if there are reports that can be submitted; b) Period II, Reports submitted no later than November 30 before the planned work year, namely business plan. If there are changes to the business plan, the deadline for submitting changes to the business plan is in accordance with the Financial Services Authority Regulation on bank business plans; c) Period III, Reports submitted no later than January 31 of the following year, if there are reports that can be submitted; and d) Period IV, Reports submitted no later than April 30 of the following year, if there are reports that can be submitted.
III. UNSTRUCTURED REPORTS
A. Unstructured reports for BUS, including:
b. Report on the appointment of public accountants and/or public accounting firms.
6. Reports mandated in accordance with Financial Services Authority Regulations on the implementation of risk management for Islamic commercial banks and Islamic business units, namely:
a. Risk profile report; and b. Other reports, if there are conditions that have the potential to cause significant losses to the Bank's financial condition.
7. Reports mandated in accordance with Financial Services Authority Regulations on products and activities of Islamic banks and Islamic business units, namely:
a. Report on the realization of the issuance of products and/or implementation of new activities; b. Plan to discontinue products and/or activities;
c. Report on the realization of the discontinuation of products and/or activities initiated by the Bank;
d. Report on the realization of the temporary discontinuation of products and/or activities; e. Report on the improvement of products and/or activities following the temporary discontinuation of products and/or activities; f. Report on the realization of the re-issuance of products and/or re-implementation of activities; g. Report on the realization of the permanent discontinuation of products and/or activities ordered by the Financial Services Authority; and h. Action plan for the permanent discontinuation of products and/or activities ordered by the Financial Services Authority.
8. Reports mandated in accordance with Financial Services Authority Regulations on the minimum capital requirements for Islamic commercial banks, namely Minimum capital adequacy assessment reports in accordance with risk profiles.
9. Reports mandated in accordance with Financial Services Authority Regulations on the share ownership of commercial banks, namely:
a. Action plans to adjust to the maximum share ownership limits; and b. Reports on the implementation of action plans to adjust to the maximum share ownership limits.
10. Reports mandated in accordance with statutory regulations regarding Islamic commercial banks, namely:
a. Reports on changes in the Bank's ownership composition that do not result in a change of control; b. Reports on changes in basic capital;
c. Reports on the issuance of the Bank's shares through public offerings on the stock exchange;
d. Reports on the separation of the head office; e. Reports on the relocation of divisions or sections from the head office location; f. Reports on the implementation of changes to the Bank's name; g. Reports on changes to the articles of association; h. Reports on the appointment of members of the Sharia Supervisory Board;
i. Reports on the appointment, dismissal, or replacement of executive officials;
j. Reports on the dismissal and/or resignation of members of the Board of Directors, members of the Board of Commissioners, and members of the Sharia Supervisory Board; and k. Plans by the Bank and/or some Bank offices to conduct operational activities on non-operational days, holidays, and/or not operating on working days.
11. Reports mandated in accordance with Financial Services Authority Regulations on the assessment of competence and propriety of key parties of financial service institutions, namely:
a. Reports on the transfer of share ownership by prospective controlling shareholders not approved by the Financial Services Authority but who already hold shares in financial service institutions; b. Reports on the appointment of key parties of the Bank;
c. Reports on the cancellation of the appointment of prospective members of the Board of Directors and/or prospective members of the Board of Commissioners not approved by the Financial Services Authority but already appointed by the Bank; and
d. Reports on plans to change the business group structure related to the Bank, including the legal entity owning the Bank up to ultimate shareholders.
12. Reports mandated in accordance with statutory regulations regarding the implementation of good corporate governance for Islamic commercial banks and Islamic business units, namely:
a. Reports on governance implementation, including information on remuneration policies applying governance in providing remuneration; b. Reports on the results of Sharia Supervisory Board supervision;
c. Reports on changes in the business group structure related to BUS, including the legal entity owning BUS up to ultimate shareholders;
d. Reports by the Board of Commissioners on findings:
Reports mandated in accordance with Financial Services Authority Regulations on the utilization of foreign labor and knowledge transfer programs in the banking sector, namely:
a. Reports on the appointment of foreign labor as experts or consultants; b. Reports on the appointment of foreign labor as executive officials; and
c. Reports on the implementation of knowledge transfer obligations in the utilization of foreign labor.
Reports mandated in accordance with Financial Services Authority Regulations on the implementation of risk management in the use of information technology by commercial banks, namely:
a. Information technology development plans; b. Reports on the current status of information technology usage;
c. Reports on changes to information technology development plans;
d. Reports on the realization of activities as information technology providers; e. Reports on the realization of electronic banking service products; f. Reports on the realization of the operation of electronic systems located in data centers and/or disaster recovery centers outside the territory of Indonesia; g. Reports on the realization of the operation of information technology-based transaction processing to service providers outside the territory of Indonesia; h. Reports on critical events, misuse, and/or crimes in the operation of information technology that can and/or have caused significant financial losses and/or disrupted the Bank's operational smoothness; and
i. Reports on information technology audit results.
Reports mandated in accordance with Financial Services Authority Regulations on prudential principles in capital participation activities, namely:
a. Reports on the realization of capital participation; b. Action plans if the total portfolio of capital participation exceeds the capital participation limits;
c. Capital participation divestment plans;
d. Plans for the implementation of temporary capital participation divestment; and e. Reports on the implementation of capital participation divestment and temporary capital participation.
Reports mandated in accordance with statutory regulations regarding the requirements for commercial banks to conduct foreign currency business activities, namely:
a. Action plans for Banks experiencing a decline in core capital for 3 (three) consecutive months; b. Reports on the realization of action plans to adjust foreign currency business activities; and
c. Reports on changes to the list of Bank branch offices that will conduct foreign currency business activities.
Reports mandated in accordance with Financial Services Authority Regulations on prudential principles for commercial banks that outsource part of their work to third parties, namely:
a. Outsourcing plans; b. Reports on changes to outsourcing plans; and
c. Reports on problematic outsourcing.
Reports mandated in accordance with statutory regulations regarding the maximum limits for granting credit and providing large funds for commercial banks, namely:
a. Detailed lists of related parties to the Bank; b. Action plans to resolve violations of maximum fund distribution limits and/or exceeding maximum fund distribution limits; and
c. Reports on the implementation of action plans to resolve violations of maximum fund distribution limits and exceeding maximum fund distribution limits.
Reports mandated in accordance with Financial Services Authority Regulations on the assessment of the health level of Islamic commercial banks and Islamic business units, namely:
a. Self-assessment results of the Bank's health level individually; b. Self-assessment results of the Bank's health level consolidated;
c. Action plans related to bank health levels; and
d. Reports on the implementation of action plans related to bank health levels.
20. Reports mandated in accordance with Financial Services Authority Regulations on the implementation of commercial bank compliance functions, namely:
a. Compliance reports; b. Special reports on policies and/or Board of Directors' decisions that the director overseeing the compliance function considers to have deviated from statutory regulations;
c. Reports on the temporary replacement of the director overseeing the compliance function; and
d. Reports on the appointment, dismissal, or replacement of the head of the compliance unit.
21. Reports mandated in accordance with Financial Services Authority Regulations on single ownership of Indonesian banking, namely Reports on the progress of fulfilling regulations for Banks to be taken over by parties who have become controlling shareholders.
22. Reports mandated in accordance with Financial Services Authority Regulations on intermediary banks, namely Reports on the implementation of intermediary bank business activities.
23. Reports mandated in accordance with Financial Services Authority Regulations on the implementation of integrated governance for financial conglomerates, namely:
a. Reports on the assessment of integrated governance implementation; b. Reports on new financial conglomerates, changes in main entities, changes in conglomerate members, dissolution of conglomerates; and

2. In the event that financing is used to finance more than 1 (one) type of economic activity that cannot be separated, the classification method focuses on the priority economic sector (the sector that receives the largest share of facilities).
IX. Limit
Filled with the effective limit nominal of the financing facility before restructuring.
The entry of the limit amount in rupiah and foreign currency is expressed in millions of rupiah.
The limit for financing facilities is filled as follows:
a. Joint financing or syndication
Filled with the share of the limit for each participating bank. b. Other financing Filled with the limit amount according to the agreement or deed.
X. Financing Balance
Filled with the principal financing balance at the position of the Reporting month before restructuring.
The entry of the debit balance in foreign currency after conversion into millions of rupiah with the exchange rate on the last date at the end of each Reporting month for each account before restructuring. The exchange rate is the average of the buy and sell exchange rates based on the closing exchange rate of Bank Indonesia at the end of the Reporting month.
XI. Currency Type
Filled with a character of 3 (three) digits of the currency type code for the financing facility provided by the BUS before restructuring, referring to the reference code list for currency types according to the provisions of regulations regarding integrated general bank reports.

I. Type of Product, Activity, and Distribution Network
Fund transfer refers to fund transfers in accordance with the Law on Fund Transfers. International fund transfers consist of:
a. international incoming fund transfers, which are funds entering the territory of Indonesia with the reporting BUS customer acting as the final recipient of funds sent by the originating sender organizer located outside the territory of Indonesia; and b. international outgoing fund transfers, which are funds leaving the territory of Indonesia with the reporting BUS customer acting as the originating sender of funds sent to the final recipient organizer located outside the territory of Indonesia. International incoming or outgoing fund transfer transactions include international incoming or outgoing fund transfers of the BUS through sender or recipient organizers, whether in the form of Banks or non-Banks (including Money Gram and Western Union).
Cross-border correspondent banking (vostro), where the reporting BUS acts as the correspondent for a BUS located outside the territory of Indonesia. Meanwhile, correspondent banking refers to correspondent banking in accordance with the Financial Services Authority Regulation regarding the implementation of anti-money laundering and counter-terrorism financing programs in the financial services sector.
Cross-border correspondent banking (vostro) transactions include incoming fund transactions and outgoing fund transactions from the BUS's vostro account (accumulation of movements). Debit movements are summed with credit movements.
Distribution network refers to the distribution network in accordance with the Financial Services Authority Circular regarding the implementation of anti-money laundering and counter-terrorism financing programs in the banking sector.
Distribution Networks are divided into 2 (two) types, namely:
a. face-to-face distribution network, where transactions between customers and the BUS are conducted in-person, conducted in the same physical location and through physical interaction. For example, transactions conducted by customers at the BUS office through tellers and transactions conducted by customers through pickup service; and b. non-face-to-face distribution network, where transactions between customers and the BUS are not conducted in-person, not conducted in the same physical location and not through physical interaction. For example, transactions via telephone, email, ATM, mobile banking, video, and internet banking. Face-to-face distribution network and non-face-to-face distribution network transactions include all financial transactions conducted by customers on the BUS distribution network as long as:
a. the transaction adds or reduces the nominal amount of funds owned by the customer; and b. it does not include account movements arising from profit sharing, tax burdens, zakat, and BUS administration.

III. Office Code
Filled with a 9 (nine) digit number that must be unique as the identity of that office at the reporting BUS, which is established by each BUS and/or Bank Indonesia, with the following provisions:

Example:
Bank "A" receives the branch code for Bandung from Bank Indonesia, which is 999. The code is converted into 9 (nine) digits, i.e., 999000000. Bank "A" then establishes the sub-branch code in the Ciumbuleuit area, which is in Bandung city, with the code 999005000.
The office code is used consistently by the relevant office starting from inclusion in the bank's business plan, implementation of business activities, status changes, address changes, until office closure. An office code that has been used cannot be used again for another office even if that office has been closed.
Specifically for electronic banking terminals, if there is more than 1 (one) unit of electronic banking terminal owned by the BUS at a certain location, data is reported each with 1 (one) office code.
The method of filling the office code is as follows:
a. an office code that has been opened cannot be opened again; b. an office code that has been relocated cannot be opened again;
c. an office code that has been closed cannot be closed again; or

The Basic HR Data Report is filled with information regarding the data of active and departed BUS employees during the Reporting period. BUS HR individual data reported includes permanent and non-permanent employees. Example:
Non-permanent employees are employees directly contracted by the BUS for a specific period. These employees do not include outsourcing employees managed by third parties or labor service provider companies. Basic data for the Board of Directors, Board of Commissioners, DPS, and EOs is reported monthly in Table 1a, while basic data for officials 2 (two) levels below the Board of Directors who are not included as EOs, up to staff-level employees, is reported semi-annually in Table 1b. (i) Filled with the time to fill vacant positions, which is the time required to fill a specific position from the time the position is vacant until the candidate employee accepts the offer to fill the position. (ii) Filled in units of days.

(i) Filled with the average recruitment cost, which is the average cost incurred to recruit 1 (one) member of the Board of Directors, member of the Board of Commissioners, DPS member, or employee. The calculation formula is:

(i) The term "mandatory leave" refers to the number of leave days that must be taken for how many consecutive days (block leave), as regulated in the internal policy of the BUS. (ii) In the event that the BUS has a policy for varying block leave days among positions, the number of days is filled with the minimum block leave days applicable to all employees. (2) Guidelines for Filling Out
The Bank Human Resources Remuneration Report is filled out with information on the range of minimum, maximum, and average remuneration policies for employees per position level and per position grade (grade) in the current year.
Remuneration is compensation established and given to members of the board of directors, members of the board of commissioners, members of the Sharia Supervisory Board (DPS), and/or employees, whether fixed or variable, in cash or non-cash form, according to their duties, authority, and responsibility.
Parameters for fixed remuneration and variable remuneration are in accordance with the Financial Services Authority Regulation regarding the application of governance in the provision of remuneration for Sharia commercial banks and Sharia business units, namely as follows:
(a) Fixed remuneration is remuneration that is not linked to performance and risk, including basic salary, facilities, housing allowance, health allowance, education allowance, holiday allowance, and pension. (b) Variable remuneration is remuneration that is linked to performance and risk, including bonuses or other forms equivalent to it.
Information filled in Table 8 for the first semester period will contain data on the accumulated remuneration amount of the previous year because accumulated remuneration data for the current year is not yet available. Whereas for the second semester period, the reported data covers the accumulated remuneration amount data for the current year (annual).

(2) Guidelines for Filling Out
(a) Shareholder data is reported semi-annually, filled with data:
i. Controlling Shareholders (PSP) of a BUS, whether legal entities, individuals, and/or business groups. PSP is a shareholder according to the Financial Services Authority Regulation regarding single ownership in Indonesian banking;
ii. PSP of a BUS that is a public entity; and
iii. non-PSP shareholders with ownership of at least 5% (five percent).
(b) In the event of a change in shareholders within the reporting period, information on previous shareholders is also reported. (c) Example:
The PSP of BUS "ABC" changed from PT "XYZ" to PT "DEF" in December 2020; the PSP information reported in the second semester of 2020 includes information on PT "XYZ" and PT "DEF".

The format and guidelines for filling out the Financing Restructuring Report for UUS refer to Chapter II item 1.a Financing Restructuring Report in the Appendix of this Financial Services Authority Circular.
This Report data contains at most 10 (ten) debtors. UUS continues to report this Report even if the data is less than 10 (ten) debtors.
For UUS that do not have write-off debtors, they must still submit an empty table, i.e., a table containing only the header of the Largest Write-Off Debtor Monitoring Report table.
The format and guidelines for filling out the Largest Write-Off Debtor Monitoring Report for UUS refer to Chapter II item 1.b Largest Write-Off Debtor Monitoring Report in the Appendix of this Financial Services Authority Circular.
This Report data contains at most 15 (fifteen) debtors. UUS continues to report this Report even if the data is less than 15 (fifteen) debtors.
