COMMUNICATION "A" 455 20/02/84
TO FINANCIAL INSTITUTIONS, EXCHANGE HOUSES, EXCHANGE AGENCIES AND OFFICES AUTHORIZED TO OPERATE IN FOREIGN EXCHANGE AND EXCHANGE BROKERS:
Ref.: Circular INFORMATION REGIME FOR FOREIGN EXCHANGE OPERATIONS AND OBLIGATIONS WITH ABROAD - REFEX 1 -17 Survey of the external debt of the Public Sector as of 31.12.83
We address you in order to inform you that it has been provided that entities of the Public Sector must report their foreign-currency obligations with abroad as of 31.12.83 in accordance with the rules of this communication.
Entities and dependencies of the national, provincial and municipal public administration, national, provincial and municipal public banks, and entities detailed in Communication "A" 275, that were holders of such debts, must declare their obligations with abroad as of 31.12.83. All companies or majority state-owned or state-administered companies or societies not included in that last Communication, and that do not submit their declarations to the Survey of the external debt of the Private Sector provided by Communication "A" 418, must also do so.
All deferred-payment obligations in foreign currency, including overdue unpaid ones, contracted directly with creditors resident abroad, or directly through local financial institutions charged to their credit lines, whose original amount exceeds USD 5,000 or its equivalent in other currencies, are covered by this provision.
The debts that must be declared comprise obligations primarily originating in a) loans received, that is, whose foreign currency was negotiated in the foreign exchange market; b) imports of merchandise; c) services provided by residents abroad; and d) income generated by the aforementioned obligations and by direct capital investments. Likewise, obligations contracted to cancel or renew the primary obligations and those arising from the capitalization of the aforementioned services and income must be declared.
Public financial institutions authorized to operate in foreign exchange must declare their own obligations included in the preceding paragraphs, and the credit lines received from their correspondents abroad, reporting the amounts used thereof, the conditions agreed with their correspondents and the application of such lines.
Likewise, each entity must globally report the amount of its remaining obligations with abroad as of 31.12.83 that have not been agreed as deferred payment, as in the cases of cash-payment obligations pending cancellation as of 31.12.83, and current account balances in favor of residents abroad, as well as deferred-payment obligations whose original amount was less than USD 5,000.
The following must not be declared:
a) Commitments contracted for collections of exports anticipated prior to shipment or for prefinancing of exports and their interest, whether or not charged to credit lines of authorized financial institutions, as long as such obligations do not become financial loans in accordance with the provisions of Communication "A" 12 (COPEX -1).
b) Foreign-currency deposits in authorized financial entities and loans received by the Public Sector charged exclusively to them.
In order to determine whether a debt in a currency other than the dollar exceeds USD 5,000, the pass-through rate arising from the quotations of the Banco de la Nación Argentina as of 29.12.83 must be taken.
The submission of external debt declarations, duly certified in accordance with the provisions of point III, is an essential requirement for debtor entities to be authorized to cancel the obligations covered by this communication.
Public Sector entities covered in point I must submit, prior to the declaration of their obligations, form 5010 for registration in the Registry of Debtors with Abroad, whose model (Annex I) and instructions (Annexes II and III) are attached.
Entities registered in the Registry of Debtors must submit form 5013 (Annex IV) and, if necessary, complementary forms 5013 A and 5013 B (Annex II), for each of the obligations pending cancellation as of 31.12.83, completed in accordance with the corresponding instructions (Annex V). They must also submit form 5014 (Annex VI) summarizing the debts declared in form 5013, in which the global amount of the entity's remaining obligations with abroad must also be reported, completed in accordance with the instructions (Annex VII). The highest level of each jurisdiction must take the necessary measures to ensure that all obligations covered by this rule are declared by its dependencies, and to avoid duplication of submissions.
The duplicates of forms 2360, 2361, 2362, 3189, or 3191 of the Permanent External Debt Survey (Communication "A", REFLEX -1), corresponding to the obligations with abroad now declared as part of the debt statement as of 31.12.83, must be returned to the Central Bank, attached to the new declaration in form 5013.
The duplicates of forms 5013 and complements will replace for all purposes forms 2360, 2361, 2362, 3189 and 3191. The Central Bank will timely communicate the rules applicable for updating the obligations as of 31.12.83 and for declaring those contracted as of 1.1.84.
B.C.R.A. COMMUNICATION "A" 455 20.2.84
The forms included in this provision must be completed by machine and submitted in triplicate. All copies must be clearly legible. The original signature of the authorized official of the declaring entity must appear on all three copies. The certification and intervention referred to in point III of this Communication must appear, at a minimum, on the original copy of form 5014 and on the original and one copy of forms 5013, 5013 A and 5013 B. The duplicate will be returned to the declarant, with assigned number and date, as proof of having complied with this rule, with the original and the triplicate remaining in the possession of the Central Bank.
The receipt of external debt declarations does not imply giving conformity to the data reported by the declaring entity.
In case of loss of the aforementioned duplicate, the declaring entity must request, by note addressed to the Department of External Debt, a photocopy authenticated by the Central Bank, which will replace it for all purposes, with the applicant being obliged to return said photocopy in the event of finding the lost duplicate.
The Central Bank will not accept forms with errors or omissions in completion, even if they comply with the requirements set forth in point III.
Submissions to the survey will be signed by the official or officials who, by general or particular rules, or internal rules of the declaring entity, as interpreted by it, are authorized for this purpose. Declarations must satisfy the requirements set forth below:
a) Forms 5013 corresponding to obligations contracted charged to credit lines of local financial institutions, or to obligations with creditors resident abroad guaranteed or secured by local financial institutions, will be certified by said financial institutions.
b) Based on what was agreed by the Central Bank with the General Syndicate of Public Companies and with the Court of Accounts of the Nation, the auditors of the Syndicate and the fiscal accountants of the Court will submit a report on the debts as of 31.12.83 of the companies, offices and organisms whose external control is exercised by said entities, following the model of Annex IX, section A) (companies controlled by the Syndicate) or section B (offices and organisms controlled by the Court), as applicable, and using form 5016 (Annex VIII) for this purpose. The public banks of the Nation, of provinces and of municipalities must attach a report on their debts as of the survey date in form 5016 prepared by the professionals who perform the external audits of their quarterly and annual balance sheets, following the minimum guidelines of section C) of Annex IX. The remaining Public Sector entities will submit their declarations examined by the body that, in accordance with the applicable rules or regulations, verifies their financial statements for the purpose of external, or failing that internal, control of the entity, and provided that it corresponds according to those same rules. In these cases, the model of section A) or that of section B) may be used on an indicative basis, as applicable.
In all cases in which the aforementioned report takes place, the control body will also intervene the forms 5013 and 5014 that must be submitted to the Central Bank.
Entities that exclusively declare debts with local banks charged to their credit lines are excepted from the requirement of this report and from the intervention of the declarations.
As of February 22, 1983, the forms and instructions will be delivered, inquiries will be attended and declarations will be received at the premises of Bartolomé Mitre 300, Capital Federal, from 9 a.m. to 6 p.m. Entities residing in the interior may request forms, make inquiries and submit their declarations by mail, addressed to the Central Bank of the Argentine Republic, Department of External Debt, Reconquista 266, (1003) Buenos Aires.
Entities must register in the Registry of Debtors with Abroad (form 5010) by 5.3.84. The debt declarations (forms 5013 and complements), and the debt summaries (form 5014) must be in the possession of the Central Bank before 16.3.84. The reports of the control body (form 5016), if their submission corresponds, may be sent to the Central Bank after that last date, to the extent required by the review tasks; in this case, the Central Bank will be informed of the expected date of submission of the report.
Public sector entities that have certified their declarations by financial institutions in accordance with the provisions of point III. a), must exhibit before the certifying entities, after their submission to the survey, the duplicate of forms 5013 intervened by the Central Bank, so that the financial institutions can comply with the obligation determined in the last paragraph of point V.
Entities authorized to operate in foreign exchange of the Public Sector must declare their own obligations with abroad, including credit lines received from their correspondents abroad. All their submissions will be made by completing form 5013 and complements 5013 A, 5013 B or 5018, as applicable, and forms 5014 (Summary of debts) and 5016 (report of the control body).
Public and private financial institutions must certify the submissions of Public Sector debtors that refer to obligations charged to their credit lines and to obligations guaranteed or secured by the same entities, in accordance with point III. For this purpose, they must inform their debtors as of 31.12.83 of the obligations in force at that date that were charged to their credit lines and those that were guaranteed or secured, so that the debtor entities can proceed to submit their individual debt declarations.
B.C.R.A. COMMUNICATION "A" 455 20.2.84
Public and private financial institutions must take the necessary measures so that their Public Sector clients for obligations charged to their credit lines submit without errors the declarations provided for in this Communication, for which they will consult the Central Bank on situations giving rise to doubts. Until 30.3.84, public and private financial institutions will have a deadline to communicate to the Central Bank the list of Public Sector debtors charged to their credit lines and of obligations guaranteed or secured by them, that have not submitted to the Central Bank duly certified the corresponding debt declaration forms. For this purpose, financial institutions must send to the Department of External Debt a list, indicating for each operation the entity holding the obligation, its jurisdiction, its registration number in the Registry of Debtors, the name of the creditor, the date and concept of the operation and the currency and amount of the obligation, in that order.
We greet you very attentively.

Entities that are debtors of the Public Sector must submit one copy of form 5013 and, if necessary, supplementary forms 5013 A and 5013 B, for each of the obligations covered by this rule pending cancellation as of 31.12.83, in accordance with the scope of the definitions included in these instructions.
With respect to commercial debt, one form 5013 must be completed for each documentary credit (letter of credit, collection, etc.). Declarations of commercial obligations may alternatively be made for each shipment.
With respect to financial debt, one form 5013 must be completed for each disbursement, except in cases of multiple disbursements where the loan contract establishes a common interest rate for all disbursements, the same currency and a consolidated payment plan, and there is a single authorized intervening entity. In this case the disbursements must be reported jointly on a single form 5013.
Credit lines that must be reported by financial entities constitute a financial debt with multiple disbursements. Financial entities may submit their declarations by completing a single form 5013 for obligations under a credit line with the same correspondent creditor, the same country of domicile of the creditor, the same currency of payment and the same interest rate (with the exception mentioned in item 45). When these conditions are not met, separate forms must be used.
If the debt falls within the concept "Other Debts" (see item 16), one declaration is completed for each obligation.
Forms 5013 A and 5013 B are intended to supplement the information provided in form 5013 when the space allocated to the payment plan (principal or interest) is insufficient to cover all the installments that must be declared.
These forms (5013 and supplementary) must be completed by machine and submitted in triplicate. The original and the duplicate must be prepared on forms provided by the Central Bank, and a photocopy of the original may be submitted as the triplicate. The three copies must be clearly legible. Erasures or amendments, if any, must be corrected in the space of item 50. The original signature of the authorized official must appear on each form and on the copies. The intervention of the control body, where applicable, must appear on the original and on the duplicate, at a minimum.
All declared amounts must be written without cents. Numeric information must be completed aligned on the right margin of the corresponding boxes without using periods or commas. Dates are indicated with numbers, using two digits for the day, two for the month and two for the last two digits of each year.
(The instructions contained in items 1.a5. and 14. apply to forms 5013 and supplementary forms. The instructions contained in items 6. to 13. and 15. to 35. apply only to form 5013).

Report the country code of the domicile of the natural person or legal entity declared in item 8. In accordance with the corresponding table added as Annex X of this communication. When the creditor is an international organization (e.g. IBRD, IDB, IFC), code "200" is assigned in accordance with the provisions of the respective table of Annex X. When only "Credit Line" has been reported in item 6, "999" is written.
Assign a number in accordance with the following table:
1- International organizations (e.g. IBRD, IDB, IFC).
2- Government financial institutions of other countries (e.g. EXIMBANK).
3- Foreign commercial banks.
4- Syndicated loans.
5- Holders of securities and bonds issued by the public sector in foreign currency.
6- Foreign suppliers.
7- Other foreign private creditors.
8- Other foreign public creditors.
9- Foreign credit lines of local banks.
The number is assigned in accordance with what is declared in item 6. Number 9 is assigned when the legend "Credit Line" or the name of the exporter followed by the legend "Credit Line" has been written.
Report whether the obligation had been previously declared to the B.C.R.A. If so, complete item 49. (Replaced forms).
Report the name of the local financial entity that intervened in the structuring of the commercial operation being declared or in the foreign exchange negotiation of a loan. In the case of operations financed by a local bank through a foreign credit line, the financial entity reported in this item is also the creditor. It is crossed out with a line in the case where there was no intervention of a local entity or where the declarant is an authorized financial entity.
Reserved for the B.C.R.A.
Report the currency in which the obligation was contracted and its code in accordance with the corresponding table added as an Annex to this communication.
Report the currency in which it was agreed to pay the obligation and its code in accordance with the corresponding table added as Annex X of this communication.
Mark with "X" the concept of the obligation, in accordance with the classification indicated. A single concept must be marked.
"Commercial Debt" must be considered any obligation originating directly in imports even when a local financial entity has intermediated in the operation using a credit line. Likewise, "Commercial Debt" is considered that which responds to a contract by which a debt for imports is renewed, through direct agreement with the suppliers. Current interest due and unpaid as of 31.12.83 or maturing, originating in "Commercial Debt", as long as the obligation to pay the principal subsists, must be reported together with the principal obligation in the part corresponding to interest of the payment plan. The declaration of commercial debts must be made by completing items 17. to 20. inclusive, crossing out with a line the spaces corresponding to items 21. to 35. "Financial Debt (Credit Line)" must be considered the obligations contracted by entities authorized to operate in foreign exchange with their correspondents abroad, in accordance with their own modality (e.g., special accounts, advances, acceptances, "call", etc.). In the case of these obligations, financial entities must complete item 21. crossing out with a line the spaces corresponding to items 17. to 20. and 22. to 35. Financial entities must report the conditions agreed with their foreign creditor and not the conditions governing the applications of those credit lines with their clients. "Financial Debt (Loans and Repo Operations)" must be considered any credit received in foreign currency, whether settled by the declarant in the local foreign exchange market (entered loans) or applied by the declarant for the operations mentioned in items 28. to 33. (non-entered loans). This concept includes debts contracted with local financial entities through the use of their credit lines. Obligations originating in imports that were renewed with exchange insurance must be classified as financial. Loans from international organizations must in all cases be declared as "Financial Debt". Repo operations, including those of financial entities themselves, constitute a particular case of financial debt, even when they have been used to cancel imports. Current interest, due and unpaid as of 31.12.83 or maturing, originating in "Financial Debt" (Credit Lines, Loans and Repo Operations)", as long as the obligation to pay the principal subsists, must be reported together with the principal obligation in the part corresponding to interest of the payment plan. Declarants of this type of obligation must complete items 22. to 33, crossing out with a line each of the spaces corresponding to items 17. to 21., 34. and 35. "Other Debts" must be declared as obligations originating in the deferred payment abroad of services or income, penalty interest and default interest. Current interest owed for commercial or financial obligations is included in this category only in the case where the obligation to pay the principal does not subsist. Freight (when its declaration by the importer is not applicable in accordance with the
provisions of item 20.), profits and dividends, royalties and in general, all concepts included in the respective table of Annex X, whose payments have been deferred, form part of this group of

obligations. In the following space "Specify" the pertinent concept is indicated and the code is assigned in accordance with the table of concepts added as Annex X to this Communication. If the concept "Other Undifferentiated Obligations" of the table of concepts of that Annex is reported, its nature must be explained in accordance with the instructions given in item 50. (Observations). When these obligations are declared, items 34. and 35. must be completed, crossing out with a line the spaces corresponding to items 17. to 33.
17. Report the shipment date in accordance with the corresponding documentation. In the case of a documentary credit with multiple shipments, the date of the first shipment must be mentioned as the shipment date.
18. Mark with "X" the class of instrument used in the import in accordance with the groups indicated. "Drafts" will be reported when this document is used and there is no Letter of Credit or Collection.
19. Mark with "X" according to whether it is an import of current or capital goods. "Capital" goods are considered those included in the list of Annex I of Circular COPEX - 1 (Communication "A" 12 and its update by Communication "A" 60); the remaining goods are considered "current". In the case where the operation comprises goods of both types, the one with the greater participation in the value of the obligation being declared must be reported.
20. Report the breakdown of the original amount of the debt expressed in the currency of origin, without cents, even when the debt is partially cancelled as of 31.12.83. It is emphasized that the original amount of the debt must be understood as only the deferred part of the value of the import. In the case of multiple shipments, which are reported jointly in accordance with the conditions of the documentary credit, the accumulated value of the deferred payment amounts of said shipments must be declared as the original amount of the debt. The concepts "freight", "insurance", etc., must only be reported in the case where they form part of the total amount of the debt originally contracted with the creditor and must be included in "Others". The interest of these obligations must not be reported in this item; for their declaration, the procedure indicated in items 36b. to 42.b. must be followed.
21. Entities authorized to operate in foreign exchange must report globally the destination given to each credit line obtained from their correspondents abroad, using one form 5013 for each credit line. Credit lines in foreign currency under agreement must also be included. In "Financing of exports" (item 21 a.) loans or advances granted to local exporters against future collections for exports are included. In "Financing of exports" (item 21b.) applications to letters of credit or other financing instruments to importers for shipments already made are recorded. In "Financial loans with forward cover" (item 21c.) the amounts of the credit line applied to local loans are indicated, according to whether or not there is forward cover through insurance or through repo operations in favor of local borrowers. In "Other applications" (item 21e.) other destinations not specified above are reported. In "Unapplied amount" (item 21f.) the amount of the credit line not lent to residents in the country is reported. All amounts must be expressed in the currency of origin of the debt with the foreign creditor (item 14.), without cents. The date of granting of the credit line is reported in 21g.
For the purpose of declaring the applications of each credit line, the information from the accounting records of the financial entity may be used.
With respect to credit lines in foreign currency received from abroad by a local financial entity and granted partially or totally to another local financial entity, the following procedure must be followed: the entity that received the line directly from abroad must report the total amount, including the amounts transferred to other financial entities. For the purposes of the breakdown of item 21., it must indicate the applications made by the local financial entity to which the credit line was transferred. For this, the latter entity must provide the former with the information on the applications made. The information on the entity or entities to which the line was transferred and the corresponding amounts must be added in item 50. (Observations) of the declaration of the granting entity. Local financial entities receiving credit lines in foreign currency from other local financial entities must not complete form 5013 for the obligations corresponding to said operations.
22. Report the date on which the first or only disbursement of the current contract was made, whether or not it gave rise to an inflow of foreign currency. In the case where the contract is expired and not renewed, or the terms have been extended, the date of the first or only disbursement of the original contract will be reported.
23. Report the amount of foreign currency negotiated in the foreign exchange market, corresponding to the contract being declared, expressed in the currency of origin of the obligation (item 14.), without cents. This amount is equal to the sum of the amounts negotiated in the foreign exchange market, in the case of loans with multiple disbursements.
24. Report the date on which the foreign currency corresponding to the last or only disbursement was settled in the foreign exchange market.
25. Mark with "X" the class of form used to declare the sale of foreign currency by the debtor corresponding to the last or only disbursement and indicate its letter and number.
26. Report the non-entered amount of the obligation, without cents, which must be equal to the sum of the concepts set out in items 28. to 33.
27. Report the original amount of the loan by adding the concepts "entered" and "non-entered" (items 23. and 26.), regardless of whether at the date of the declaration the obligation was partially cancelled.

This declaration must be signed by authorized officials of the declaring dependency.
The intervening entity must certify whether the operation is charged to its foreign lines of credit. The same entity must also certify the guarantees or sureties it granted and that were reported in this form (item 47.). The following criteria must be applied:
a) Declarations of obligations for imports instrumented through confirmed letters of credit must be certified by marking in this item "charged to line of credit". The same criterion may be followed with respect to unconfirmed letters of credit that directly or indirectly affect the available borrowing capacity with the correspondent. Also certified under this heading will be "fallen" guarantees or sureties that as of 31.12.83 were debited by the correspondents.
Declarations certified as "charged to line of credit" must form part of the obligations for lines of credit that the entities declare globally, except for the lag between the shipment date and the date of recording by the entities.
For guaranteed or secured drafts and letters of credit not certified in accordance with the preceding paragraph, "guarantee or surety granted" must be marked. Said guarantee or surety must also be reported by the declarant in item 47.
Imports with other instrumentation different from those mentioned above, provided they do not entail payment responsibility or guarantee or surety by the intervening banking institution, must not be certified by said institutions.
b) In relation to the information that must be supplied to the Central Bank about the holders of commercial obligations that must present for certification the declaration forms corresponding to 31.12.83, the authorized entities may use the information from their accounting records as of 31.12.83. Based on such data they will determine the obligations of the Public sector, for shipments completed prior to 31.12.83, that are charged to their lines of credit or guaranteed or secured.
To the extent that the recording of commercial operations of later months or any other procedure allows detecting commercial obligations not declared by their public sector clients, with shipment date prior to 31.12.83, the authorized entities must immediately inform the Central Bank of such situations.
c) Local financial entities receiving lines of credit from other local financial entities must certify the submissions of public sector debtors that refer to obligations charged to those lines of credit.
d) In the case that an obligation charged to a line of credit of one entity has been guaranteed or secured by another authorized entity, the certification will be extended by the authorized entity that granted the loan.
e) With respect to loans granted by the entities and partially financed with foreign lines of credit and partially with lendable capacity originating from foreign currency deposits, the certifying entity will write the legend "PARTIAL" followed by the percentage indicating the proportion in which said loan is financed from its lines of credit.
